*** ***---On August 2017, I filed a complaint with Revdex.com Cincinnati (Case #***)On August responded indicating they would take action to resolve my complaintThat same date I stated I found their response satisfactoryI was asked to provide data including receipts which I didAs of today, December 2017, Perfection Lawn & Landscape, Inc., has not attempted any contact with me or made any attempt to carry out the agreement of AugustI have given him three monthsBelow is the original complaintIf you need supporting documents I will provide them again as wellORIGINAL COMPLAINT: On May, 2015, I entered into a contract with Perfection Landscape to build stone walls with designs to redirect water away from my homePart of the water redirection was to tie the east side of my home’s rain gutters to a single pipe flowing out to a pdrain; on the west side the single rain gutter was to be extended out past the wall/planter so it would not flood the area close to the house; finally the north back area of the yard where the wall was redesigned the rain water was to be redirected easterly and flowing out into the woodsA stone patio was built to resolve water pooling on the east side of the deckAdditionally the exterior of my home was re-landscaped with new plants installed around the house and the yard returned to its original shape to include natural water sheddingThe work was begun in September and performed with the understanding that I would have a year to replace plants that diedIt was leading into winter so no new grass had sproutedI asked about this and John said he would resolve any problems noted within the year as previously statedAs spring came, it became apparent that the drains were not working properly; the pdrain would not flow and expel water, the drain on the east side was flowing into the flower bed washing out the plants and back filling to the house, and the drain from the north wall was washing into the yard but only when heavy water flowed otherwise backing up in the pipeAs the rains continued the soil was washing out on the east side leaving ruts and rocksThe rocks were from the removal of the old north wallThe yard was nearly impossible to mowSeveral plants died during this first year as wellI contacted John on April advising him that I had a few punch list items to be correctedHe replied the same day stating he would come out the next week to meet with us regarding the problemsHe came out on May reviewed the list and stated he would be out shortly to resolve the problemsBy August I contacted John again with the list of items noted to which he responded he would the same dated he would be out in September to resolve the issuesOn November I contacted John again asking why he had not followed throughI stated it appeared I would have to take action on my ownI also I said how disappointed I was with his follow-throughHe responded again on the same day and said “I am a man of my word “, and we set Monday or Tuesday of the first week in December as the date to resolve the issuesOn December I contacted John asking which Monday or Tuesday he had in as it was obviously not the first ones in DecemberJohn finally responded again on January stating he was waiting for the nursery to open back up and that he “did not forget about [us]”My last contact with John was March where I forwarded photos of the damaged plants and pdrain to himHe responded back that he received them and would “get to it soon for sure in the next couple of weeks.” It is now the end of August and John has not been in contact since March I have replaced the plants at my expense and resolved some of the drain issuesThree remain as does the rocks in my east yardEND ORIGINAL COMPLAINTBased on Perfections continued failure to perform tasks as agreed to, I do not believe that the company will do so nowI desire taking this into action myself contracting as needed then having Perfection billed directlyIf this is not possible then I need a legally binding contract that stipulates to the following: 1) Reimbursement for replacement cost of shrubs as stated in the original complaint2) Reimbursement for expense incurred by me for having to hire another company to correct the pdrain on west side of yard3) Reimbursement for expense incurred by me for having to hire another company to remove all rocks, grade (add dirt), and re-seed east side yard4) Reimbursement for expense incurred by me for materials and labor to correct drain spout at east side of yard (original drain was removed but not reinstalled resulting in water erosion next to house)5) Reimbursement for cost to dig and bury drain line running from walled area by back fence

I read the concerns on the email.  first off I am happy to reimburse the plants if provided a receipt.  I would also like to schedule a time with [redacted] to review the other concerns and set a date to resolve them.  once I review and we set a date we Will move toward to correct them....

 I will gladly move quickly to resolve the other three concerns.
