I was hired by my client, the homebuilder, to evaluate scale accumulation in the sump pit at Mr [redacted] ' home My conclusions were based on elementary testing on the sample obtained, conversations with other geotechnical engineers in the area, evaluation of the adjacent residence (which has similar construction and groundwater conditions) and evaluation of aggregate from the same supplier being used in a home currently under construction I'm not certain to which code of ethics Mr [redacted] is referring The NSPE code of ethics does state that engineers shall "Act for each employer or client as faithful agents or trustees."I requested permission to communicate with Mr [redacted] before I responded to his first email I did not inform him that I had done that Given the nature and specifics of this situation, discussing this with the homeowner without permission from my client would be unprofessional and unethical.I can have any necessary testing performed to determine exact chemical maof the precipitate if my client is willing to pay me to do that Mr [redacted] can also hire someone to perform this testing I feel it would be a conflict of interest for me to work for Mr [redacted] at this time

I was hired by my client, the builder of the house where Mr*** resides, to provide geotechnical engineering services for construction of a new single family residence. I was later asked by my client to evaluate a scale accumulation that was occurring in the sump pit of this
houseMr*** did not hire me and is not my client. Any correspondence I have had with Mr*** has been out of professional courtesy and to assist my client. I did not, and would not, correspond with Mr*** unless my client gave me permission to do so. Actual chemical composition of the scale is not relevant and, therefore, My client was not willing to spend the money necessary to determine actual chemical composition of the scale. Mr*** may have a complaint against the builder of his home. He did not hire me and I have not caused any damage to his home. I do not see where he has any grounds for a complaint against me

I am rejecting this response because:he is now lying and hiding behind his client who emailed me saying that he was told that the sample had been sent out for testingThat he requested permission to speak with me and was granted that permission suggests that he did not then continue communicating to finish the jobThe builder will be paying for someone to resolve this, but as **'s ethics are beyond a doubt compromised, he is right that he is not the right person to do this
