As you correctly mentioned, there are two sides to every storyit is very unfortunate that this person is resorting to this in order to seek moneyThe facts are that this person performed a professional inspection before they signed a purchase and sales agreementThey thoroughly inspected the property and identified various items they wanted us to fixWe fixed absolutely everything they requested and then somePrior to the closing this person and or her broker went to the property numerous times, even though there is a limit on the purchase and sales agreement in the number of visits, and they throughly again inspected everything, and anything they brought up we addressedThen, prior to the closing, they conducted a final walk through to verify that everything had been completed as agreed to in the purchase and sales agreementHaving done that, she attended the closing and did not mention to our attorney any repairs that needed to be addressedNormally, if something like this comes up, there is money held at the closing to address this, but because nothing was mentioned, the closing took place and she received the keys to the propertyAlso, note that after the closing, this persons made no attempt to advise us of anything wrong with the property other than seeking money from us by filing a complaint with the attorney general, which we believe was dismissedMassachusetts law is very clear that once title passes to a buyer, there cannot be claims for items that should have been brought up before they purchased the propertyThis person had more than ample opportunities to address things and she did not, but whatever she addressed we took care of by the time for closingPlease note that we were very fair to these people and they had the opportunity walk away from the transaction and recover their deposit but she never did, and instead she is taking this unfortunate actionWe have sold many properties and have always addressed issues, and this is the first time we are faced with this situationIt is very unfortunate but it is not correct what this person is doing
