*** *** (***)***Revdex.com Complaint *** (*** vsPaul Swoyer Septics)I am pleased that Paul Swoyer Septics (Swoyer) has supplied a response to my March complaint. I’m sorry that it required me following up with Revdex.com and Revdex.com following up with Swoyer. Unfortunately, this is consistent with Swoyer’s treatment ever since I didn’t back down on a contract issue regarding type of grass installed in the drip field.Below, I will comment paragraph by paragraph on Swoyer’s response to my complaint. I would like to note up front that over the approxmonths that the cracked coupling and associated warranty coverage issue has existed, Paul Swoyer Septics never bothered to come see the problem.PARAGRAPH 1:I agree with everything stated in the paragraph. Further, the system’s proper operation has been confirmed several times by the service company, Block Creek, since the system became operational. PARAGRAPH 2:I agree with the content except the “Apparently the leak and damage was done by someone else”. To my knowledge, only Swoyer and Block Creek have ever touched this system and I think it extremely unlikely that anyone would just open it and then do damage. There were emails exchanged among Swoyer, Block Creek, and myself on March that I summarized in an email to all parties as follows:“From my perspective, saying the system worked when it was turned on, doesn't say there can be no repair responsibility based on bad part(s) or faulty install that shows up down the road The only thing I know is I didn't do anything to cause the problem. I hired one company (Swoyer) to install and one company to service (Block Creek). From my perspective the potential causes of the cracked coupling are: faulty part that was just 'weak' when installed and took a few months to failsomething moved post installation that caused stress on the coupling and it cracked. something occurred while system was being serviced that cracked the coupling.please feel free to offer other possible causes, especially ones I should be responsible for. I'll capitulate quickly if someone can explain to me why this isn't one of your companies' responsibility to repair. All I can see is it's either a bad part, an install problem, or something occurred during periodic service that cracked the part.” Block Creek’s constructive response to this was:“If you can get the box dug up we will cover the cost of the part broken in the box out of good faith Again I do not believe we did anything wrong but do not want an unhappy customer” Swoyer’s answer was:“Box was driven in the ground broke coupler. She is saying you dig it up she will fix free pretty nice of her. Remember you held me to spray bid even tho it was drip , you got everything your getting from me free.” I responded with:“I just went out and looked at the box. ***, I think your assessment, minus the "driven in", is right. The pipe / coupler in question comes through the walls of the box with essentially zero clearance. Any activity on the box (e.gservice personnel working, kids playing) would put pressure on the pipe and could stress / crack the piping. I think that's an install flaw. How about you send somebody to dig the box (feet or so down), Block Creek does the pipe repair, and I do the backfill.” Swoyer responded with:“Not happening we passed inspection it was at least a year ago not exactly sure on time , only reason I installed job for you is because I honored my mistake , but I am done with you. Susie I would charge him for any repairs this guy doesn't deserve anything free, not a good guy thinks he is entitled and cheap. See where he had to add service tech to reason it broke. Like your guys are going to walk on the box!!! Done. I'm done” PARAGRAPH 3:Agree with everything except “Customer refused to do anything to assist in the matter ….”. In an email provided above I suggested “How about you send somebody to dig the box (feet or so down), Block Creek does the pipe repair, and I do the backfill.” Swoyer’s reaction to that was “NOT HAPPENING, GUY DOESN’T DESERVE ANYTHING FREE, NOT A GOOD GUY THINKS HE IS ENTITLED AND CHEAP”. The reality is Swoyer is the only party that refused to assist. PARAGRAPH 4:This is a VERY WRONG paragraph. The only times I was unhappy with Swoyer were 1) when they (***) pushed back hard, yelling and talking abusively to me, when I insisted the StAugustine grass mistakenly put down in the drip field be replaced with the Bermuda specified in our contract and 2) when they refused to cover the cracked coupling under warranty. PARAGRAPHs 5, 6, & 7: These paragraphs are self-serving to Swoyer and not consistent with my experience. Ever since the grass issue occurred, Swoyer has treated me awful, culminating in the refusal to do repairs under the contract warranty. NOTE: my name is “***”, not “***”. My take on what’s happened here is that Swoyer made or business mistakes that made my project not profitable to him and, for reasons I’ve yet to understand, transferred blame to me.Swoyer may have underbid my job; only he knows for sure. I had multiple competitive bids for a drip septic system design I provided to the bidders. Swoyer’s bid was the lowest, but not by a large amount. In one of Swoyer’s emails above he said “Remember you held me to spray bid even tho it was drip”. That’s just not true. Mr*** and I never had a discussion where I “held him” to anything other than putting in the contracted Bermuda grass.Swoyer made what was probably a costly mistake in putting down the wrong grass in the drip field Based on the above, I reject Paul Swoyer Septics’ response to my Revdex.com complaint. ***’s business mistake(s) and personal animus toward me can not be acceptable reasons to not provide the warranty coverage specified in our contract. *** *** (***) ***

I am rejecting this response because: Paul Swoyer Septics' answer is a non-answer They're unwillingness to meet they're warranty obligation forced me to handle myself and incur the associated cost That's just wrong, To Revdex.com,Is there anything you can do to help this along or is Paul Swoyer Septics' NO then end of it? Regardless of that answer, I hope and trust my complaint will be logged and visible to other potential customers of Paul Swoyer Septics

We installed a system for the customer March 2015; as part of our installation guidelines and regulations; we have to coordinate with the county for inspections to be done on the job so that the county can ensure that everything is working 100% on the septic systems and that all regulations were...

followed and obeyed when the system was installed; as part of the inspection from the county; they check for any leaks; test the operation of the tank and field and as mentioned if everything is not 100% installed; they do not give us the License to operate on the system; which makes the system 100% for operation by the customer. With that said when the servicing company went on site on March 2016 for one of the quarterly maintenance to the system and stated that when they opened the box where the leak is; they did not touch anything in the box and when they went and turned system on; the pump to test the psi; that's when the tech discovered the leak. We are unsure of how this leak came about but they assured us they did not do anything to cause the leak. Apparently the leak and damage was done by someone else. Customer was informed of the findings and we informed him that we would not fix for free and he was very unhappy with us for not wanting to come out and fixing it for free; but as we mentioned to the customer; system was installed 100%; the license to operate issued by the county 2015 and we should be held responsible for damages done to the system after the fact? Customer refused to do anything to assist in the matter; didn't want to be responsible for any fees related to us helping him; servicing company offered to get it fixed or looked at if he would dig up the box on the system, that they would fix the issue for free; and he was still very unreasonable and refused the help offered from them. Mr. [redacted] has been a very demanding customer and very unhappy from the beginning of the project; we did everything we could to try to accommodate his needs during the installation and even after the fact; but unfortunately there are some people that it don't matter how much you try to accommodate; they will never be happy and are always trying to get everything they can done for them at no charge. It is very unfortunate; as we strive to be known for our customer service; and our customers are our number one priority on satisfaction, and customer service. We are very sorry Mr. [redacted] is an unhappy customer, but we are confident that Mr. [redacted] was provided devotion from our staff, and we have tried to make him happy thought the installation and even after the fact; but unfortunately in this case; nothing we could ever do will ever make the customer happy. At Paul Swoyer Septics, LLC we believe that "quality" means personalized service that is timely, courteous, convenient, fairly priced, efficient and dependable; we strive for our customer's happiness!!!
