We were reliable tenants of Pegasus Realty Corp for 38 months from August 2016 thru October 2019. We moved out of *** on Oct 31, 2019. It took Pegasus Realty Corp OVER 60 days (which was the maximum allowable time on the lease) to refund us back our deposit money which was originally $1,277.27.
When we finally received the check in the mail, it was in the amount of $363.42. They had kept $913.85 in which they provided descriptions for.
The one item which we have asked them to provide us with substantial evidence for, which they have not, was for a bathroom vanity that they accused us of damaging (which we have no recollection of doing). They deducted $131.52 from our deposit. All they gave us was a super close up picture of an unrecognizable image and a receipt from *** (dated 40 days after we moved out), which had several items on it not pertaining solely to our unit. We asked them to provide us with an installation receipt from the company who supposedly installed the new vanity, including the address of our unit. They provided such invoice for a painting company that they hired to paint our unit, so why did they not have an invoice for the vanity?!
Considering they deducted a significant amount from our deposit of which we at least found reason for in the lease (although we never received any invoices for said charges in the mail and were charged late fees on top of it), the one item that we completely disagree with, they are refusing to cooperate with us on. Any reputable and ETHICAL company would be able to itemize all charges and provide such evidence upon request.

This message is in response to the Revdex.com complaint received by Pegasus Realty Corp. on February 21, 2020, that was made by a former tenant, Creative Company. First some background - Pegasus Realty Corp has been in the business of managing commercial properties for over 25 years in Colorado, including the Creekside II Office Park since 1994 which is owned by an affiliate company, and never had a Revdex.com complaint filed against it. During this time, we have processed hundreds of security deposit returns with very few issues. We are proud of our record and value our reputation for honest dealings over many years, so we do not accept being accused of unethical behavior lightly.At issue seems to be whether or not a bathroom vanity countertop at Creative Company’s former office suite at ***, Centennial, CO had damage caused by the tenant, above normal wear and tear, that was identified after move-out for which $131.52 was withheld from their security deposit. The tenant was provided with photo evidence of the damaged countertop and a receipt for a new countertop. For additional documentation, we can forward video evidence and additional photos of the building and bathroom to visually confirm that this occurred at that particular location. Each bathroom is unique in terms of floor tile, location of water supply line, so the photograph and video can corroborate the exact old vs. new countertop location. Additionally, our property manager and maintenance person involved in the work are willing to sign affidavits confirming the damage and replacement of the countertop.The security deposit reconciliation was mailed to the tenant within the 60-day time frame as stated in the lease. Ms. was provided with a detailed nine-page listing of the other items that were deducted from her security deposit pursuant to the lease agreement (previous monies owed, but not paid by the former tenant, other damage expenses, etc.). We find it interesting that Ms. is disputing this relatively minor issue in the context of the return of the security deposit, which leads us to believe that this is a fabricated dispute by a disgruntled former tenant meant to damage our reputation and cause us to expend time and energy dealing with this issue.Please feel free to contact me to discuss if you have any questions or if you would like the photos and video.Regards,Pegasus Realty Corp.

I am rejecting this response because:

I have attached the photo and copy of a receipt that Pegasus Realty Corp sent to me when I requested proof of them replacing the bathroom vanity in our unit. As you can see, the photo is a super close up of something that appears to be a chip?! Forgive me, but that could be a photo of anything and not necessarily our countertop! Also as I mentioned in my initial complaint, the copy of a *** receipt dated 40 days after we left which includes several items on one receipt is just not proper accounting nor is it sufficient evidence to prove where the vanity was in fact installed!!!

Pegasus Realty Corp has reiterated that they have been in the property management business for 25 years, but this still has nothing to do with the issue at hand. They could be in business for over 100 years for all I care! The fact that they messed up by not documenting everything properly and then accusing us of damaging a bathroom vanity would not hold up in a court of law. Hearsay does not count as substantial evidence and would not hold up in a court of law! Therefor, I am not going to accept an affidavit from their property manager as proof that the bathroom vanity in our unit was damaged. They clearly do not have proper evidence and therefor they owe us the $131.52 that they unlawfully deducted from our security deposit. In fact, we did not even receive our security deposit within the 60 day time frame as stated in our lease. I have an email that I sent to Denise *** on January 7, 2020 stating that we had still not yet received our check in the mail. Since our lease ended October 31, 2019 we should have gotten our check in the mail no later than December 31, 2019.

This is just totally unacceptable!

Attached are before and after photos of the vanity top in Creative Company's former office suite bathroom along with a statement from our property manager relating to how this issue was handled. You can clearly see this damage to the vanity in the "before" photo. Also note how the floor tile, toilet and water supply lines match up in both photos to confirm this took place in the same location (***). We also have a short video starting outside the building showing building address/suite, then continuously moving into the bathroom, but it doesn't appear that it can be attached to this Response to Complaint.
