We accept Perry Pool's response that he will the have the entire pool replastered and we will pay a maximum of $for our part. The plaster will need to be the same plaster that they just put in the hot tub Perry will also be responsible for the professional startup of the pool when it is finished.
This work will need to be completed by the end of June

After returning from *** addressing health issues with my critically ill mother, I sat down with my plaster contractor and reviewed Ms*** complaint. I ***ly disagree with Ms*** assessment, but my reputation is even ***er than this disagreement How do you argue with experts in our field, especially with leak detection? The picture Mrs*** attached shows the cracks repaired and weeping, however gunite is porous. It is the plaster that had not been done yet when the pictures were taken that actually seals the crack. It's sad when you provide an article out of our own Houston Chronicle that articulates the ramifications of ground movement and people still want to deny the facts. The solution is simply this, we go in and readdress the cracks in the pool or my plaster contractor will replaster the pool at a cost of $2.900.00. Perry Pools is willing to pay half of the expense of $1,

After reviewing Mrs. [redacted] complaint, it is obvious that Perry Pools has responded in past years.  After conferring with the plaster company and a reputable leak detection service it was determined that their pool cracks were not due to poor quality in material and workmanship, but solely...

due to ground movement.  The integrity of the gunite shell was found to be water tight through the leak detection process.I was informed that the pool would continue to move and that it would be wise to let the pool finish moving.  Mrs. [redacted] expressed that the cracks did get worse, as we suspected, and it was in March of this year that we felt comfortable enough to now address the cracks.With that being said, it specifically says in the contract that plaster is not warranted against discoloration, staining, chipping or cracking.  We already knew why the cracks occurred.  Please see attached article out of The Houston Chronicle, talking about exactly what we are dealing with.Now, as a reputable pool builder, and because of Mrs. [redacted] patience, Perry Pools paid for cracks to be repaired and for her spa to be resurfaced.  Mrs. [redacted] was informed by Perry Pools that the cracks in the pool would look like patches and she said she was aware of that.  These will continually fade in over time.  The plaster superintendent looked at the patches after the fact and said short of re plastering the pool, that is what patches look like.
