Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.Pavement tech is correct there was no warranty 1-I did indeed do an on site inspection of this machine and upon this inspection there was no markings stating it was an model or a modelThe only way to determine the year and model CORRECTLY is the numbers that are stamped in the frame of this machineWith that said the only way to retrieve such information is through the local courthouseAt that time I supplied the paperwork from Pavement Tech stating once again that this machine we purchased was a model and that's when I learned that it was a instead of a in which their paperwork from Pavement Tech states it 2- I'm NOT reporting a warranty issue, but merely stating that Pavement Tech sold a machine as a instead it's a 2007.I feel deeply that IF this machine was advertise as a it would not have sold for the money it did, and this is why I'm taking action 3-As for us making payment after inspecting the machine is NOT TRUE, we had to wire the money to their New York office the Friday BEFORE I went to picked it up in [redacted] where it was setting that following SATURDAY 4-Misrepresentation is my complaint and we should be compensated for this matterIt is not our responsibility that Pavement Tech did not do their follow up with the personnel they purchased it fromThank You Regards, [redacted]

Customer is correct in that the manufactured year of the
equipment is 2007 and not 2008.  The year 2008 was referenced on documents
Pavement Tech received when it purchased the equipment.  The item
purchased was a [redacted]/ [redacted].
 Pavement Tech...

declined to offer a credit to the customer
for the following reasons: 
 a) Customer performed an on-site firsthand inspection of
the equipment prior to purchase.
 b) Customer was informed before, during and after the
sale, that the used equipment was being offered in as/is condition without
warranty. 
 c) Customer's invoice clearly disclaimed all
warranty.  The used equipment warranty disclaimer reads: "The Buyer
acknowledges that buyer has conducted adequate due diligence concerning these
items
be it new, used or refurbished and that item/s being
purchased are fully satisfactory in their current condition and that all
payments to seller are final and non-refundable.
In the event that there is a product or part warranties
offered by the manufacturer or seller it will be clearly conveyed within the
item description of this Invoice, Seller, Pavement Technologies International
Corp., hereby expressly disclaims all warranties (other than those stated
herein) either expressed or implied. The seller neither assumes nor authorizes
any other person to assume for it any liability in connection with the sale of
this product. Seller shall not be liable for any loss of profits, business,
goodwill, data, interruption of business, nor for incidental or consequential
merchantability or fitness of purpose or damages related to this agreement. I
have read, fully understand and agree to all conditions set herein"

[redacted], if you want a decal kit, CALL the office at ###-###-#### and ask for me, [redacted].  I'm the company president.  I'd be happy to provide you a decal kit at our cost.  You've misrepresented the facts in your February 4, comments.Here are the facts.You'd requested that we make a man available on the weekend so you could inspect the equipment on your day off.  Despite the fact that the facility you visited was closed on the weekend, we arranged for our man to come in, on his day off, to accommodate you.You insisted that, following inspection, if you decided to purchase the equipment, you weren't interested in sticking around until Monday, when the banks would be open and you could wire payment.  You wanted to be able to take it with you the same day.  In order to accommodate your leaving with the machinery on a weekend, when both the facility and BANKS ARE CLOSED, Pavement Technologies offered and you agreed to pay In Full, the amount which was FULLY REFUNDABLE, IF FOR ANY REASON following your inspection, you decided not to accept the equipment.  You inspected the equipment, accepted it and took it with you that day.  All of these details can be found in the email exchanges and documentation. As per our invoice and website, used equipment is sold 'without warranty of any sort' which is why we always instruct customers  to inspect it first.  While, we make every effort to present used equipment details as accurately as possible, the website clearly states that there is no guarantee that the information on the website is error-free.  Once again I'm happy to offer you the decal kit at our cost.  Give us a call.  ###-###-####
