Performance First Concrete & Landscaping

We had a contract signed that he will get the work done on the house I'm building he was paid 33,000 - 6500 for the truck that he was going to be paying off by monthly which I had to take back from him today (June 21st/2014) because he hadn't paid me for the truck as he was supposed to every month. He took the money from me and only did half the work. When I told him to come finish off the work that he was paid for he wouldn't say no but I'd get it done tomorrow but that would never happen. I got fed up of him saying it will be done so I asked for my money back but he said he doesn't have the money no more he spent it all and would make excuses so he doesn't have to work and return the money or he would start swearing and hang up. I had to hire some other company to get the work done. That he was supposed to do as per contract. I gave him the full amount cause he was refusing to get the work done till he didn't have the money in hand and only wanted cash no cheques of any type due to his business account not being set up due to being the beginning of the season.Product_Or_Service: Concrete work for new houseDesired SettlementI want the money that I spent on getting the job done by another contractor back from him due to the fact I had to pay twice the amount of money to get a job done that was supposed to be done by him.

Complaint. I contacted the "owner" of this "company" for concrete work to my new house and nothing was ever done. Took our deposit[redacted]I contacted [redacted] under the "company" name Performance First Concrete from an ad on [redacted]. He dealt with my wife since I was away working. He came by the house and my wife told him what we needed to get done, walkways from the sidewalk to the house and up the side of the house as well as a patio in the backyard. We had been previously quoted from an actual company so Performance first was basically matching it with the expectation that they were going to be able to start the work immediately. I spoke with [redacted] over the phone on a couple occasions and everything seemed normal. He requested we pay him a deposit [redacted]. We provided him with a draft from his request of $3150. After we gave him the money everything fell apart after that. He kept delaying saying that he would start work the next day and the next day. [redacted]. Then he said his bobcat had hydraulic problems but from what I found out after he doesn't even have a cat. [redacted]. [redacted] its been over a month since he said he was going to start and nothing has been done. I asked for my money back s[redacted]. He said that he would give me a refund minus the base dirt that he had delivered, minus the hours he had put in and he claims he had a survey done of the property for over $1700. I told him to show me receipts and bills but has never been able to come up with anything. [redacted] Desired SettlementI want my deposit back of $3150.
