Paws 4 a Cause has been deceptive and unethical throughout my family’s interactions with them. The apparent owner — *** — has been especially fraudulent.

In May, my family arranged to purchase a kitten from Ms.. Because my 5-year-old boy and I are allergic to many breeds of cat, we were very specific in telling Ms. that we sought a female Siamese (our research showed that this gender and breed are less allergenic). We communicated these requirements to Ms. numerous times by phone and email. She assured us that she had a female Siamese, so we agreed to acquire the cat.

On May 5, 2020, we paid Ms. $130 for the cat via PayPal. On May 8, I drove to a garage to pick up the cat from her.

When I arrived and asked if the cat was female, Ms. admitted that the cat was male — even though she had repeatedly assured my wife the cat was female. Having driven 90 minutes and already paid Ms., I decided to take the cat under the condition that Ms. would accept the cat back and refund us the money if my child or I were allergic.

Upon returning home and inspecting the adoption paperwork Ms. drafted, we discovered another deceit by her: The cat was not a Siamese but a Maine Cn. We promptly called Ms., who claimed not to know we expected a Siamese, even though we had conveyed that to her multiple times prior to our transaction.

It quickly became clear that my child and I were allergic to the cat. We contacted Ms. on May 14 and made arrangements to return the cat for a refund. She assured us that she would honor our refund agreement. When I dropped the cat off to her on May 15, she again confirmed that she would refund us the money. Yet she refuses to do so.

We have contacted Ms. multiple times over the past three months and she flatly refuses to refund us our money— even though she knows that she acquired this money fraudulently.

Dear Ms.,I would like to begin by clarifying that we did not receive this complaint until 8/15/20.The address given was for Blues House of Grooming. One of our volunteers/fosters works at this grooming salon. The kitten was returned at this address to prevent Covid transmission to our fosters. On the rare occasion that a pet is returned, we have it returned at the salon to be bathed before returning to a foster. All of our foster are high risk individuals. Personally, I am on oxygen with both heart and lung issues, so I let other volunteers do the direct interaction with customers. I handle most phone calls. The Paws 4 A Cause address is ***. This is my home and the address of the rescue. This is the address where the kitten was picked up.Prior to *** and *** adopting we had multiple phone conversations. We repeatedly informed them that all of our kittens are mixed breed and we do cannot guarantee the breed of any pet. Mustacio was listed as a Siamese and Maine Cn mix. That is what we were told when the litter was surrendered. I have included a screenshot of the listing. You can see that we listed the kitten as a Siamese and Maine Cn Mix. We also educate people when they call that no cat is truly hyper allergenic. If people have serious allergies they should consider adopting a hyper allergenic dog. *** was told this on multiple calls, but insisted that she would be fine with adopting. There was an error made when sexing the kitten. That does sometimes happen. We discovered the error a few minutes prior to pick up, when Mustacio was dropped off by his foster. We did inform *** when he arrived of the error and he decided to take the baby anyway. We also informed him that we had another family that also wanted him. We are being very responsible during the pandemic and only do social distancing pick-ups in my front yard. Petco shut down adoption events in March and has not yet reinstated them. Prior to the pandemic all adoptions were done at the Fontana Petco. I have been doing adoptions there since the store opened. *** the current manager can serve as a reference, should you need one. The *** family decided to drive the 90 miles round trip to adopt. They called shortly after adopting and informed us that they would be returning the kitten. We made arrangements for the return to occur on May 8th. They did not call to say that they were not coming. The groomer/volunteer called when she was getting ready to leave work, and they said that they decided to keep the kitten longer and give it a try. Since they were scheduled to return the kitten on the 8th, the family that adopted the sibling was waiting to adopt him. They were disappointed that the *** family had not returned him at the scheduled time. *** and *** contacted us again on May 14th and wanted to return the kitten. The kitten was dropped off with the groomer at Blues House of Grooming on the 15th. When they returned the kitten to the groomer Mr. requested a refund and was told by the groomer that she would pass on the request to the president. As our contract indicates we do not give refunds. Had the kitten been returned in a timely manner in good health, we would have considered the request. Shortly after the kitten was returned we got a call from the groomer. She stated that the kitten was fleas infested and needed to get a flea bath and have Advantage put on her. Our cost to get this kitten ready to be rehomed after the return included:Bath $45.00Flea Shampoo $5.00Advantage $15.00Drontol Worm Treatment $5.00Drontol had to be given because the kitten was flea infested. Kittens often get tapeworms from infected fleas. I have included a copy of our contract. Please take a look at item #5:“I agree that no warranties either expressed or implied are made with regard to breed, personality, exact age, appropriateness of a particular animal for the new owner or family, or extended good health.”Please take a look at item #6:“I agree that my donation is non-refundable, but may be transferable (within 30 days of adoption), should I decide this pet does not fit into my home. I understand that my donation helps rescued animals and that this is a non-profit organization.”A refund was not given because of the poor condition that the kitten was in at the time of return. We do consider refunds for allergies, but we have never had a pet returned in poor condition before. Additionally, we will not transfer the adoption fee and place an additional pet in a home with the flea infestation. In 2019, we did 213 adoptions with 0 complaints. Since our establishment in 2014, we have never had a complaint filed with you. As a teacher and upstanding member of the community, I am greatly offended by Mr. Tokaji’s slanderous statements. He accuses me of fraud, being deceptive and unethical actions. As a professional educator, I find this complaint unfounded and he is simply venting because he did not like the fact that we do not issue refunds.

I am rejecting this response because: The response from Paws 4 a Cause and Ms. *** is wholly consistent with their deceptive and fraudulent business practices throughout this affair.

We stand by every word of our original complaint: Paws 4 a Cause — and *** specifically — have been flagrantly unethical at every turn. This includes her reply, which is full of deflections, counter-accusations, and outright lies about our interactions and the condition of the cat upon his return.

Paws 4 a Cause and Ms. are exactly the sort of disreputable, fraudulent operators who cause such harm to the animal rescue community. We expect that your organization will take the necessary steps to shine a light on the dangers Ms.’s business poses to consumers, the general public, and rescue animals.
