Review: Improper collection of "credit check" fee; and failure to perform ACTUAL credit check.

I inquired about a studio apartment at Pensione K Apartments. I spoke directly with the manager. He showed me the actual studio unit. He collected my holding deposit AND the credit check fee BEFORE even asking to verify my income. BUT about 2 days later, I met with him again and at this time he verfied my income. THEN he told me that I earn TOO MUCH to qualify to rent ANY unit. He gave back my Holding Deposit check BUT he refused to give back the Credit Check Fee of $25.00 - EVEN THOUGH he NEVER actually performed the credit check AND there was no need to do a credit check BECAUSE the manager claimed that I earn TOO MUCH to even rent from there. I think it was a RIP OFF to take my $25.00.Desired Settlement: I want the $25.00 returned for the Credit Check that was not warranted AND was NEVER done anyway.

We have attached a copy of the applicants "fee waiver" & "denial letter" and where it states and signed by him (applicant) where it states "this fee is not refundable in any circumstances", applicant has agreed to these terms, though he was not denied based on credit or back ground circumstances, though was entirely based on Income restriction based on the low Income Housing Guidelines which are followed by the California Tax Credit Allocation Committee.
