Complaint: I am rejecting this response because: When attempting to transfer the warranty for the Macbook Pro that was purchased, I was told by Apple employees that there was no warranty on this, that the manufacturer's warranty had expired and no extension was ever added to itI immediately contacted the seller to advise of an issue arising from an Ebay purchase of $that EXPLICITLY stated there was a warranty (AppleCare) remaining for just under months, and his first reply was very matter of fact, stating he couldn't see the listing any longer and offered me $100, which seemed to be a quick fix so that I would just go away.I forwarded the seller the email received directly from Ebay customer that I requested by CALLING THEM and requesting a supervisor, showing EXACTLY what I had stated to him already, and the seller again advised they weren't able to see this because Ebay removes items from their dashboard after daysOddly enough, in one of the sellers replies he boasted of his stellar rating & positive feedback yet he took no action to try and confirm this information by contacting the manager that I spoke w/overseas (her information was in the email forwarded to him) or making any attempt at all to verify the information, instead choosing to NOT take any action to actually disprove the factual information provided to himI clearly stated to him that it doesn't matter when I decided to transfer the warranty, it should be there since I paid for it at the time of purchase.He states I threatened him, that is an absolute lie! I didn't make any threats; I did, however, forward an article about a person who filed a frivolous lawsuit over a $printer that went on for years in court and cost the person who sold it almost $40, as he pointed out, but that I wasn't interested in traveling down this road and had hoped we could come to mutual agreement on a FAIR settlement without involving Ebay, Paypal, or the court system (though I am willing to take this as far as I need too in order to resolve it to MY satisfaction, not just his)He continues to point out Ebays month policy but has failed to mention once that Paypal has a month dispute policy, and this was purchased via Paypal.His initial offer of $was insulting, and I told him just that because if he expected me to pay another $to get a warranty that I had ALREADY paid for he was sadly mistaken, I'm a very understanding and easy person to deal with, but I'm not a doormat for society and those who advertise falsely or do not honor what they say in their advertisementsIf it was an honest mistake, which at this point I truly do not believe it to be, he would've taken any steps needed to rectify this and save his reputation that he was so quick top point out in his replies to the BB and the District Attorney's office.He continues to state I'm demanding $That is FALSE! I clearly stated that if he is unable to provide me a warranty until August, then yes, I expect to receive that amount as I should not have to pay anything our of pocket to get a WARRANTY THAT WAS ALREADY PAID FOR! This concept seems to be very confusing to the seller, I'm not sure why, but it's been clearly stated and I'm not going to do it again.His next option was a pro-ration, which still would require me, the buyer who PAID FOR A WARRANTY in his original purchase, to again have to pay out of pocket to get a warranty (it wold be over $160)! He states that I'm satisfied with the product and have had no issues with it: Correct! But I'm not paying a 15% restocking fee to send this back, that would be $out of my pocket - each of the two "resolutions" the seller offered me had it so that I WAS PAYING $because he advertised a product with information, that is not my fault! And just becasue their have been minimal issues with the laptop doesn't mean I don't expect to get the warranty that I've paid for, and was CLEARLY STATED to be a part of this purchase, it was one of the primary reasons I purchased it!I'm at the point now where I simply want to move past thisI work full-time, go to school full-time, and also volunteer in my free time - I'm just too busy to continue dealing with this nonsense over something that I've PROVEN beyond any doubt was already purchased! I'm open to an offer of $249, whereas I'll still have to put in $out of my pocket to get a warranty on this Macbook but since I'll be paying for and getting full years at this point then I'm fine with thatIf this is not acceptable to the seller, I'll continue to do what's necessary to ensure a fair resolution for me, the buyer, who paid $for a laptop with months of warranty coverage.I've attached PDF files of both the email reply from Ebay, with the managers contact information at the very end of it (i.eher full name, and their phone# was found on the Ebay website, took me all of 2-minutes to find that), which has already been provided to the seller months ago as well as the chat transcript w/AppleCare, advising that there was never a warranty on this as the seller clearly stated in his listingThank you Regards, J [redacted]

This buyer contacted with us about an issue with an item they bought with AppleCareApparently the buyer states the auction stated applecare was included till August however the buyer contacted months after the auction endedOur auction clearly states our warranty and return period is
days (please see attached form 1-1)The buyer has days to contact us with any issuesWhy did it take over months to contact us? We cannot even view the auction on ebay to see what it said about any ApplecareEbay only allows ended auctions to be viewed for days after auction ends (please see attached form 1-2_)When we emailed the buyer this, they wrote us a very aggressive email and even threatened a law suit against us and cited an article where a person sold a dollar printer and got sued for $30,(please see attached form 1-3,1-4, and 1-5)We have included a print out from our Hotmail email and also a copy and paste as some of the longer sentences get cutoff at end in the Hotmail print offRegardless of these threats and the seller contacting us months after the auction ended (when our auction clearly stated a day return period) we still offered the seller either a $dollar payment to close the matter or to take the item back for a 15% restocking feeThe reason for the 15% restocking fee is we are charged ebay and paypal fees to sell on ebay and you can only receive a credit from ebay for returned items no later than daysWe also include free shipping on all our itemsThis buyer contacted us months after this auction ended, we can no longer view this auction on ebay, and they made threats against us, we still offered them either a partial refund or return optionWe did not have to offer any of these options however we still tried to resolve this.We an ethical and honest companyIf we make a mistake we always resolve all issues (in this case we can't even check if we made a mistake or not as this auction ended so long ago)Our feedback on ebay is over 99% (please see attached form 1-6), and we have the highest account rating on eBay that's possibleOur rating is Top Rated Seller and our powerseller level is platinum (see attached form 1-7).The item in question, has zero issuesThe buyer even stated in his complaint to the Consumer Mediation Department of Ventura County "Im satisfied with this product and not interested in returning it.” There is nothing wrong with this laptopThe seller is requesting a $refund for the cost of AppleCare (which he is arguing we stated ended in August by providing an email he claims he received from EBayWe cannot verify this email)AppleCare is for two years of coverage (please see attached form 1-7)The buyer is claiming we stated the AppleCare ended in August of Why are they requesting a refund of 349? Two years is months, August is months away from now/ months = $per monthShould the buyer not be requesting $X months they allege the appleCare was supposed to expire?We feel we should not have to do anything in this matterThe buyer contacted us months after the auction ended and made threats against usRegardless we still tried to resolve this with the buyer (even though we can't check if we are at fault or not)The buyer even stated themselves there is nothing wrong with this itemEven they themselves stated it is not defective and does not even need any Appelcare repair work doneThey are requesting a refund for the cost of Applecare when that cost is for months of extended coverageWe have already offered this buyer a $dollar payment to them or to return this item for a refundIf they feel the Applecare is the main issue here, we are willing to refund them $X months they allege was supposed to be left on the Appelcare.We have tried over and over to resolve this with this buyer.If the buyer agrees to the refund of X = $189,we can send them a payment via paypalPlease let us knowThank You.PDK Asset RecoveryCEO: P*** ***
