I had my mechanic review the repair shop estimate in which the customer is requesting reimbursement for and want to bring to his attention the amount in which he paid and what it was that he paid forHe paid BMW of Minnetonka $in diagnostic charges and $in "misc labor" to secure an
intake clampThis is something we would have done free of charge at our shop as we do not charge our customers diagnostic fees or have any miscellaneous labor feesI had the intention of paying him back the difference between what we would have charged and what they charged but because our cost for this is $0, I am not able to do soGoing forward, I would suggest calling us first prior to making a decision regarding a repairI do apologize that this happened, but we could have fixed it for nothing and not had to use any of the warranty as the dealership he took the vehicle attempted to do

I am rejecting this response because:
I asked them to fix it when he ran a check when my engine light came on ans I was told it was covered on my warranty which was not plus I was told they would not fix my car it was used this matter is not over I was told my coverage was good and it was not the case

In response to the claims by *** ***:I would like to first point your attention to the credit application *** filled outThe first credit application was completed on 02/27/and Ms*** stated she worked for *** *** ***Again, on 04/05/she stated the sameOn the secured
credit application the applicant is to fill out the application true and accurate and any statements may subject the applicant to criminal penaltiesNow I would like to direct your attention to two letters, the first of which was provided to us by Ms***The first cause for concern on this letter is the dateIt reads "April 5, 20016" and goes on to state alleged dates of employmentWe believed this letter to be fraudulent, not only because the date was innacuratley entered, but because the bank that approved her loan was unable to verify she worked thereUpon receiving this letter we called 3rs and spoke with Anthony *** who stated Ms*** did work for the company, but was no longer employed and did not work the duration of time she stated on her secure credit applicationsOn the letter Anthony sent us, he informed us Ms*** worked at 3rs for months, from November through February On the secure credit application she claimed she was there for years, monthWhen we receive credit applications, we submit them to our lenders with the information provided to us by the applicantThe lending institutions either approve or deny the applicant based on this information, as well as with the applicants credit historyIn this situation, the application for Ms*** was approved contingent upon her employment history (which was deemed to be false) and her down payment of $5,000.I have attached copies of two separate receiptsA credit card receipt for $and a cash receipt for $713, for a total of $3,000, this was the amount we received when she took delivery of the vehicleMs*** was unable to run the full $5,in one transaction on her card and told us the remaining $2,could be processed the following business dayIn good faith, we accepted this arrangement and when we attempted to run the card the following business day it was declinedNow she has lied twiceOne time to us regarding her employment, and one time in this claim about the amount of her down paymentThe final two documents I would like to call your attention to are the conditional delivery agreement and the forfeiture notice.A conditional delivery agreement is a form we have all of our customers fill out when they take delivery of a vehicle based on an approval by one of our lending institutionsA conditional delivery agreement, in short, states the customer is taking the vehicle based on the approval received from a bank based on information they have providedThe customer signs a contract, provides stipulations (check stubs, insurance, references, proof of residency, etc) that we send out to the bank for a verification processUpon receipt of these documents the bank verifies all information provided on the application on which they approved the loanIf any of the information is deemed to be false, the contract gets returned and the bank will not follow through with the loan as was the case with Ms***The forfeiture form is a document the customer signs agreeing to forfeit any or all of their down payment or trade in used as a down payment if the contract is returnedWe are denying any and all liability to Ms*** due to the fact she misrepresented information to us and to our bank on a secure credit applicationWe will not be pursuing criminal action against Ms***, but we will not be held liable for any of her claims. If you have any questions, please feel free to contact me at ###-###-####.Thank you,Kevin ***Perfect Auto

Initial Business Response /* (1000, 5, 2015/05/14) */
Copy of the warranty paperwork attached - the warranty purchase price was $1415, not $2000. The coverage started at 121,470 and expires 2 years or 24,000 miles from the purchase date/mileage; whichever comes first. The warranty options are...

populated based on VIN and vehicle mileage and would not be eligible for a contract if one or the other do not work.
Initial Consumer Rebuttal /* (3000, 7, 2015/05/16) */
(The consumer indicated he/she DID NOT accept the response from the business.)
when I purchased the car, it was at 121,470 miles. I bought the delux coverage warranty with [redacted] warranty company. The coverage states that they cover vehicles with less than 85,000 miles at the time of the purchase. attached is the warranty that was purchased! also underlined is the number of miles the warranty covers, which states 85,000 miles. I purchased the car at 121,470
Final Business Response /* (4000, 10, 2015/06/01) */
That is the brochure from the warranty company. I have attached the actual warranty she purchased. The warranty is good for 24 months or 24k miles from the mileage it was purchased with. Paragraph I clearly outlines what is covered. What she had underlined was a section pertaining to the suspension and only the suspension.

I am rejecting this response because: the employer Kenny [redacted] who worked for perfect 10 auto at the time recommended I put two years employment on My application for employment. I gave a $5000 dollar down payment which Mr. [redacted] stated the company owed him money so he asked me to do the $3000 dollar payment with my card and I gave him $2000 dollars in cash. Now at the time I bought the car February 28, 2016 I was in fact employed at [redacted] center. The company didn't decide to verify my employment until the middle of March which by that time I had went on maternity leave and was Terminated March 11, 2016 but I did not realize this until I received a letter from my employer April 10, 2016. So the information I gave was in fact true and not fraudalent to my knowledge. Not only that but perfect 10 fired Kenny [redacted] a week after he sold me the car due to fraudulent activity on his part. I feel the company owed me the car or my down payment because the information I gave was indeed currect and true they have checked stubs from the company to prove this. I feel I signed a bill of sales at the time of purchase a a contract which basically states I bought the car and the deal was finalized. Usually u are not supposed to do this until the bank accepts the loan.

Initial Business Response /* (1000, 7, 2015/06/12) */
Perfect 10 did not have a second set of keys nor was Perfect 10 involved in the "theft" of the vehicle. There will be no reimbursement of any down payment.
Initial Consumer Rebuttal /* (3000, 9, 2015/06/17) */
(The consumer indicated he/she...

DID NOT accept the response from the business.)
no I do not accept.perfect 10 is claiming that there are only 1 set of keys and they didnt have anything to do with theft but I have documents that said
the same suv was sold 13 days prior to me buying the suv.where ever the truck came from someone had keys its perfect10 responseability to change locks or investigate who all test drove or brought truck keys could of been copied at any time my best defense is where the truck was stolen from and the last owner of truck lived with in 2 miles (thats 13 days prior to me buying truck)something went wrong with prior deal and im stuck in the middle.perfect10 never asked for a police report or to come discuss issue they held tabs until fist payment was due. thats they have 11 complants involveing sales issues which tells there buyers u brought or signed a contract and that it.they sold that truck so fast that they didnot even bother to clean out that truck because if they had I would not of found that buyers info in that truck all I wanted them to do was to give me a truck and I would of forgoting the issue it is the least they could do but since I asked them who was the last owner of the truck it was not my business and they didnot have to tell me anything whatever document I have didnot mean anything.if the give me a truck through a nother party this issue is resolved if not im fighting this until the end I will prove fraud on this claim my credit will stop me from getting a car over this and thats not fair to me
