Complaint: [redacted] I am rejecting this response because: No copy of a signed contract was given How could this job jump by $20,to fix a stoop repair from termite damage and rebuild the entrance steps (steps total)?No invoices were ever received It's funny how they say they mailed invoices but I never received any How could so many invoices be "lost" in the mail? I'm responding to the argument for rejection submitted by the client or his representative1. A copy of the signed contract was given to the client at the time of the contract signingOur standard contract form is carbonless and have two parts: one white, which is our copy and one yellow which is the customer copyThis he was given at that timeAccording to the copy of the contract included in our first response, the contract has the same date as the check for deposit that Mr*** gave us that day
Mr*** verbally requested more work to be done at his property at different stages of the work. Each time, the scope of the work to be done was explained and the cost were disclosed. He verbally agreed to each one of those changes, and give us a check as a deposit and agreement to the job to be done3. The work done at Mr*** property was not a simple stoop fix and rebuild of the entrance steps. It was an extensive landscaping work, including:
Demolition, removal, disposal and rebuild of the entrance stepsDemolition, removal and disposal of the deck, shed and garden wall.
Walls and walk buildBelgium block and native stone installationPut rock near the river bedPlantings, including seeding, topsoil, spread, level, delivery, fertilizer, etc
Two Front Tree Removal; two Back tree Removal and tree trimmingBelgium block work around the mailboxMulch and Fabric, delivered and installedRemoval, disposal, fix and installation of rotten foundation woodFront Railing

Weed removal, by hand and weeding spray application4. Invoices were sent regular ** *** ***. The client claims he never received. We have re-send all documents: signed contract, copy of the checks, a copy of the contract with all the additional work accepted by Mr*** and completely done in his property, copy of the invoices and copy of the check. It was send via ** *** *** Certified Mail, Tracking Number ***5. To our understanding at the moment we spoke to Ms*** ***, our notes at the office were that a copy was hand delivered. After further research, we found out that the invoice was never hand delivered, but was mailed and received accordingly to Ms*** own admission that she has shown our invoice to another landscaper to get his opinion6. We have tried to contact Ms*** *** multiple times, and left voicemail, but our calls were never return, until October that we finally had the opportunity to talk to her. Ms*** *** had never contacted the office during the almost three month that took the work to be completed at Mr***'s home. Never called the office to ask about the progress of the work. If she have a power of attorney before the date the contract was signed or had notified the office of this fact, Perfect Landscaping, LLC would have taken steps to seek her authorization and discuss the details with herWe never knew this detail until our conversation on October 26, 2015, and we think if this was the case, Ms*** *** had the duty to disclosed that fact to us, as a contractorWe had noting to cover up or making things up. All documentation has been provided. Again we are open and willing to clarify any misunderstanding relating to the services that were complete and professionally performed. Review: A contract was signed April 24, 2014 with Perfect Landscaping of North Haven, Connecticut. A check was written for a deposit in the amount of $1500. The check was cashed April 28, 2014. After one week from that date no information for the start of the work was received. After an additional several days phone contact was attempted with several voice messages left on voice mail. The only response was a message indicating the secretary would check the schedule and get back to us.After several more attempted calls, no scheduled work was made nor have any calls been returned to date. I have on several calls asked for a return of the deposit and a cancellation of the contract. Again no response has been forth coming. It is now a month since the first attempted contact.Desired Settlement: Refund of deposit and a cancelled contract
