Hola mi nombre es ***, el motivo de esta queja es:
- Cuando vino la aseguranza Plattner a mi trabajo hace un ano y medio aproximadamente, yo la rechace y firme un documento donde la rechazaba, pero me seguian descontando 38 dolares a pesar de que la habia negado, pasaron dos meses y aparecio de nuevo *** diciendo que perdio mis documentos y los de las demas personas y debiamos de firmar de nueva cuenta y firme, tengo la copia de esos documentos.
- Pero se me seguia descontando los 38 dolares.
- Paso el tiempo y yo feliz de la vida creyendo que *** hacia bien su trabajo asi como yo hago bien el mio guardaba mi talon de cheque sin revisar, hasta que hace dos meses note que me seguian quitando 38 dolares, todo ese ano me estaba quitando mi dinero y todo porque *** se equivoco. Calculo a la fecha *** dolares que quiero de vuelta, por parte de ***.
- Tengo toda la evidencia y los correos donde mis jefas pedian la cancelancion de la aseguranza y a el senor le importo un frijol.

This is the proof that I had file a cancelation to my health insurance and he never processed it and they were deducting money from my check all this time without my consent. I didn't notice it thinking that he did his job.

On August 16th, 2019 I received an email from her manager inquiring about the deduction for medical insurance. After reviewing all the emails I've received from the group and I didn't see the request to cancel the medical coverage, I received on 8/20/2019 an email attaching the waiver form requesting to waive coverage for medical and dental. It was signed and dated April 4th, 2019. However, this is the first time that I received a documented request to cancel her medical insurance. I have not received proof that this form was received by me or the insurance carrier prior to this date. I have requested this information and to this date, I have not received anything. Therefore, there was no request for me to notify the insurance carrier she no longer wanted coverage. The insurance carrier requires a cancelation change form which is a different document than what I finally received in August and must be received within 30 days of the cancelation date. Her manager claimed that she stated that she thought it was being deducted a premium for a Medical or Medicare plan and that is the reason she did not notify her employer earlier. However, her paystub shows a deduction labeled *** which is not for Medical or Medicare. It is for a group health plan. To my knowledge, the employee is not enrolled for Medicare as well. The employee has received four months of paychecks with this exact deduction and did not notify or question this with me or her employer. There is a shared responsibility of the employee to confirm her coverage was canceled with the carrier, employer, or agent of record if her intent and request was completed per her records. The reason the insurance carrier requires cancelation requests to be received within 30 days is to avoid financial responsibility of services rendered by the employee for dates the coverage is no longer enforced. I always provide the best service and care for my clients. If I am provided proof that this application to cancel medical signed on April 4th, 2019 was received by myself or the insurance carrier within 30 days of May 1st, 2019 then we would take full responsibility. The insurance carrier will consider an exception to retroactively cancel her coverage effective May 1st, 2019 if the employer completes the requested exception form. Also, to clarify the credit due to the employee should the carrier approve this exception would be an average of *** not *** as she claims. The employee pays a portion of the premium, not the full amount. If you should require anything further, please contact me and thank you for your time and consideration

I Do not accept the proposed resolution I think I do not deserve to be punish for a person is in confident in doing his job. This is not the only time he has make mistakes. He has lost papers with personal information of my co-workers. And I have proof that I sent him the cancelation request and he never processed I don't know why he keep on denying that he ever received anything. Thank you for your help.

As I mentioned to you earlier, and sent you copies of the Enrollment Application & subsequent Waiver (only for Dental) which both were in English. Now we have another later Waiver, this time in Spanish, that I never receive. Trying to be helpful and considerate, I am willing to help out and pay 60% of the premiums deducted from her salary, the amount she showed to you included the Employer's contribution, for the period in question. But she has to put in writing that this will be a settlement in full (she paid *** per month for the months of May to August (included), i.e., *** without future recourse and withdraw the complaint she made to you. By the way, this is the first complaint against me in all my years in the business.

I do not accept the resolution that he is proposing I want all the money that they took from me for all the months since I send the original cancelation of the health insurance in wich I already send you a copy of such document. If he lost it or neglect to do his job that is his problem. Thank you.
