Banyan Living takes pride in all of our properties, Mr***' community is no exception We hate to hear he has escalated his point of view to this level however we have made numerous attempts to calmly speak with the resident directly That has not been successful Mr
*** is a family member of a form employee who was relieved of his duties a few months ago(** *** *** *** *** *** ** *** *** *** *** *** *** *** *** ***) Prior to that Mr*** had never complained of anything Mr*** has been so aggressive since his relative left the company that he has been served a notice to refrain from contacting the office for anything other than immediate apartment services need In one hour business day he made numerous irate calls to the office, calls to be exact, if you include his roommate That letter can be shared with the Revdex.com if needed Furthermore his complaints to the Portage County Health department we also unsuccessful as they inspected the community and found NO VIOLATIONS, we have a letter from the PCHD that can also be shared with Revdex.com if needed His ongoing complaints of trash build up at the compactor is the occasional result of residents who do not properly disposing of their waste There is signage posted of proper use of the facilities as well as contact information for HOURS assistance if the area is in need of attention, all clearly posted at the location Pictures of the signage can be provided to the Revdex.com if needed His statement regarding the shortage of accommodations needed for additional dumpsters is as the capacity of the compactor onsite is more than ample The compactor has the capacity of 5-standard dumpsters We firmly believe that adding smaller capacity dumpsters throughout the property has the potential to create multiple eye sores if Mr***' neighbors continue to ignore posted signage The compactor disposal area is conveniently located toward the center of the property and exit so all residents can easily stop by for disposal anytime they are leaving the community.Mr*** is seeking release from his lease now that he does not have family in the office, we will not be able to honor that requestWe do feel the team onsite has gone above and beyond to maintain the property to the highest standards as well as honor ALL terms of his lease We sincerely hope that this request not indicative of any unauthorized preferential treatment that he may not be receiving since the exit of his relativeWe are very proud of our equal housing opportunity compliance at all of our communities no matter the who they may know in the office We are hopeful the last months of Mr***' lease contract can be more enjoyable for him than the last few month have been, we truly value all of our residents

I am rejecting this response because:
This issue comes down to the front office not taking proper care of the property, but always seems to come back to the issue of my 3rd cousin formerly working in the front officeThis issue has been on going as you can read back to the Revdex.com complaint over years ago that states the exact same problems I've brought forthRegardless of who is running the front office this issue hasn't been fixed and that is why I'm asking to be let out of my leaseEven when my relation was working in the office this was an issue, but at the time we had someone from the front office living on site, this is sadley no longer the caseThe front office and upper management have also been hostile and uncommunicative causing miscommunication issues that have ruined any chance of resolutionsWhen the Regional Property Manager holds her property tax amounts ($250,000) over the importance of your complaint, you know you have a problem in how your customer service is handledOn multiple occasions in the last week I have had to take trash back to my apartment because I could not access the dumpsterIt's not rocket science, but it seems this management company can't admit to when they can't fixed a problemIt shouldn't take over years to figure out a trash situation with your residents, not only is this irresponsible but it's also unprofessional at every turn I have CC'd the Ohio Attorney General as they have been looking into this issue as well

The applications for the apartment was completed by 20 year old adults as well as the co-signer which in this case was a parent.  The Application process is very transparent, all marketing material as well as the application steps tell the applicant(s) what is going to be charges and when....

 On two occasions during the application process the applicant is advised that they'll have 3 days to cancel without penalty, after that time the aptly name holding fee will be non-refundable as we will take an apartment off the market for them and turn away other potential applicants.   Each of the 3 applicants recieved the notice of charges twice during the application process, so for this group of 3 applicants (2 residents and one cosigner) they were advised of the Holding Fees a total of 6 times.  This apartment was off of the market held for these applicants for 8 days.  Our pricing as based on the longevity of the lease term and supply and demand of the market and therefore will fluctuate daily.  We are distressed to hear the Browns were not happy with our services but unfortunately on advice of Council we will not be able to refund undue fees as that would set a precedent that non-refundable fees are now refundable since we would be required to treat all applicants the same under Fair Housing.  We are very glad to hear they were able to find a more suitable housing option for them in Kent and wish them well. Respectfully.
