Again I am going to respond to the issues raised in this letter as they are presented with exception of the garrulous comments and personal attacks that I will leave without commentIn some areas I have added grammar/spelling corrections to clarify what I believe Mr [redacted] was intending to sayIf I have errored in my interpretation please advise me as I want to be certain I am accurately interpreting his remarks.The accusation that “first Nathen nor his crew took one wire brush to the house” is not accurateI don’t know how else to say this, but we did brush the loose paint on the house Did anything get missed? Perhaps, but again, small misses are not unusual and, as stated before, are typically dealt with in the touch up or punch list phase of the project.“Nathen never primed one spot on the houseDidn’t even purchase primer.” The areas to be primed are the areas of bare wood Those areas were still under construction at the time we were wrongfully terminated from the project Again, as stated in the first response We do not understand how Mr [redacted] expected us to prime areas that are not even ready for paint If he is addressing other areas of the house, I will refer you to his initial complaint that stated the house was in “excellent quality” and the exterior “looked like it had just been painted.” If this is the case I again ask what needed primed if not the areas of new construction that was not completed?“We ‘General Contractor and home owner’ decided to paint the exterior of the house ” In his original complaint Mr [redacted] stated the owners “didn’t even want to paint the exterior (be)cause it looked like it was just painted.” It has been a common thread in these complaints to have conflicting responses from Mr*** I do appreciate the clarification and especially appreciate the confirmation that the request to paint was due to a desire to change the color of the house and not because of excessive cracked/loose paint, broken caulking lines or large areas of exposed wood that existed before the work performed by Peakview Property Serivces.The money spent by the homeowners is of no relevance in regard to this issue.“Nathan has made up every excuse why its (it’s) our fault.” I have not made excuses or said it was anyone’s fault What I have done is point out that nearly every point is either conflicting or inaccurate I fully acknowledge that there may be, as is common in every construction type project, some areas of my work that would have needed additional attention The industry standard procedure for dealing with these type of issues is termed a “punch list.” Toward or at the end of the project the contractor and the customer walk through the project and address specific areas that require additional attention Instead, Mr [redacted] made the decision to wrongfully terminate the contract and prohibit us from returning to the job site Then, after creating additional costs and lost time and work for us, demand that we return to the job to perform work beyond the scope of our original contract without compensation That is not an excuse, it is why we have not and will not return to the project under Mr***.“Nathan has called the cops over accusation of me threating (threatening) to build a poor me case and play the victim.” I have contacted law enforcement to report threatening and harassing phone calls, texts and emails from Mr*** This in no way is an effort to elicit sympathy, but rather to ensure that should the harrasment continue we had grounds to pursue legal action if needed and to allow law enforcement to seek criminal charges if appropriate We have retained these texts, voice mails and emails and can certainly provide affidavits from others that were contacted by Mr***As a professional business we do not resort to his sort of behavior and will not be subjected to it by others.“I'm willing to get his [redacted] Rep out and Professional painter to show Nathen he didn't do his job correctly from the start.” I look forward to reading any statement [redacted] would issue in regard to my work on this projectI frequently purchase [redacted] product and have personally visited with them in regard showing and coat the house.” The may be some areas that require additional scrapping to remove lose paint, and as mentioned above, the new construction (If Mr [redacted] has it completed now) will require priming As for this arbitrary insistence about coats of paint We addressed that in the first response The contract was to coat the house with 2-mils of paint If he wanted the house to have coats he should have demanded that in the beginning.“I have bid(s) to prove this job was done incorrectly and has a huge dollar amount to have it fixedWe've been quoted anywhere from $4,to $6,000.” I am not sure how his bids prove the “job was done incorrectly.” Bids typically reflect the price/cost of a given project and not the fact that previous work was incorrectThe dollar amount of these bids in no way reflects the scope of the bids.“I offered to pay for all the paint and nights of hotels for Nathen to come fix his work.” First, this offer is new to me, and certainly has never been stated in writingHowever, it is not material at this timeBecause of Mr***’s actions and his decision to wrongfully terminate our contract, we cannot return to any project with him involved“I think I've been more than fare (fair) with Nathen and all his BS excuses.” No, the wrongful termination of a contract is not fair Demanding work beyond the scope of the original contract is not fair.“Nathen was even [redacted] would like to have [redacted] put this in writing I would certainly consider it in my review However, this was not said to me by [redacted] or anyone else at [redacted] ***“This is my last offer to Nathen Owner of Peakview Properties, That will purchse (purchase) the or gallons of paint and pay for days of hotel for him to come fix his work the correct wayI think this is more than fair since this $to $will be coming out of my pocket“ Like most of the issues in this complaint, the offers by Mr [redacted] continue to change over time.1) First, it was for me get off the project and never return to the job site(written demand on file)2) Then it was to return to the job site, correct work started, perform work beyond the scope of our contract without additional compensation and perform the work on the balance of the contract.3) Next, according to his first complaint, [redacted] was going to cover ½ the cost of materials to “come back and finish the job correctly.”4) Then, Mr [redacted] was going to cover the cost of materials and nights lodging(the current complaint.)5) Now, I have just receive a letter from his attorney stating he will cover all the material, nights lodging and $in costsPeakview Property Service will not be returning to this project with Mr [redacted] present.The balance of the comments in the complaint do not address any issues related to the project/contract itself, but are simply diatribe intended to berate myself and my work This issue has already consumed my time and costs than it should haveHowever, Peakview Property Service’s values our reputation with our customers and the Revdex.com As should be clear in our response we make every effort to be thorough in all of our dealings and will make every effort to address and satisfy our customer’s needs and concerns What we will not do is be subjected to arbitrary and abusive behavior from a general contractor without responding I will again make it clear that we will not be returning to this job/project if Mr [redacted] or his company is involved in any way In addition, we will continue to retain any legal rights we have to damages from the wrongful termination of our contract, any additional costs we have incurred in regard to that termination and any other costs or damages we may be entitled to including the right to file a lien for work performedAgain, we will extend the same offer as we did in our original response: “we would offer to visit with the home owner or another independent representative, and would address specific issues in regard to the work we have done and how we might be able to correct deficiencies that existIt should be noted that this visit would be to strictly address perceived deficiencies in the work performed and, if possible, to reach an agreement on what items should/can be corrected, what costs, if any to be incurred, and a time line for completion We invite the home owner or another independent agent to contact us to set this meeting“I would offer one thought in closing If, I and my company are truly as incompetent as Mr [redacted] claims in his complaint why would he want us to perform any further work on this house? This letter is in response to the complaint filed by [redacted] with [redacted] [redacted]. I will work through his comments individually in an effort to accurately clarify each one. 1)      His recant of the contract terms addressing caulking “…the...

resealing of all broken latex. caulked seams,…” uses a period to separate these two items.  The contract does not address them as separate items, but together to indicate that I intended to repair broken latex, caulked seams…it was never intended to indicate I would caulk all seams on the structure exterior.  [redacted] has also included pictures of caulking that is poorly applied and or lap seams that are not caulked.  In regard to the poorly applied caulking, this is workmanship that existed prior to my work on the house.  The caulking had not failed, and therefor was not removed.  Removal of existing caulking is a substantial undertaking and would have been clearly addressed in the contract had that work been intended.  Again, my contract address repair of “broken latex” caulking…not removal and replacement of poor applications for previous contractors. As for seams under lap siding.  Caulking under lap siding is discouraged by siding manufactures as it can prohibit moisture from escaping and encourage rot.  I did not intend nor recommend caulking the bottom of lap board siding.2)      [redacted] indicated “Nathen never scraped loose paint…”  The house was scraped of loose paint prior to painting.  On a project of this scope it is possible that some small area may have been missed.  However, those areas can certainly be and are typically addressed during the final touch up phase of the project. 3)      “never primed bare wood.”  There are portions of the house that had ongoing construction.  [redacted] pushed to have the painting started before he had completed the exterior construction on the house.  These areas were going to be addressed by [redacted] after construction was completed.  It is quite difficult to prime bare wood that has not even been installed yet.4)      “power washed the house with low pressure.” I utilize an engine driven pressure washer that produces over 2000psi.  It was used on the entire house.  Not sure what [redacted] calls low or high pressure. 5)      “didn’t even remove dirt from house.”  False…see #4. 6)      “Sprayed ½ the body paint without power washing.”  False, he even acknowledges the house was washed…just argues about low vs. high pressure.7)      “Was billed $546 extra for him to caulk all seams and purchase extra materials…”  False, he was billed $546 to cover the cost of re tinting the body paint and replace paint used because the home owner decided they wanted a different color.  See #1 above in regard to caulking seems.8)      “he (Nathan) abandoned the project for a week to take another job the supposedly paid him better. Left paper and tape on house which blew all over the property because of winds and weather.”  I included both of these lines together as the second sentence shows the reason we left the project for a week.  It was due to adverse weather that made painting the exterior of the house impossible.  Even [redacted] acknowledged the weather in his comments.  If the weather was significant enough to remove masking material, it was certainly not conducive to painting.9)      “Nathan one coated lap siding which he states he did 2 coats.”  The contract doesn’t call for 2 coats.  It calls for 2-4 mils of paint to be applied.  If he would like to address the mil application that is fine…number of coats is a non-issue.10)   In the next section of his comments he tries to indicate the overall quality of the house and its condition prior to painting.  However, if these statements are true I have the following thoughts:a.       If the house was in “excellent quality” and the exterior “looked like it had just been painted.”  Why would there be any issues with peeling paint or needing to scrape the paint?  Why would there be any issues with areas that needed to be caulked?  If they want to infer the poor caulking is my work…why would I take time and money to do any caulking…let alone poor quality if the existing house paint was of such “excellent quality”?b.      If the owners “didn’t even want to paint the exterior (be)cause it looked like it was just painted.” Why did they authorize it? What would have motivated the general contractor to allow it to happen if he agreed that it was in such fine condition? 11)   The balance of the comments focuses on comments and remarks from [redacted] and their representatives.  Most of the comments he references from their representatives have not been shared with me by them.  However, I think one comment in particular would clarify that he may be distorting things.  [redacted] indicated that Chris with [redacted] stated the “paint was of poor quality…”  I would doubt that any [redacted] representative is going to claim that their product is “of poor quality.”  The balance of the comments indicated will be retained for our records in the event this moves to further civil actions.Peakview Property Services contracted for the exterior painting of the property in question.  Over the past year or so Peakview has complete numerous painting project for this contractor and they are well aware of our quality and service.  In this case something seems to have changed.  His complaint indicates that he wants Peakview to return to the project.  However, on April 21, 2016 the contractor issued a stop work demand and ordered us to “stop all work” and indicated we are “no longer allowed on the property.”  He did not ask us to correct deficiencies or address problems.  The order simply says “You are fired from this project.” Since that time he has demanded that we return to the project and not only address problems that are beyond the scope of our contract, but also that we do so without compensation for the work we have done or the balance owed on the existing contract.  In addition, the contractor has sent numerous threatening texts to myself and even family members that have no connection to the business in an effort to coerce and intimidate.  The contractor has requested that the desired settlement be to “Finish lap siding correctly. Do want (what) was contracted by him. Own up to his poor quality or work.”  However, because of the irrational, threatening and abusive actions on the part of the contractor I cannot return to the project with this contractor.  In addition, since [redacted] Construction and Design wrongfully terminated our contract and removed us from the job site, Peakview Property Services has had lost revenues and encountered other costs and down times in relationship to this project and the actions of the contractor.  At this time Peakview Property Services is going to retain our rights to pursue any civil remedy we feel is appropriate for these costs.  In addition, we have had to contact law enforcement in regard to the threatening phone calls and texts we and other family members have been receiving. The simple reality is that many of the issues that need to be addressed on this project are things that are traditionally addressed during the touch up stage at the end of the project.  Cleaning up overspray, scraping and recoating areas missed during the initial painting are all part of the final touch up phase and had the contractor allowed us to complete the project we would have cleared up most if not all of these.  However, he chose to remove us from the project and then, even though he seemed to think we were incompetent, demand that we return and do work beyond the scope of our project without compensation.  Because of the erratic and threatening nature of this contractor, Peakview Property Services cannot return to this project with this contractor present.  However, we would offer to visit with the home owner or another independent representative, and would address specific issues in regard to the work we have done and how we might be able to correct deficiencies that exist. It should be noted that this visit would be to strictly address perceived deficiencies in the work performed and, if possible, to reach an agreement on what items should/can be corrected, what costs, if any to be incurred, and a time line for completion.  We invite the home owner or another independent agent to contact us to set this meeting.Peakview Property Services values the relationships we have with our customers and the Revdex.com.  We make every effort to ensure our customers are happy with the quality of service they receive from us and we hope we are able to find a way to ensure the home owners of this property receive the value they deserve.  However, we will not be subjected to abusive, threating and intimidation tactics from a contractor. Thanks you for your time.
