[redacted] CONTRACTING LICENSE #Scooter Way Murrieta, CA ###-###-####February 8, 2018TRANSMITTED VIA EMAIL ONLY Bertha Bejarano Revdex.com WShaw Lane Fresno, CA [email protected] Re: Complaint #made by [redacted] Dear MsBejarano:I am in receipt of your correspondence of January 28, 2018, which I received on February 3, Thank you for the opportunity to respond to the complaint made against Crazy Frogs, Inc., dba [redacted] Contracting by [redacted] regarding improvements performed at Ms [redacted] ’s residence located at Corte Capistrano, Temecula, CA.In May of 2017, I was contacted by [redacted] of Simply Slabulous, Inc Ms [redacted] requested that I provide a proposal for work to be performed at Ms [redacted] ’s residence per the plan and itemized list provided to me by Ms [redacted] on May 31, (copy attached as Exhibit “A”) In response to Ms [redacted] ’s request, I provided a detailed proposal to for work to be performed at Ms [redacted] ’s residence A copy of my June 19, proposal in the amount of $3,is attached hereto as Exhibit “B” The proposal was forwarded via email to Ms [redacted] and was accepted by Ms [redacted] Between July 24, through August 5, 2017, my crew and I and a drywall subcontractor, performed work at Ms [redacted] ’s residence We completed as much work as possible (described in the June proposal) However, we were precluded from completing all of the work due to the delay of other sub-contractors who were installing counter tops at Ms [redacted] ’s residence I contacted Ms [redacted] every other week for a status of the work being performed at her residence in order to schedule a time to complete my work For example, on October 31, 2017, I contacted Ms [redacted] via text message and asked for a status update She responded “Just getting counter tops installed this week, thanks for checking.” Then on November 6, 2017, Ms [redacted] communicated with me via text message and stated that [redacted] at Simply Slabulous helped her to complete the rest of her kitchen and that she felt bad due to all of their delays and problems On November 17, 2017, I communicated with Ms [redacted] via text message and asked when we could discuss my final bill Communication between myself and Ms [redacted] remained extremely amicable until such time that I sent my final invoice to her on December 2, in the amount of $1,(copy attached hereto as Exhibit “C”) I gave Ms [redacted] a credit in the amount of $for work which I was advised was completed by another contractor Copies of the text messages between myself and Ms [redacted] are attached hereto collectively as Exhibit “D”.On December 28, 2017, I met with Ms [redacted] at Simply Slabulous, per her request, to review my final invoice I greeted Ms [redacted] with a friendly hug and we sat down to discuss my invoice I was NEVER angry with her I met with her for the purpose of coming to a mutually amicable settlement of my invoice in the spirit of cooperation Ms [redacted] immediately became very upset and refused to move forward with any discussion about resolving the matter She insisted that she did not owe me any monies for the work itemized in the December invoice As a result, I placed a lien on Ms [redacted] ’s property for the unpaid balance A copy of the lien and invoice for the lien is attached hereto as Exhibit “E”My entire family has been in the construction industry for decades I take great pride in carrying on the traditions and craftsmanship passed on to me by my dad, my uncles and my grandfather It is my mission to provide quality construction projects at a reasonable price I take great pride in my work and I always strive to go above and beyond the client’s expectationsHowever, at the end of the day, I expect to be paid for the work I provide.Please do not hesitate to contact me if you have questions regarding the attachments, and/ or if you need further information regarding my response to Ms [redacted] ’s complaint I remain willing to discuss this matter with her further, in the presence of her representative from Simply Slabulous, in order to resolve this matter.Kindest regards,/s/ [redacted] ***,PresidentCrazy Frogs, Inc., dba [redacted] Contracting

I am rejecting this response because: Mr***, as a licensed contractor in the state of California, knew that it was his responsibility to provide me with an itemized (listing out amounts for materials and labor) contract for the two of us to sign before initiating a job. (This is according to the California Contractors State License Board.) Not only did he not do so, he purposely mislead me into believing that one was not needed by telling me that since we were "going through Simply Slabulous, it's not needed." He intentionally deceived me. The work that he and his crew completed, as evidenced by the attached photos, was substandard. The measurements in the photos clearly show how far all of the measurements are off. Additionally, the pass thru, which was to measure 45.5" across, is less than 44" across the opening. I couldn't get any more photos to attach here, but the walls on each side of the opening over to the cabinets were supposed to be 3". One side measure 3.25" (no big deal) and the other side measures 4.25" (now it is a big deal). Mr*** himself admitted (at our Decmeeting with *** ***) that he never came out to look at all of the mistakes after he received these photos from *** ***, formerly the designer at Simply Slabulous, but instead sent out one of his crew to attempt to correct the misshapen opening. When that attempt failed, he sent out a couple of drywall guys to attempt to correct the mistakes. The opening has never been completely corrected, and he was aware of my dissatisfaction with this. Due to these problems, and my also finding out that he did not have workers compensation insurance for "his crew" that was working in my home, I did not want him or his crew back in my home. Being a year, career teacher, I tried to couch this in what I thought were the kindest words I could think of as I was worried about what he might do if he was angry. Mr*** is now trying to extort money from me for work that he did not do (which he admitted at our meeting on Dec28, 2017, with *** ***, the owner of Simply Slabulous). Mr*** and his crew also scratched, dinged, and chipped paint from my front door when they were removing the old kitchen cabinets from my home, which he said he would fix/repaint, yet never did. I have an estimate from another contractor for $to tear out and redo the pass-thru and arch correctly, plus repair and repaint the front door. If he really, as he states in his response, "takes great pride in" his work and "strives to go above and beyond the client's expectations," then why wasn't the work completed correctly after the first, second, and third attempts, and my door taken care of?Mr*** has also, in his response, attached a document that has never been seen by me, as it has never been given to me. That document is his exhibit E, "Notice of Intent to Lien," dated Dec13. I believe that this is a fraudulent document "cooked up" by Mr*** and *** ***, who is stated to be the "Collection Manager" of a business called "Lien on Us." Mr*** started threatening me with a lien on my home at the beginning of Dec2017, when he found out that I had others complete the work that was needed at my home and I was not going to pay him for work he did not do. Mr*** has not stepped foot in my home since he received a check for $from me on July 26, 2017, for the work he had completed at that timeNowhere on that receipt (copy attached) does it state that there is a balance due and Mr*** told me "that was it" until anything else was done. Since he has not done any more work since that time, which he admitted at our 12/28/meeting with *** *** at Simply Slabulous, he is not owed any more money. Work that Mr*** did not do and which was completed by others (see attached receipts) includes: reinstall all appliances (refrigerator, stove, dishwasher, microwave), install microwave vent, install sink drain and disposal, hook up kitchen faucet, pull plumbing through back of cabinets to sink and dishwasher, install undercabinet lighting. In addition, he did not repair/repaint the front door that he and/or his crew damaged.I had to request, multiple times, a meeting with Mr*** in an attempt to resolve this situation, whereupon he wanted money for work he hadn't done. (Nowhere on the receipt attached is it noted that there is a balance due.) In regards to Mr***' comment that he allegedly "greeted Ms*** with a friendly hug" at our Dec28, meeting with *** *** at Simply Slabulous, that is completely untrue, and *** is a witness for that. I believe that Mr*** has actually caught himself in a lie here for, why on Earth would he be greeted with a hug after repeatedly threatening me with putting a lien on my home, and after allegedly giving me a "Notice of Intent to Lien" on Dec13, 2017? I was the recipient of several shoulder squeezes/pats from Mr*** during the time that he worked at my home, all of them unwanted. He is not, nor has he ever been my friend. As a single woman, I was very uncomfortable and intimidated by his attempts to touch me. At the most, there should never have been anything physical other that a handshake offered by him at any time. At the time of our Decmeeting at Simply Slabulous, I walked in very upset and intimidated from Mr***' repeated threats to put a lien on my home, as *** *** would corroborate, and most certainly never hugged him. That is an absolute lie. When I walked into the meeting, Mr*** immediately began asking/pestering me, over and over, if I had checked my mail that day. When I finally asked him to stop, and why he kept asking that, he said that there was going to be a lien against my house in the mail, so I should be sure to check it. More threatening and intimidating behavior from him. (I have to wonder, with just us two women in the office, if Mr*** would have acted like he was doing if there had been another man in there.) It was not me, as Mr*** states in his response, that "refused to move forward with any discussion about resolving the matter," but Mr*** who stormed out of the office, as corroborated by *** ***' attached statement. Mr*** seems to forget that there was a witness present.I am a 25-year career teacher, well-respected as an honorable and trustworthy person in my community. My mom was a 25-year employee at the Escondido Police Dept., with years of that as the Administrative Assistant to the Chief of Police. I am requesting that Mr*** remove the mechanics lien he has placed on my home, and provide evidence of that to me. He never initiated a signed, itemized contract with me (his responsibility as a contractor, according to the CSLB), deliberately lied to me and misled me about that, did substandard work in my home that he never came back to look at instead sending one of his "crew" and drywallers to attempt that, had "his crew" working in my home without workers compensation insurance on them, and admittedly did not complete work for which he is trying to extort money from me. Additionally, the mechanics lien is invalid because it was filed outside of the legally allotted number of days in which Mr*** had to do so, plus I was never given a Pre-lien Notice, as required, when he first began work at my home. It should also be noted that he has attached a fraudulent document ("Notice of Intent to Lien") here with his statement which was never given to me/seen by me, and has deliberately lied about what happened at our Dec28, meeting, at which there was a witness.There was an attempt made, by myself and *** *** (owner of Simply Slabulous, the business I purchased my kitchen cabinets and counter top material from, and who initially recommended Mr***), to resolve this matter with Mr*** at a meeting on Dec28, at the Simply Slabulous office. He was presented with receipts from the other businesses who completed the rest of the work that he did not. He admitted he did not complete that work, and offered to "knock a couple of more hundred dollars off." Mr*** admitted he never came back to my home to look at the substandard work that was done, and is now telling lies about what occurred during that Decmeeting. I would request and hope that *** ***, owner of Simply Slabulous, be contacted for her version of this meeting if her attached statement is not sufficient corroboration of my account.
