PEM Properties responses to claims for the above case Mr. [redacted]:
The location that he does not mention in his claim is [redacted].
We are not the General Contractor. Mr. [redacted] is his own General Contractor who hired PEM Properties to do some of the work to the property at [redacted]. Akron, Ohio.
All work is complete except for the gutters and downspouts that is on schedule. Mr. [redacted] is aware of this and is also aware that it is on the schedule to do.
The addition has been inspected by the building department and approved. Any other inspections have been done and approved. We are not sure why Mr. [redacted] is requesting this. He knows it has been inspected and approved.
The "rough" electric is waiting inspection. It is possible that the inspector was there and could not get in. The doors may have been locked. Once the rough electric inspection is completed, then the electric can be finished. The electrician pulls his own permit. He is asking for a refund. He has only paid for the rough. The rough is completed and waiting inspection.
The permit pulled by PEM Properties was for the work that PEM Properties has done. If Mr. [redacted] has other work to be done by him or another company, then he will have to pull permits accordingly. He is not using our permits for other work. Our permits were specifically for the work that we did, not for anything else he would do.
The HVAC (heating) has to put register covers on, but cannot do this until Mr. [redacted] has other work that he is doing or having another company do and completed. HVAC has own permit as well.

[redacted](PEM properties) went to the city of Akron with me, and under oath, stated he IS the general contractor for [redacted] project. He then obtained a permit for the work that ONLY the general contractor could get. This house had a small fire in it in September 2014 which makes it mandatory by the city that a "general contractor" be the one to do the work and obtain the proper permits. This is what [redacted] was hired to do and started but has not finished. He pulled the permits under PEM properties-he was paid to do the electric work and the furnace work which I have receipts for. Now I am being threatened for litigation by [redacted] and Cooling because PEM has not paid them as of yet for the service they provided. Also, the electrician (Electrical Fire and Data) has not been paid by PEM either. I have paid PEM already for these services and yet he has not paid the companies that he contracted to do the work. Also, as of date, he has not been over to the home to finish the gutters. At this point I would like my money back and to have no other dealings with PEM. Over the past several months, it has been very difficult to reach [redacted], literally zero communication as to the progress on the house. and he has been very unprofessional. He was paid for a job that has not been completed. Often saying he would be at the house to start a job then not show up. Weeks went by with no work being done, knowing there were timelines that were set by the city that [redacted] was aware of having been the general contractor. He attended the hearing with me at the Summit Co Health department as my general contractor. Due to the house fire, the law states that the work can only be done by a general contractor, which is why PEM was able to obtain the permits and do the work.

We did get a permit to do the work that we were hired by Mr. [redacted] to do. We were not hired to do the complete job for the property at [redacted]. We were only hired to do specific work. We are not the general contractor for the entire project at [redacted]. Mr. [redacted] made all the decisions as to whom he was hiring for the project.
I cannot make this any clearer and this will continue to be a back and forth thing, because apparently he is not clear on what a general contractor is. Mr. [redacted] coordinated the project and got quotes and hired us for a specific portion of the work to be done at [redacted]. PEM Properties did not do the entire project. He hired us for a particular part of the job. There are things being done to that house that he did not hire us to do. We were hired to do the work that was in the contract. He had other work to do and wanted other people or does the work himself.
He is not doing other work under my permit. We were not hired to do the entire job.
The work was done, inspected and as I stated in my first letter there are a few things that need completed but it is waiting on Mr. [redacted] to finish his work and also on an inspection (regarding the electric). (SEE the first response) My company did the work and is complete - inspected and approved.

PEM Properties has not reimbursed me for anything , nothing has been resolved. I had to pay extra money to bring the wiring up to code and the furnace company still has not been paid. PEM Properties knows that they were the General Contractor for this house and did not finish what I had paid for. I have all of my receipts showing everything is completely true as to what I said. I still would like all money due to me and the others whom have not been paid. This matter has not been resolved.
