To Whom It May Concern:After years in business, this is the first complaint ever against Peak In response to *** ***, we were in contact via phone and email on 9/and later she received information from my attorney and after that my attorney and her have spoken also
For *** *** to state we have not spoken 8/is false ** *** attempted to attain her property by fraudulent mean via her relationship with her current employer *** *** *** and her *** *** *** *** for over $15, We have began legal proceeding with intent to collect this money and contacted the police to determine the criminal intent which all took place inside *** *** *** under survalence camera *** *** has stated to the GC board no code violation and we did obtain a CO, did a punch list, and completed out cost plus contract *** *** plan has been has been to obtain her property via fraudulent mean from day one We intend to pursue this until we are paid in full We have have documentation in which *** *** star she was wrong and intended to make this right and never has

I am rejecting this response because: I am not surprised or by Mr***'s responseI might be the first to do an official complaint to the Revdex.com but I know he has other clients that are taking him to court "the***" and I have been told by his subcontractors this happens on every one of his jobsI can give you the peoples names and phone number should you request themMr*** stated we had contact on 9/and stated my statement was that the last time we spoke was Aug I can show you all emails and text from Mr*** and myself since July of to the last text August 29, He NEVER returned my text or calls after he got his last drawI did speak to Mr***'s attorney and there was no resolution he never called me backI never attempted in any way shape or form to obtain my house in a fraudulent wayMy place of employment has nothing to do with my personal life or my loanUpper management has advised Mr*** to please quit harassing people at my work placeMr*** came to my place of employment to sign the Owner/Contractor Affidavit, Waiver of Liens and Indemnity agreement because it had to be notarized then he was going to pick up his last drawHe came here willingly and knew exactly what he was signing I gave him the option of picking up his check first or coming hereHe came here first sign the document and one of the tellers notarized itWhich yes, if we had video tapes you could see Mr*** smiling and talking with everyone and signing the document in the main lobby in the presence of people with no argument or conversation about what he was signingI have an email from Mr*** dated August 27th stating and I quote "If they want to draw on what is completed like the well etcand pay that out I am good with thatTo sign this with the amount of money out there is not good for me** *** *** is wanting a check and I have not had a draw on it and it will roll on to next week." I then replied and I quote "I can get the invoice from *** (who is ** *** *** secretary) and have them send a check to her if that would be okay with youThe other money is between you and I it has nothing to do with what is left on the house." I also have a text to him dated 8/from him saying all work has stopped until he got the moneyI did not give him the money for the garage door, cleaning inside the house, pressure washing or the remainder of his profit because those items were not done the last time I was at the house which was 8/23/and after all he has put us through in the this process we knew if he gave him this remaining profit of $(he has already taken $30,300) he would not return which is apparent because he has not returned, called etcsince 8/29/We NEVER had a walk through, never had a punch listMr*** left us with half a driveway, no well house, no landscaping, put no seed under the straw he covered the yard with, didn't scrape the yard as it is filled with roots, rocks, gravel etc he covered it up with strawHe shimmed in the vents with wood along the driveway, the driveway is cracking on the part he didThe french drains and drains from gutters were not buried deep enough so they are showing on the side yardHe put a tree across two other trees and filled it with bails of straw to block a big drainage issue that we found while we were removing the silt fence and cleaning up the woods where Mr*** and his crew had thrown debris intoWe have not steps up to our attic and its unpainted, didn't finish the stucco around the house, cracks in the drywall and you can see where they moved the handrail to go upstairs and there are big lumps where they tried to cover it which is like that all over the houseHe did not follow the house plans we had doneWe ended up with two extra rooms upstairs that he said he would finish and he did not put heating or air in them, drywall them and only insulated the walls that enclosed the two upstairs bedrooomsThe septic was not plugged in which could have burnt up the unitWe had someone come out to look at it because it looked like it was sinking and they plugged in it (*** *** the person who designed the system)We then called *** *** who Mr*** hired because we were according to *** County a maintenance agreement that Mr*** never gave to usHe did not install a garbage disposal which we did not know he was not doing to doThe electricians came back for us to install two kitchen lights and they said he told them not to put one in but it is wire for itI subbed out the kitchen, master bathroom and tiling and deckThat is the only thing custom about this "Custom Home" it is a *** homeI have a list from *** where he purchased everything from his "friend" ***Mr*** had not paid the floor people who are in *** County where he lives nor did he pay ** *** ***He told ** I hired him and to get the money from me BUT Mr*** took it in his last draw and it was more than enough to cover the billI hired the kitchen people, the tile people and he paid them out of the drawsAs I stated before he told me NOT to do a separate check for ** in an 8/email that he would pay themI didnt want to use his well person because he told me that he would drill down ftit would cost $and if f he didn't hit water he was pulling out and not coming backThat is why I chose someone localMy attorney sent Mr*** a email dated 9/12/at 3:p.mstating he was representing me and my husband regarding several unpaid invoices resulting from the construction of our homeHe said he had reviewed his construction contract with us and it is clear to him that the well cost were included in the contract with an allowance of $5,Since Mr*** contract indicated the allowance it makes no difference who actually communicated with the well contractorHe also told Mr*** there was an upaid invoice to *** *** in the amount of $for flooringThis was also partially included under the allowances in your contract for $4,Since the ***s had more than enough credit to cover this overage you would owe the entire amountIn fact the credits that the *** accumulated are
$for paying tile guy, $for door credit, $mirror credit and $well creditHe told Mr*** he signed a LIEN AFFIDAVIT indicating that all these bills were paidA AFFIDAVIT by Mr*** is A CRIMINAL OFFENSEHe requested he pay the invoiced within daysI included *** *** because *** *** who is the owner contracted me and said Mr*** had not paid her and if he didn't she would lose her businessMr*** paid her because he needs her to do his future jobs and she lives in his home townHe has yet to pay ** *** ***If anyone is a fraud here it is Mr***As I stated I have pictures from day oneI told Mr*** via text on 8/that I released all funds that were needed for him to pay all the contractorsThe rest was in a construction account with my lender *** *** Bank and since we had closed I would be disbursing the remainder of the fundsI told him when work was completed I would go see if it was done as an inspector would do with the bank and disburse the funds to himI did go to the house 8/and the correct garage door was up but no driveway, no cleaning, no landscaping, no well house etc etcI text him and told him when he got back from his day beach trip I would make it right with the garage doorHe did not answer that was the last text I sentMr*** was over his head he had been borrowing Peter to pay Paul with each jobHe would take a draw from us and he wouldn't be at the job site for weeksThen all the sudden he would show up and start things againWe had to pay to have trees cut down, pay for our own deck, the columns on the front porch, the corbels, wire the house for a sound system he promised us he could doHe was to run conduit and cap it off in the back for our outbuildingThat didn't happenThe funds that were left in the construction account were used to finish the houseI have receipts for everything and it is way over what was left in the accountThe driveway alone was over $and Mr*** had $left on the draw sheetYou could see the writing on the wallHe was never going to come backI wish I would have gone ahead and had the check made for the well people but he said he would pay itAgain, another lieHe is very good at promising and saying absolutely!! He would make a sketch for us and we would find it in the trash in the garage of something he said he would do for usHe never followed throughThe doors are all crookedWhen you walk down from the upstairs you can see out the top of the front doorWe had to hire and pay $to have people come in and do finishing work, painting including the front doorHe did not caulk the siding on the front porch where they cut the sidingThe did not secure the stone work under the columnsThey did not insulate the piping under the houseIf you would like copies of the house plans, emails, text, signed affidavit and waiver of liens, pictures, receipts etcI can provide all of this at your requestPeak Contractors should not be doing business and they certainly shouldn't have an A rating with the Revdex.comI have the NC Dept Licensing Board for General Contractors coming to my house next week because I file a complaint with them and he and his company are under investigationI hope once they see all I have they take his GC license away so nobody else has to go through what we went through for over a yearI can also provide you the name and phone number of the investigator assigned to this caseI have attached a few documents for you to see email from attorney, draw request, his permit for the well and his signed affidavitI look forward to hearing from you and hoping you can take some action to have Mr*** pay the debt to ** *** ***.

We agree to mediation per our conversation

I completely reject all of Ms. ***' claims as and lies. Ms. *** obtained her property via Fraudulent means in which we have and are in the process filing complaints with Revdex.com, the Federal Reserve, and North Carolina Commissioner of Banks. We are currently processing liens to *** ***'s property for failure to pay and will notify all the correct parties involved. We have asked for the third party inspection reports to back up the short pay and no one can or will provide them. I have email backup on 9/2/with replied to emails back and forth and a *** phone bill showing a phone between us. Ms. *** also admitted her fault via text message on 8/29/2014 in this entire situation and said she would make it right but has chosen to bully us into paying and doing things which were not in our contract. Ms. *** had an addition set of plans drawn up months after the first set and months after the loan was closed with an attempt to force additional items not in our contract. We agreed to a cost plus contract and Ms. *** has chosen not to pay. Ms. *** can state all the opinions, the fact still remains this the first complaint ever again Peak Contractors, Incin year history and this one is completely false. No company should have to respond to such statements and lies and we will reject these claims to the end

This is becoming a joke with Mr***'s accusationsWe have one set of plans and thats itWhere he is coming up with his information is beyond meThe only way this is going to be resolved is if Peak Contractors pay the money they took and is due to the well companyIf that does not happen plsase set up an arbitration dateI will be there with everything I need to prove Mr*** is the liarI look forward to the day of the arbitration

Review: [redacted] owner of Peak Contractors signed all lien waivers that sub contractors were paid on the house or that was not complete...he took off with the last draw and we have not heard from him since August 29th. We have filed an official complaint with the NC Board of Contractors and his compnay is currently uner investigation. DO NOT hire this guy. He makes so many promises but never delivers. It took over a year for him to get almost done with my house. He would get a draw leave and you wouldnt see him for weeks. He was taking my money to work on other jobs get a draw from that job and come back to my house. Everything from top to bottom was under bid. He did not follow the house plans. Left us with half driveway, no landscaping, no finishing work, no septic information which requires an annual contract. I have spoken to some of his subs and they have told me he does this on every job. He even did it to one of there parents that did an add on. He should not be able to build house. I have documentation to back up all of this which has been sent to the NC Dept. Of Licensing. Do your homework when hiring a builder. I wish I would have!!!Desired Settlement: I want him to pay the people who have not been paid but he took the money. [redacted] in Mooresville $5050.00 also to reimburse us for the driveway we had to finish, the finishimg people we had to hire, the landscaping we did etc. He should be taken off the Revdex.com website or change to F rating.
