#[redacted] Dear Sirs,   We are in receipt of the above mentioned complaint where Mr. [redacted] claims his unit was not move in ready. However, invoices and pictures prove otherwise. The Lodge at Shavano has invoices paid to professional vendors for cleaning of the unit and carpet cleaning. Also, the previous residents who resided in unit number 328 before Mr. [redacted] left the unit in good condition.  Pursuant the terms of the Lease Contract, Mr. [redacted] is responsible for a professional carpet cleaning, cleaning of the unit, any damages and the final utility bills. In viewing all the evidence from the previous move out and Mr. [redacted]’s move out we can see no reason to refund anymore of the deposit.  The Lodge at Shavano Park Apartments provides an outstanding living experience including our dedication to the highest level of maintenance and service to our residents.   Sincerely,  [redacted]Management SupportAccount Resolution

I am rejecting this response because:
When I moved in I was told by one of the nicest reps of the Lodge at Shavano Park; Crystal that if I terminated my lease earlier due to my deployment overseas I will be charged Relet Fee (85%) ONLY. That was the reason I accepted and signed the contract where there is nowhere it says about Relet Fee (85%) and one month rent if I terminate my lease earlier.
Indeed on February 1, 2016 I went to the office and presented the Property Manager [redacted] my work orders of my overseas deployment and asked for a waiver of the early lease termination. The Property Manager [redacted] handed me the early termination form and asked me to wait until I hear from corporate office [redacted]. On February 20, 216 I picked up a formal early termination document from my mail box dated February 12, 2016 (see attached files) signed by [redacted] from the corporate office of The Lodge at Shavano Park.
I have tried a few times to talk to the Property Manager [redacted] but she was not available and finally on February 24, 2016 I met with her at the office and handed her my early termination form dated February 1, 2016.
On March 01, 2016 I met with the Property Manager [redacted] and paid my utility bill of $17.16 and the Relet Fee of $794.58 . I asked the Property Manager [redacted] for payments arrangement for the remaining balance and was told that I will be contacted by the Account Resolution [redacted] for further discussion.

Before I left the office I stated to [redacted] that I may not be around and provided her with business card of my lawyer Jamal Rhadbane. Unfortunately, I never heard from Ms. [redacted] or anyone from
The Lodge at Shavano Park corporate office.
Since I was told I only will be paying the Relet Fee when I moved in which I already paid $794.58 (see attached file) and the utility bill I am asking The Lodge at Shavano Park for a waiver of the remaining balance and to consider my case is closed.

Lodge at Shavano Park, if Mr. [redacted] chooses to vacate early he can either pay out the remainder of the rent due on his Lease contract, or he has the option to exercise an Early Lease Termination. These options were given to Mr. [redacted] by the property manager on February 1, 2016, and then again by our Property Supervisor in a letter dated February 10, 2016. On February 24, 2016, Mr. [redacted] turned in the Early Lease Termination agreement along with possession of the unit. Mr. [redacted] will be responsible for rent through a 30 day notice, which will be March 24, 2016, a fee equal to one months rent of $';34.80, a Relet fee equal to $794.58 and the discounts he was given at move in of $300.00. The Lodge at Shavano Park provides an outstanding living experience to all our residents including military personnel. Unfortunately, pursuant to our company policy, we simply do not make exceptions to our lease no matter how deserving the situation may appear.
