Review: The painter was contracted for a full house painting. He has only painted 1/3rd of the house. We have paid him more than 1/2 the amount. Now he has discountinued to come. It is a job not finished according to contract.Desired Settlement: We want a refund of $1000 extra that we have paid him. Plus any extra amount that we will pay to get another painter to paint the remaining job.

Response:

1) I agreed to payment terms the client set forth and signed off on. 2) Client refused to use quality paints I recommended, instead buying low quality paints that prolonged the project due to poor coverage. 3) Client kept adding additional tasks to the scope of the project which they wanted for free. I provided them with many of their requests, free of charge, until we reached a point where I had to tell them that any additional work, outside the scope of the project was billable. They agreed to such an arrangement. 4) Client violated the payment terms of the contract as work progressed. 5) Though only light sanding an stain touch up for some of their windows was part of the contract, client asked me to additionally restore 20 or so 25 year old [redacted] windows. I agreed under the understanding this was additional work, and billable. The task was extremely time consuming, as it required complete sanding of all of the windows and their frames. 6) After it taking me nearly six days to complete that task, the client refused to pay me for the extra effort. 7) At that time, more than half the project had been completed, contrary to their claim, as all the labor intensive prep work had been completed, the additional window work performed, and at close to half of the painting and staining was completed. 8) I offered to return immediately to complete it, once they had paid for services rendered. At that point, they were $1100 in arrears. They refused my reasonable offer, and as they had violated the original contract, and the subsequent verbal agreement, I had no choice but to stop work at their house. Never before, or since, on any project, have I had to do so. 9) The client subsequently filed a complaint with the State’s Attorney General office, from which and I received no disciplinary action. I assume it was dismissed for the very reasons mentioned here. 10) To make matters even worse, they filed a claim with my insurance company alleging damages that I had not made at their property. With the exception of one small mark I had left on a ping pong table, that I had promised to repaint free of charge, none of the damages they claimed were as a result of my efforts at their home. For instance, they claimed that I ruined one of their carpets. The stain looked like someone had spilled tea on the carpet, and it preceded commencement of the project. No paint was spilled there, or anywhere else in their home, by me.
