Complaint: [redacted] I am rejecting this response because: My daughter is only 16 and not capable of entering into any binding legal contract. Also, I did not threaten to ***. After the manager, ***, made the comment that they need to keep the restocking fee as they need to make money on every order, and in regards to my daughter not being able to enter into a legally binding contract because she is only 16, the comment that she (***) is not so sure it was my daughter that actually made the purchase I told her that I would be contacting my brother-in-law who is an attorney and ask his advice as how to move forward (to which his advice was to contact the BBB). shipped in a timely fashion via UPS and received on July 7th I have copies of the original order, sales receipt, charge slip, refund slip and UPS proof of delivery if you need me to send themPrior to purchasing online, you must agree to our no cancellation and strict return policy: Peaches Boutique has a day return policy for online orders on eligible itemsItems marked final sale are not returnableIt will let you know in the shopping cart if the item is a final saleSale dresses, shoes, jewelry, and accessories are a final sale and are not returnableAny changes or cancellations to your order after you place it are subject to our restocking fees even if the order is not confirmed or shipped yetAll internet orders must be handled through internet customer service, not at our brick and mortar locationThe store location does not alter or fix internet ordered itemsYou can return a dress for a full online merchandise credit or for a refund minus 15% restocking feeCustomer pays all shipping fees on returns and exchangesNo returns or exchanges will be accepted past the need date even if you are within our days return policy guidelineItems can not be returned at the physical store locationOnce your order is placed there are no cancellations even before the order is confirmedCancelled orders are subject to a 15% processing feeYour shipping method takes place from the estimated shipping date which is when your dress arrives to us, not from todays dateShipping times include business days onlyInternational customers are responsible for customs and duties to their countryIf expedited shipping to your address is more you will be notified firstDue to camera lighting and computer screens, the color of the dress and beading may photograph different on the computer than in personPrint patterns can varyThe manufacturers cut their dresses according to their size chartThese are not custom made dresses to your measurementsPlease note that dresses are very delicateBeads, sequins, petals, ruffles, and/or tulle can come apart or come off and Peaches is not responsible for such damage as we do not manufacture the dressesOnce you receive your order you have hours from delivery date to contact us in the rare instance of damage or incorrectly shipped itemsIf this occurs we will replace it for the exact same dress only, any change in dress or cancellation will refer to our exchange and return policy*** *** is not obligated to honor any errors in pricing or availabilityFree gifts are not exchangeable and are while supplies lastSale dresses are sold AS IS This customer called on July 9th and wanted to see if the dress was available in a bigger sizeWe explained that we did not have a bigger size in stock and we could not special order the dress in as it was recently discontinued by the manufacturerThis is something that happens all the time as the styles are constantly changingSo we explained she could choose another dress in stock or receive a merchandise credit good for year for the full purchase amountHowever if she wanted a refund there would be a 15% restocking fee as she agreed to prior to placing the order onlineShe then threatened us that she would sue us as her brother was an attorney if we did not waive the restocking feeWe calmly explained again that she agreed to the terms PRIOR to purchasing and issued her the RA#When we received the dress back we refunded the customer less the 15% restocking fee.We do not owe this customer any further refund Thank you in advance for your cooperation in this matterPlease let me know if you need any other documents.
