PDQ Auto Movers

PDQ failed to refund me $150.On April 13, 2014, I signed a contract with PDQ Auto Movers to ship my car from [redacted] to [redacted] for a cost of $575. The order number was [redacted]. I sent in the $150 downpayment for the order on April 28. I repeatedly emailed[redacted] at PDQ several times after this asking about what time my car would be picked up on the scheduled pick up day (5/15/14) and she continuously told me she would know at a later time. When I called her the day before the car was to be picked up, she informed me that she was unable to ship the car at the agreed upon price. I told her I wanted to cancel my shipment since she was unable to complete the agreed upon job. She agreed to refund my money both on the phone and in an email, yet has still not done so. I have emailed and called her everyday since 5/18/14 and she had ignored all of my calls and emails. Desired SettlementI need to be refunded $150.Business Response Yes, the customer did sign a contract, which she breached. It stipulated 72 hours notice for cancellations in which money would be refunded. She called me the day before. I explained that the order was so out of date and truck prices had risen that a fair price to her would be at the time would be $700. She refused to comprehend, yet went ahead and made reservations with 2 other brokers for the price that was suggested by me. That was another breach of contract. You cannot double book while the information for a vehicle appears on Central Dispatch with PDQ Auto Movers.I sent her an email that the order was indeed canceled but not that we would refund her money.Consumer Response I continuously contacted the company about the status of the shipping truck starting several weeks before the scheduled pick up date.[redacted] did not inform me that the price had risen until two days before, even though she had several opportunities to on the various other occasions that I called to ask about the shipping truck. This company is clearly purposefully giving customers low quotes that are not feasible and then raising the price at the last minute leaving the customer without options. If 72 hours notice is needed for cancellation, then the final cost to the customer should be set in stone before this time.Final Business Response Again, the customer breached the contract. We don't work for free. The thought that we would be a bait and switch company is ridiculous. Our contract states that prices may vary, specifically to let the consumer know what could happen when you place an order a month ahead of time. Prices fluctuate around the trucking company. The customer called continuously even though we explained that it could not be scheduled until a few days to a week before the shipping date. At the time of dispatching a truck, one month after the order date, we found that the truck companies had upped their price, which was conveyed to the consumer who went on with another company at the price we recommended, based on what the truck companies told us. Again, no bait and switch. The price was feasible in April and no longer valid in May.There is no refund due. The customer breached our signed contract, stating that a)prices may fluctuate, b)no double booking (which translates to no other company shall have the order while we are working for a transport). We never, ever told the customer, neither verbally nor written, that a refund was due. It will not work that the customer makes a complaint when they breach the contract.
