Complaint[redacted] Management did not return our deposit, nor did they send the requested proof of damages in pictures and receiptOn May 2, 2016 I sent a letter to [redacted] via the business address. It was sent to the attention of [redacted] and Pendergraph Management. Below is the complaint in details.Today I received a check in the amount of $122.00 ($100 refundable pet deposit and $22 security deposit) for the return of my security deposits. After consulting legal counsel I am challenging the amount of the refund. 1) [redacted] told us that all we had to do was sweep and vacuum the floors because he was going to strip and wax the floors. Also [redacted] came over the very last day while we were moving and said that the apartment looked good and she saw no problem with it. [redacted] and [redacted] were present at this time.2.When [redacted] went to turn in the keys [redacted] refused to do a walk through because she stated that she was busy. She also said that place looked fine and she did not see anything wrong with the place when she was there earlier. [redacted] was also present at this meeting. On the move out report, I was charged $3 for the chip on the stove. The chip was an accident and is also normal wear and tear. I also challenge the cleaning fee of $75, the $75 painting fee, and the $75 carpet cleaning fee. [redacted] stated to us that the unit was clean. However, [redacted] decided that all apartments would now require professional cleaning. There is nowhere in the lease that makes such a provision. There is a waiting list of people seeking an apartment and a new tenant moved in the weekend of April 8. Because of this and the fact that [redacted] was an employee of [redacted] and any work he may have done was part of his normal duties, there are no actual damages or costs.It is my contention that the painting of the unit is normal wear and tear. Also since the carpet was 4 to 6 weeks old, the carpet did not need cleaning. At the time of being advised that the carpet installers were coming, [redacted] knew that we were moving and we asked her to put off the appointment until after we moved out. This request was denied. If Pendergraph says that it needed cleaning because of a pet, it is my contention that should have come out of the $150 pet fee that was stated by [redacted] to be used for the clean up after we leave and would not be returned. Pendergraph Management and their associates cannot double dip in the fees.It is my contention that:[redacted] told us that the apartment was clean and in good shape.She also stated that we would receive all of our deposit money.She also refused to do a walk through and the move out report has been doctored by [redacted] and did not include all of the "Need Cleaning" marks. When asked for a copy of the document, [redacted] refused and stated that we would get it with our deposit money. However, when we called and inquired about our deposit we were told that [redacted] told [redacted] that all the painting and cleaning had to be done by a professional.At that time we requested all receipts from the professional cleanings and pictures supporting the claims against us.I also contend that the apartment was cleaned and vacuumed.The lease also uses vague and open ended statements. It is also contrary to NC Statutes. This would also support the return of our full deposit.Desired SettlementI am seeking a return of my remaining deposit of $228.I want the proof of the so called damages in way of pictures and receipts.Business Response A response was sent from the regional property manager regardint the previous residents appeal on the charges of the security deposit settlement. This letter was sent out on June 1st, 2016.This letter detailed the items charged and discussed possible changes to the settlement. If both agree a revised security deposit settlement would be sent out to the previous resident.Consumer Response This was resolved to our satisfaction
