I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

In response to Mr [redacted]'s, reply let me begin by saying he and his secretary/partner or whatever named June should do better communications as I made the appointment for Dec 10 with her and also reminded her to bring their check book as the amount that they had written for both counties to file my two properties into my living trust were NOT adequate.....both counties returned them.  This was the day after my return from an overseas trip and I wanted to get the counties filed in the 2013 calendar year since the trust was started in October.  This was NOT the first appointment that they neglected to show nor call to reschedule or apologize.  One was about a month earlier.

A week after I returned from my trip and the December 10 appointment never happened.  I had numerous phone calls into Mr [redacted] to see when they were going to get these issues completed.  It took one week after before he bothered to return my phone calls.  He said he would get the corrections and the checks to the two different counties off in the mail.  I objected to the mail route and wanted to meet personally at either on my places. The reason for this is the mail address change was taking effect within that period of time and I didn't want further delays or rerouting of mail from Yavapai county to Maricopa county.  I did wanted the correction to page 21 that he mentioned. He proceeded to tell me that he would call me when he returned from Seattle at the end of the month and then hung up on me.  He certainly lacks good business etiquette, truth telling and follow thru on his commitment.

Several days later, while I was still at my Yavapai county residence,  I received an envelope from him with the corrections for page 21, duplication of some other pages which lacked his notary stamp and the two checks for the two counties for the proper amount.  I made the necessary corrections to both filing claims, enclosed the checks he sent and mailed them off.  As of this writing, I have received the filed property information from Yavapai county, therefore things were correct this time, but I am still awaiting the 2nd filing from Maricopa county. 

I do not understand what Mr [redacted] was talking about in his response to the claim about not writing check to the counties.  Please note that I have attached copies of the first checks that Mr [redacted] seems to say they did not write.  There were returned to me from both counties.  The name in the top is [redacted], Inc which is part of their company. Penn Planning did not mail them, but they gave me the proper papers to sign and send, (even if Mr [redacted] didn't finishing signing the day and date he notarized my signature),  the checks and the addressed, stamped envelopes to each county. The initial check amount along with other errors was the reason each county returned them to me and I informed Penn Estate Planning.

I am still awaiting to see if everything was correct this time from [redacted], I am not ready to say they finally completed their end of the agreement.

We do not file documents with any counties, that is the client's responsibility.  We do not make out checks for our clients. We do not pay fees for clients.  If someone authorized us...

paying any fees for the client, it would have been done without any out of pocket funds from the client. Our research shows that we have honored our contract in full.  There were changes made to the client's page 21 when the client wanted to omit new people from receiving any benefits of her trust estate.  We did not charge for the change. We have no record of any appointments scheduled with said client after October 10, 2013.  Again, we show that all of her requests were handled in 2013. Thank you, [redacted]
