Dear ***, I just sent you a response before your response to our letter, sent Tuesday, arrived I never did push [redacted] into a demand for paymentBut to me, decency would at least offered something for our time and [redacted] certainly used up allot of our time, in coming by our office, not only in meeting him at his house several times but at his house to go over ideasAgain I did question him about all the contractors he was meeting with and he assured me they were there for other reasons, and that his wife really liked what we came up with It is unfortunate that a consumer can lead a year old company "on" , giving them the impression that they would be doing the work Phil C***

correspondence dated October 18, Before I specially address Mr [redacted] complaint, I feel that I should give you a brief background history of our company.APC & Associates Company History: We have had a successful design and construction company for 31years, which is rare in this industryThe projects and commissions that we have completed are of the finest quality and have taken us across the nation and into EuropeWe have successfully completed over projects including work for national celebrities and three NBA playersWe are not new to this industry and we take our clients seriously, offeringthem a high quality design service and great customer service.BPC & Associates Company Awards:In we received an award for "Best Customer Service" for our design and customer service work.Our work has been published in Architectural and Design MagazinesOur clients wrote in to this magazine about our work (accolades attached) .We have had our work photographed and written up in different National magazines.C Mr [redacted] LetterMr [redacted] came into our office in July, He said he was purchasing a home at [redacted] ***,just up the street from our office and asked about our company [redacted] mentioned that the house he was purchasing needed some additional bathrooms and some wood flooringHe asked if we had the time in our schedule to complete this project quickly after he closed on the house, as he and his family were leasing an apartment ( also close to our office), he needed a new waterline from the street and his children would be starting school here in Lake Oswego the beginning of SeptemberAt this time I asked one of my head designers (Naomi) and our construction manager, (Rick St***) to be part of our conversation, as they were both in the office at the time[redacted] had a hand drawn sketch with him that he said was put together by his father-in-law based on the "likes" of both [redacted] and his wifeThe quality of the sketch was difficult to read so I asked for a time for myself, my two designers and Rick to come to the house and view the exact areas needing remodelingAt that time I told him my first hour of evaluating the project would be free ( I offer this " first hour free" to every potential client so that I can determine the scope of work )Mr [redacted] seemed very excited about our proposal but he said since he had not closed on the house yet, he needed to contact his realtor to meet us at the property, allowing us entry.He called me a few days later with a date and time to meet at the houseWhen we arrived, we were told we needed to wait outside as another construction company was inside "looking at a project on thehouse"My clients sometimes get three bids, so I completely understood his reasoningWhen it was ourturn, we were taken into the empty house and shown the upstairs, where the work was to be doneAs the ceiling were too low on one side of the upstairs to accommodate what was asked (and also what Mr [redacted] 's father-in-law had sketched), we stated that a new plan was neededIexplained that we could measure while we were there,and that there would be a charge for the preliminary plans.Then once a plan had been decided on,we could establish an estimate for the project.Mr [redacted] said there was a set of drawings downstairs that someone else had drawn,and that we could borrow them.The realtor and I know each other and when I asked her what she thought about our borrowing these plans for a few minutes to take to our office and make copies and immediately return, she also said OK.As we were leaving we noticed two other construction companies (trucks) waiting outside to meet with Mr [redacted] Both of these companies are builders,not designersThat meant they would need to outsource the design and permit work to an architect, which is very expensive.While we were at the home, Mr [redacted] also asked us about many other projects they were interested in in the future, including opening up walls downstairs,adding additional wooden floors and a set of stairs, widening the driveway, improving the front entry, as well as a new waterline to the streetI told him all of those things could be done by our firm.When I returned to the office we copies the plans and returned them to Mr [redacted] in less than minutesI told him at that time that we had now exceeded our free one hour of consulting work, and that we needed to come up with a fee for our plansHe asked me if we would put the costs of the plans into the cost of the project, since this was such a large projectI also told him that I was concernedabout continuing to do work when he had other contractors bidding on his projectHe said that he really liked our ideas and "was probably" going to go with usSo I thought, "OK, I'll put some more time into the project, based on good faith and provide a quote".A few days after our staff and our project manager had about hours into the project, we set a time to meet with Mr [redacted] and the realtor at the job siteAt this meeting Mr [redacted] said "Since you are already here can you give me more bids on more work"? When we left we noticed that again, there were other contractors waiting to meet with Mr [redacted] and the realtorWe did talk that night at which time I asked him about the other contractors to which he replied "My wife and I like your drawings and ideas for the project better than any of the others "and that "they were going to us for their project" [redacted] then asked me again how our work load was going and how soon we could start his various projectsI assured him we could get the permits in one day and start the projects the day after, beginning the projects the day after thatA few days later [redacted] came to us with a plan for a bathroom with a utility room, that he and his wife had sketched outNaomi was asked to look at the drawing and found the drawings would not work because the sloped ceilings on the second floor are sloped, however Naomi and I could make it work with another new designWe immediately started the new plan (putting some other jobs on hold for Mr[redacted] )The additional hours to the plans was very much appreciated by Mr [redacted] when he came into our office the next dayThe day after that he requested a bid for a new water meter and the new oversized waterline he mentioned when we first met at his house.We did not hear from [redacted] for a few days, until he received a partial bill from my bookkeeper for$for the designs and drawings we had done for himHe said all of this was "supposed to be free" So I removed $and re-sent him an invoice on September 15, for $(see attached).I asked [redacted] in an email dated October 3, (see attached) when we were getting started and he said (see attached) that the money they had saved for the remodel had to be used to pay off his car lease in order for the house to closeThat fact that the car lease was $30,and he owes us $is interesting.We have also included a copy of the home listing/sold ( Zillow), dated October 18, 2016, at [redacted] showing the purchase price of $925,000.00.He asked us to do a lot of workWouldn't you think that for all the time and effort we put into his project, he would have covered part of our office meetings and design/drafting time?Phil Chek & Associates [redacted] 503-224-

Complaint ResponseAt no time did I sign a contract to do receive contracting services from Phil C[redacted]. He was one of the contractors I reached out to to give me a bid on a bathroom addition project for a home I was in the process of buying to see if I could afford doing the job. Like the other companies who spent time and money to create a free estimate on the job, the money Phil C[redacted] spent was part of his cost to win the bid. If he presented me with a contract that required me to pay a free to create a design and I signed it, then I would surely have paid him. In the attached emails below he assured me that his bid on the job was free.Dear [redacted],  Thank you for your response. There is no fee to bid. I was just trying to recapture the design and drafting costs, if plans were being used for other contractors bidding on your project. I will get back to you later today with the bid for just the bathroom, as I am out of the office all morning.   Sincerely, Phil C[redacted] Office: 503-224-4500Cell: [redacted]www.[redacted]comFinancial circumstances changed during the process of securing the loan and so my wife and I need to save up money now to be able to do this job in the future. I told Mr. C[redacted] this as soon as I received his estimate and his email response is attached below. Dear [redacted], Thanks for giving us an update on your project. I was hoping that you would be able to get started soon so that we could get your project finished for you quickly. We typically charge for design and drafting time and onsite measuring, but since you said there were several projects that we would be doing, two bathrooms and hardwood flooring, we did not charge for our time to design and draft several variations of the bathrooms and utility room for you. Now that you have the plans you can use them any time your budget allows. I hope you can get started soon, you’ve got a great house and I think the improvements we were looking at would really be helpful for your family. Sincerely, Phil C[redacted] What I ended up paying for the home is immaterial to his argument. I believe I have the right as a consumer to turn down a contractor’s work or delay my decision until we have the financial means to afford the job.Sincerely, [redacted]
