Review: I HAVE A $11.3K CONTRACT WITH THIS COMPANY THAT I PAID 7K DOWN FOR MATERIALS/START UP WITH THE BALANCE TO BE PAID UPON COMPLETION FOR REMODELING MY HOUSE AFTER MY HUSBANDS RECENT DEATH IN APRIL THIS YEAR. [redacted] III SAID THE JOB WOULD TAKE 10 DAYS TO COMPLETE. HE HAS BEEN ON SITE FOR 5 DAYS AND STARTS ASKING FOR MORE MONEY (PER CONTRACT DUE AT COMPLETION). I SAID NO - AND YOU NEED TO BRING ALL THE MATERIALS ON THE JOB SITE THAT ARE STILL MISSING AND GET MORE ACTUAL WORK DONE. 7 DAYS INTO THE JOB AND NOW HAS ASKED AGAIN FOR $2,350 AND HAS WALKED OFF THE JOB BECAUSE I SAID NO. THE ENTIRE JOB IS ABOUT 1/5 COMPLETE AND THERE ARE MATERIALS THAT SHOULD HAVE BEEN PAID FOR WITH THE FIRST $7K DOWN THAT ARE NOT ON THE JOB SITE - THE FRAMING MATERIALS FOR THE DECK - ROUGHLY $875. ORIGINALLY HE SAID THOSE MATERIALS WERE AT [redacted] AND HE DIDN'T WANT TO KILL MY GRASS, BUT, NOW SAYS THEY WERE NEVER PURCHASED. THERE WERE 3 PARTS TO THE WORK TO BE DONE: DECK, PORCH AND CARPORT CEILINGS, AND POST AND RAILING SYSTEM AROUND PORCH AND CARPORT AND DECK. NONE OF THE 3 PARTS ARE COMPLETED. DECK IS NOT EVEN STARTED. WHEN HE WALKED OFF THE JOB HE TOOK A ROLL OF SHEET METAL THAT HAD BEEN ORIGINALLY PURCHASED FOR MY JOB. I BELIEVE THIS COST ABOUT $80 - $90. HE CALLED ME AT WORK YESTERDAY SHOUTING AND CUSSING AT ME WHEN I ASKED FOR THE BALANCE OF THE MATERIALS TO BE BOUGHT TO THE JOB-SITE. HE SAID THAT THE LABOR THAT HE HAD PROVIDED AT MY HOUSE MORE THAN COVERED THE MISSING MATERIALS, AND MAY EVEN TAKE ME TO COURT, IF I DON'T AGREE TO JUST LET THINGS GO....I AM AFRAID OF WHAT HE MIGHT DO IF I GO AGAINST HIM. HE HAS LIED TO ME AND STOLEN FROM ME. HE KNOWS I LIVE WITH MY 13 YEAR OLD GRAND-DAUGHTER ALONE IN THE HOME. I DO NOT WANT HIM BACK TO FINISH THE WORK. CAN I GET A THIRD PARTY PERSON INVOLVED ON MY BEHALF? SHOULD I PRESS CHARGES AGAINST HIM? CAN I LEGALLY GET SOMEONE ELSE TO COME IN AND COMPLETE THE WORK? ANY ASSISTANCE AND GUIDANCE WOULD BE GREATLY APPRECIATED. THANK YOUDesired Settlement: WOULD LIKE FOR AN ITEMIZED COST OF MATERIALS FROM THE SUPPLIERS WITH THE NORMAL ALLOWABLE UP-CHARGE FOR CONTRACTORS SHOWING HOW MY $7K DOWN PAYMENT FOR MATERIALS/START UP MONIES WERE USED. I WOULD LIKE TO PAY HIM FOR THE ACTUAL LABOR/MATERIALS INVOLVED ONLY. WOULD LIKE FOR PEAKS VIEW CONSTRUCTION LLC TO BE HELD ACCOUNTABLE FOR THEIR ACTIONS AND REFUND ANY MONIES OWED WITHOUT FURTHER DELAY.

DEAR Revdex.com Serving Western Virginia,Regarding the Subject Revdex.com Case and associated complaint, Peaks View Construction firmly denies this dispute. In addition to this complaint slandering the professional manner in which Peaks View Construction does business, this is a false complaint filed by the customer who refused to resolve any problem in a reasonable manner. The customer owes Peaks View Construction money for work already completed, and materials receipts and job photos are available as proof. The overview details are as follows:Attached please find a copy of the job contract and receipts totaling $5,290.67 for materials purchased at 10% Contractor discount. Customer would have paid $5,819.73 for same materials at general public prices.Customer provided one payment of $7,000.00 to purchase materials and start job.The General Contractor and one assistant performed a minimum of 7 hours work on each of the following days : August 12, 13, 17, 18, 19, 20, 21, 24, 25 and 26, 2015. The assistant's labor hour fees for 10 days work total $1,000.00 ($100 per day). The General Contractor's labor hour fees are a minimum of $2,000.00 for the same 10-day period ($200 per day). Multiple site visits and consultations with customer, prior to start date, are notincluded in these dates. All materials purchased for the job were left onsite with the exception of one roll of aluminum trim (receipt enclosed, cost $68.45). That metal was taken off the job site to protect it for future use on the job. The Customer damaged other aluminum trim being kept onsite, thereby making it unusable. The remaining usable trim was removed to avoid the expense of repurchasing the same item due to damage caused by the Customer. Photos are available as proof of Customer-purchased materials being left onsite.Customer demanded changes to job after the contract was signed and work started.Change Example 1: Customer was to have existing deck removed prior to work start date. Customer did not remove deck as promised, and requested General Contractor do so with no extra compensation.Change Example 2: Customer requested changes throughout the job period to work that had been performed as agreed upon. These changes to the ceiling, posts, metal work, etc., added labor hours to the total effort and the requested changes were not part of the contract. The General Contractor attempted to resolve all change orders in good faith and compromise as needed. The General Contractor requested a partial payment in advance of completion due to extra work hours incurred. Customer was unwilling to compensate General Contractor for additional hours and Customer asked General Contractor to leave the job site and not come back.Regarding the statements Customer made in the Revdex.com complaint about "cussing," "l am afraid of what he might do...," "...he has lied to me and stolen from me,..," "He knows I live with my 13 year old grand-daughter alone in the home..." These statements are slanderous and accusatory, and have no factual basis. The General Contractor did not threaten the Customer in any manner, or use foul language in any discussions. The Customer could be sued for libel if this misinformation is published. Here are the actual income and expenditures involved in this case:Customer paid: $7,000.00Materials Purchased: ($5,819.73)Material removed from job site: ($68.45)Customer Materials Balance: $1,111.82General Contractor Labor Hours: $3,000.00Customer Materials Balance: ($1,111.82)Customer Owes General Contractor: $1,888.18Please contact me with any questions or comments.Sincerely,[redacted]Peaks View Construction, LLC###-###-####

Response:

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I find many discrepancies in the total hours on the job, the materials used on the job, and other complaints that are not valid. I am putting together the events of each day and will send my full response early next week. Currently, I am very busy with my work obligations, and also was called for jury service for a period lasting until Nov.8th. This would allow me the weekend to get all pictures, written statements, documents, etc. together to support my complaint.Thank you very much for your assistance in this matter.

Regards,

Response:

DEAR Revdex.com Serving Western Virginia, Regarding the Subject Revdex.com Case and associated complaint, the General Contractor has reviewed the customers response in Revdex.com letter dated 07 OCT 2015. The customer has, once again, misrepresented the facts and supplied Revdex.com with information based on error, personal assumptions, incorrect math and a lack of knowledge in construction process. In addition, statements claiming the General Contractor is "inexperience[d]" and "not trustworthy" are slanderous statements that do not represent the facts. The General Contractor has the knowledge, skill and professional experience to complete jobs far more complicated than this small porch. He has successfully completed hundreds of residential and commercial jobs. Throughout 20+ years, the General Contractor's work has always passed inspection by city and county building inspectors, and in many cases exceeded the quality required in building codes. The simple truth is that the General Contractor gave the customer a very fair price, attempted to accommodate the customer's many change requests during the job, and it was the customer that told the General Contractor to leave the job and not come back. It appears the customer only wants to misrepresent the facts and unjustifiably tarnish the good reputation of the General Contractor. There is an abundance of misinformed and unreasonable rebuttal in the customer's letter. Addressing each misinformed statement would take an extraordinary amount of time because these complaints are construction-related issues that the customer does not understand. The opinion of the General Contractor is that there are two possible outcomes to this dispute: • Option 1: The General Contractor and the customer can meet in court and present all facts to a mediator or judge. The General Contractor has job photos and will explain the contract, construction, and repair processes, in person, to the mediator or judge. The General Contractor will also provide factual cost evidence for materials purchased, and provide justification for requesting compensation for labor hours not paid. The General Contractor will also point out the malicious and erroneous statements in the customer's complaints to the Revdex.com, and request the customer cease and desist from all further false and defamatory statements both written and spoken. Finally, if allowed, the General Contractor will bring eyewitnesses to corroborate the facts he will present. • Option 2: The General Contractor and customer will not go to court. The customer will cease and desist making false accusations against the General Contractor in both spoken and written form. The General Contractor will agree to not file suit against the customer for unpaid work and breach of contract provided the customer never contact him again in any manner, personally or through other sources. It should be noted, the customer still has a balance of $4,050.00 that has not been paid toward this contract. The General Contractor left the purchased building materials on the customer's property, including enough railing system materials to complete the job. The General Contractor properly completed various sections of this job. The customer told the General Contractor to leave the job. The customer has over $4,000.00 to hire someone else to finish the job. The customer should decide which option above best meets her needs and we will proceed in accordance with her choice. Please contact me with any questions or comments. Sincerely, [redacted]Peaks View Construction, LLC###-###-####[redacted]

I do not agree with any of the options provided by [redacted], and have not received satisfactory information on labor or material costs. I have been assisted, by my employer of the last 23 years, in obtaining our company's highly accredited law firm in [redacted], [redacted], to advise on this situation. The appointment is Thursday, November 12th, 2015, with Mr. [redacted]. All facts including the back and forth with Revdex.com will be presented to Mr. [redacted] at this time. We will proceed accordingly. The only thing that would stop me from proceeding on Thursday is if Mr. [redacted] would agree to pay for the framing materials for building the deck in the amount of $1500 that should have been purchased with the $7,000 that was given to him up-front to buy all building materials and start-up monies as we agreed upon.
