November 19, 2019, I took my car for repair to this body shop. My insurance paid the owner, ***, for repairs. In january 8, 2020, I went to pickup my car and my car had zero worked done. It did not have frame work done like I was told. He got a check for *** for repairs cashed it and never did the body work.

*** is asking for a full refund of $***, when in fact he still owes Perfection Auto Body Repair a deductible of a total of $***. *** accuses *** of "cashing in" the check with having done "zero work" on his vehicle. This is not true, and in return to ***'s complaint Perfection Auto Body Repair will provide invoices for ordered parts proving that parts were ordered for ***'s vehicle. We also have a recording of *** taking his vehicle with our security cameras. *** also threatened *** on 01/04/2020 stating that "I'm going to get you into big problems if you don't give me my car" after *** telling him that "he needed a couple more days to finish it". There is another witness that was there at the time that *** was threatened by ***. *** needed more time to finish the car, because we were waiting for the supplement to be approved by the insurance company: *** We are not sure if *** is aware of how long the insurance companies may take to approve a supplement, they have to go through a process. *** did not mention how Perfection Auto Body Repair still worked with him after the fact that he stormed in for his vehicle and threatened ***, by giving him the wheel and tire that was left behind. We provide receipts to all our customers at the time that the deductible is payed, if *** states he did indeed pay the deductible then he can provide this receipt as proof, but our records at Perfection Auto Body Repair do not show any payment record.

I do not accept *** response because it does not match with my evidence of his fraudulent actions. Firs and foremost, the collision damage was in the right side of the vehicle from the fender to the rims. After two days I went to check the car and the right front door was damaged. It was damage that was not in the pictures that were sent to my insurance for collision report. *** caused the damage on purpose for insurance fraud. *** promised the insurance and myself, the car to be ready by Tuesday, December 17, 2019. The car was removed from his body shop January 8, 2020. The vehicle was taken to another body shop since he failed to do the body work and I had to pay out of pocket. The body shop that my vehicle was transferred to can verify that the car was not worked on like *** claims. *** claims he was waiting for supplements to be approved; However, the supplement was approved on November 29, 2019. In that day he already had cashed the first check of ***. Attachments will be provided. I look forward to him providing recording of me taking my vehicle because the cameras will show my vehicle was not repaired like *** promised my insurance and I. I was wondering why *** did not send the invoices of parts he returned. Further attachments will be provided.

I do not accept their proposal. First of all this is a two person body shop, *** and his English translator ***. *** never gave me a repair order Number. He never took pictures of my car. He cashed my insurance checks while forging my signatures. I never authorized the checks to be cashed in while the checks were in my name. While I was in *** business I never seen any business license or anything like that. I'm submitting transcripts to California Department of Consumer Affairs and also contractors state license board as you Revdex.com requested.
