***, ID [redacted] Let me start by saying that the customer doesn’t present the factsHis main complaint seems to be that I gave him extra photos and this is trueI do not understand how this is an issue since he is under no obligation to use the photosIn fact a headshot session is usually just to get one or two great shotsI included the extras more as notes of our session in case he changed his mindI cannot expect nor can a client expect every photo to be perfectHowever there are a number of quite wonderful and completely usable photos on the diskWhat he isn't telling you is that he is already using photos from our session and I can produce evidence of this even if he decides to try and hide this later on His second claim is that the disk looks amateur and thrown togetherThis is not the case but being art I can see where someone's style might not agree with someone else'sAll of the images including the extras are cropped and color balanced with basic editsThis disk is nothing more than a digital proof sheetMost of the images are usable but none of the images are fully retouchedI have explained to him, as I do other clients, that I will go back to the digital negatives (the raw files) and edit from the ground up including any requested retouching but only the one or two images they chooseHe has never selected photos to be retouched I do guarantee my workSince the customer is already using photos, I offered a reshoot but the client turned this downI would consider a refund but as I stated, the customer has not asked for a refund and the customer is already using the photos It is also important to note that before receiving the disk (which I provided as a courtesy since I usually only supply a download for this type of photo session) the customer had reviewed and approved the photos during our sessionI never accept payment until I get the client's approval at the end of the sessionThe customer asked for yet another favor of me, to narrow down the photos from our sessionI removed but archived photos I found redundantI normally do not do this for clients but this client insisted and so I didI also gave him a discountHe seemed nice enough at the time, in fact he seemed overjoyed at the experience and the photosHe was so happy and flattering that I even extended a discount to himFrankly I am guessing that being a much older man with poor skin, He probably viewed these again on his computer with an uncalibrated monitor and the shock of what he really looks like (especially on an uncalibrated monitor) was more than he could bareI feel bad for people who haven't seen closeups of themselves in a long time and are shocked, but that is no reason to take it out on me If he would have responded with a request for refund, reshoot, or even responded kindly to my explanation, before using the photos publicly, this entire issue would have been avoidedIf you need any other evidence or information please let me know What follows is our Email correspondence with no interactions removed.Customer - ***...no hard feelings, but I was very disappointed with the photos I didn't find anyone usable -(Customers name removed)Me- What's wrong or what's missing? If we agreed not to use any photos with a white background, why did he put them on the disc Why would a "professional" put two photos on the disc with quarter size yellow reflections from my glasses? I had to call to see if they were ready He stated he sent me a message saying they were readyHE DID NOT! He also said he would retouch the photos, which HE DID NOT! If anybody is unstable, it is Mr [redacted] and his bizarre behavior during the shoot He also said he lost the first disc and had to make another one, which is why it looks thrown together Where am I using those junk photos? I contacted another Actors WorkShop here in San Diego Their response was they would not recommend Mr [redacted] I would like a refund prior to going to Small Claims Court Thank you [redacted]
