Mr*** and his wife were my clients for a number of yearsHe engaged my firm to prepare his return visited our office on 3/31/During the meeting he provided his relevant tax income documents and we prepared his tax return based on the information he providedHe and his
wife also signed (under penalty of perjury) an electronic filing authorization and a declaration that the tax return was accurate, true and complete to the best of his knowledgeHe paid us $and we electronically filed his return the same dayApproximately weeks later he visited our office and handed us another wform that he forgot to give us when we prepared his return on 3/31/and asked if we could do an amendmentBecause Mr*** did not include this income in his original return and the amount of the income was significant the IRS by law is required to charge what is called an "accuracy related" penaltyAlso, because the amount of taxes withheld from his forgotten Wwas very little, the IRS penalty was increasedOverall the IRS penalty was about $Had Mr*** had more income tax withheld from his wthroughout the year, this penalty would have been much less and may even not have been charged in the first placeEven if an amendment had been filed immediately, the IRS still would have charged the penaltyIt is important to note that we were under no contractual obligation to file an amendment at allMr***'s assertion that we were his "contracted" CPA is categorically falseThere was no valid agreement to prepare his amendmentThere was no price discussed nor an agreement to termsAdditionally, Mr*** waited over months to ask us about the amendmentHe also received a letter from the IRS on 9/5/asking about the missing Wand gave him days to respond and try to give a valid reason why the Wwas not included in his original return (the IRS effectively amended the return for him)However, Mr*** did not respond and waited months to notify us that he received this notice (12/5/17)Keep in mind; had an amendment been filed Mr*** would have still been penalized by the IRSHis actions or lack thereof in connection with not having enough withheld form his Wand not providing us with it when we prepared his return were the only reasons why he was charged a penaltyHe did not compensate us to prepare an amendmentI felt bad about the situation and offered Mr*** $in good faith to show I wanted to keep him as a client (even though this wasn't my error) and he refused and asked for more

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
This reply by Mr. [redacted] clearly demonstrates why a documented complaint should stay on record with the Revdex.com. Mr. [redacted] firm (PB Tax Center)did not file the amendment to our return as promised (see attached e-mail) causing us to be in bad standing with the IRS and ultimately causing over $1300 in fines. As Mr. [redacted] response shows, he, his staff, his firm and the outside accounting firms he is associated with continue to take no responsibility for the fact they "forgot" to file our amended return. They also take no accountability for never informing us they "forgot" to file our return, and never made any attempt to provide our official paperwork back to us. It is also important for consumers to know that just by going to ask Mr. Haggerty why he never filed our amended return his firm choose to bill us $90.  We provided PB Tax center with the paperwork with ample time to file under the IRS deadline, which could have made this entire incident not happen. It is in the best interest of consumers in the San Diego area tho know that PB Tax center makes these kinds of errors and also is not willing to take accountability for them. We ask the Better Business Beaureu to take these facts into consideration which will allow consumers in San Diego and Pacific Beach to know they are potentially at risk of personal financial loss by doing business with this company. Thank you for your consideration. [redacted] [Provide details of why you are not satisfied with this resolution.
