This letter is in response.to subject ID [redacted].The subject property, located at [redacted] was assigned to PEMCO LTD on 12.18.2016 and subsequently listed oil the [redacted] on 12.30.2016 (Uninsured). Per the appraisal and BPO the subject property was listed...

as a 4 bedroom 3 bathroom single family detached property, the non-permitted addition was not disclosed on the PCR or Listing disclosure.  The appraisal report was completed in accordance with4000.1 paragraph iii page 441. Disclosure of a non-permitted addition is not required nor is it considered in the appraiser's scope of work.Mr. [redacted] with [redacted] submitted bid #8 (Investor) on behalf of the complainant on 2.24.2016 during the extended bidding period.The contract was received and executed on 2.29.2016, all required documents including the condition of sale and the forfeiture and extension policy were signed by the investor purchaser.Mr. [redacted] with [redacted] submitted a signed cancelation form on 3.11.2016 requesting the [redacted] be return to the complainant due to misrepresentation and failure to disclose a non-permitted conversation of the garage.In accordance with the condition of sale and the forfeiture and extension policy, the request to return the complainants [redacted] .was ·denied on 3.11.2016. The complainant submitted an appeal dated 3.11.2016, a Work Order Notification was created in P260 and submitted to [redacted] for review which was denied by [redacted] on 3.14.2016.Thank you for your [redacted]e and assistance with this matter.

I am rejecting this response because PEMCO had written notice of the illegal garage conversion but violated its duty to disclose this material fact. A detailed explanation is attached.:

I am a REO Broker and I would highly recommend this company. They are very professional and have great customer service.

Review: I called Pemco to cancel a sale due to the foreclose home having too many issues such as the property's foundation and other issues with state funding grants to help low income families purchase a home. Pemco did not offer help, but told me to tell my real estate agent helping me and so I did. She failed to cancel on a timely manner as she waited for state funding, but I wanted it cancel before the deadline to foreclose. I did not fall through on my part. I called Pemco twice to discuss this matter with no help offered. I'm a single mother and feel I am cheated by Pemco holding my $1,000 down payment. I also would like my down payment reimbursed, since I was diagnosed with abnormal cells.Desired Settlement: I would like my down payment, since I did not default on my end.

Good Day,In response to your complaint, PEMCO would be happy to assist you in filing an appeal to receive your earnest money that was forfeited as a result of your contract expiring and failing to close. PEMCO forfeited your earnest money originally in compliance with the requirements of Housing and Urban Development as outlined in the forfeiture and extension policy executed by you and your real estate agent at time of contract. In order for this initial action to be reversed, HUD must receive and review a formal appeal and render a decision. PEMCO is happy to assist you in submitting this appeal. We will need you to complete and execute the attached form. Please email the form to the address indicated on the form accompanied by supporting documents for your request. In this situation, you indicated that the house had too many repairs. Please provide documents such as a home inspection with your cancellation appeal. You also mentioned issues with down payment resources. If you have anything that documents that such as a letter from the state that would also be acceptable documentation indicating you would not qualify for the loan. Please submit this in one email and write APPEAL on the top of the form and in the subject of the email. Upon receipt it will be assigned for review and remitted to HUD requesting that they grant your appeal. Upon their decision you will be notified. Please allow 7-10 business days from receipt for your appeal to be processed and HUD to render a decision.
