My name is ***, and I am one of the owners of PCB Auto plaza. Now, all the paperwork that customer have signed was available for her to look at. If she didn't see what she was signing, she wouldn't sign it. Customer required her tag to be transferred, but we charged her as for the new plate, because she wasn't sure if the plate was registered to her name.
Plate ended up being on her name , and DMV made a transfer. Car was registered within 2 weeks of purchase(by law in Florida dealer has 30 days to transfer vehicle into consumers name). $294 (registration change was applied to the customer's balance on 3/13/2020, while vehicle was purchased on 2/27/2020).
on 04/04/2020 customer called, that she never received a plate in her mail. I've sent her copy of registration, that was mailed to her. She stated , that she does not have plate in her possession, and I suggested her to call to the DMV and make appointment with them. Customer called us two days after purchase, and said that she changed her mind, and requested to return vehicle. As a used car dealership we do not do returns on cars. she called me at the same day when she filed complaint to Revdex.com , and said, that if we dont take the vehicle back, she will take it off the bridge, and will get it flooded. she was told that she will still be responsible to make her payments. NADA value as of today is $4200. Thank you

(The consumer indicated he/she DID NOT accept the response from the business.)
On the page where I should have had to write my name in about if you're 3 days late it's a 20% charge & if you're 5 days late it can be repossessed she had already put my name for me its obviously not my writing but whatever I'll just accept that I bought a lemon from a car lot, continue to get it fixed as I've already put almost 1500 into getting it situated go ahead & get it paid off & just never deal with them again also tell anybody who will listen to NOT buy a car from them as I was instructed after getting this one I'm not the only one who had problems with them too bad I didnt know beforehand I finally got my tag situated ON MY OWN & should be receiving it soon

.
First of all, nobody told a customer, that she was supposed to place her name in the late payment contract. This was a place , that dealer has to fill out. In a place where it says buyer, buyer signed and printed her name. The late fee was not 20%. It is lie. So please read the contract again.
The tag was situated not in "her own"
Because she called us , and we explained her what she should do, and what she was supposed to tell to the DMV clerk.
About "lemon law" . Lemon law in Florida applies only to the brand new vehicles. Customer did sign AS IS NO warranty sheet.
Under Florida law, a "lemon" is a purchased or leased, new or demonstrator motor vehicle which has "nonconformities" that the manufacturer or dealer has not been able to fix after a "reasonable number of repair attempts." The "nonconformity" must be a defect or condition that substantially impairs the vehicle's use, value or safety.

Panama City Fl had been hit by a category 5 hurricane on the 10th of October. Everything was destroyed afterwards. Panama City did not have any electricity, cellular service, and everything was closed for weeks. I tried contacting the owner of PC Auto Plaza several times days after the storm. It kept going straight to voice mail. I even went by the place several times and it was closed. I finally got in contact with them at the beginning of the next month and tried to explain to them that I was not able to make my last months payment because of the storm. They charged me a 30 dollar late fee and said that they were back opened 3 days after the storm. I explained to them that I could not reach them and asked could they take the extra 30 dollars off of my payment. She was very rude and said if I did not pay the late fee, my vehicle will be repossessed. The owner is a liar, selfish, and I do not recommend anyone to come here.

Desired Outcome

Refund If I cannot get a refund then I will be reconsidering going to court.

Hey! First of all there are a few things that were incorrect in this letter. First, Panama City had Cattegory 4 hurricane, second:yes, our business was opened 3 says after hurricane, which was on the 13th of October. Third: how could customer call us, if there was no cellular connection? Something isn't right in here. Customer has her payment due on the 28th of each month, which was 19 days after the storm. And she still had 28th , 29th and 30th to make her payment before the late fee. We have the contract with customer that is stating that customer has to make her payment within 3 days of payment date. We just had to follow our contract, and I'm hoping this problem is resolved. Thank you!
