Complaint: [redacted] I am rejecting this response because:Thank you for your response on October 9, My intentions in this matter were never malicious The only reason I did not follow and proceed was financial, which I did not realized after I got home, reviewed the applicant form with the rent $_, estimated the electric deposit and there was no way I would be able to afford the rent/light on my take home income which I disclosed I know $is not much money for most people, but for me it is, as you are well aware of my take home monthly income information I provided to you I have read your response, and I am not satisfied with your response as to why I will not get my $deposit As we both know, we never proceeded to sign a lease agreement and I was never assigned an apartment number; so I ask again, how can you say you were holding an apartment without an executed Lease Agreement Contract setting out the terms, apartment number, and most of all, signed by both parties? At this point, if my requested is denied again then only resolution for both parties is to let the court review all the facts, documents I signed, my monthly income to see how you arrive at my approval under your apartment income guidelines for tenants, together with your “Response to Complaint Letter dated 10/9/2017”, and let the court make the final ruling I will be filing a small claim suit in the J.P office at the Nueces County Courthouse on Leopard Street by the end of next week if this is not resolvedYours respectfully, [redacted]

I am rejecting this response because: it is not true that I was offered any options at all other than to move out and break a lease that I would be responsible for as for the renters insurance I have it does cover loses from theft fire water damages due to leaking pipes however as I stated it doesn't cover damages occurred to my personal property from the direct negligent acts of maintenance personal in my apartment and my State Farm agent can verify that as state stat were the individual to notify me that it is Mac Lamar insurance that is liable for that as it was not a natural incident that occurred but negligent persons in your employ that caused further destruction. As well as State Farm has also recommended that I bring Mac Lamar to small claims court as well

The [redacted], [redacted], has reached out to tenant and resolved all issues. Unfortunately, as our lease agreement from Texas Association of Realtor's, does not allow use to cover any personal property loss and strongly urge all residents to maintain and hold renter's insurance. Renter's...

insurance will cover any damages sustained in the loss, not the apartment complex. As a courtesy to the mishandling of this situation, the tenant was offered rental concessions so that we could go above and beyond to correct the situation. Again, our deepest apologies, we are sorry for the issues and are doing everything in our reach to resolve these maintenance issues.
