The pitbull mix puppy referred to here was examined by our veterinarian at Pet Medical Center on 1/16/prior to my purchasing it and found to be healthyThere was no evidence indicating of a fractureThe puppy was purchased from us on 1/22/and taken by the new owners to their veterinarian
on 1/21/for a post purchase examAgain the puppy was found to be healthy and except for a slightly enlarged lymph nodeThe owner contacted my assistant manager first then myself about it and we both told her that if it hadn't improved when rechecked to contact us and our veterinarian would examine the dogThe recheck was scheduled for weeks on Feb 16,According to paperwork provided to me this appointment was missedAlthough the owner states it was being "closely monitored on future visits to access" there is no evidence that the dog was rechecked at all and the owner made no further contact with me regarding itShe only contacted me after the puppy fell and broke its legthis happened weeks and days after purchasethe emergency vet paperwork states " presented for lameness after falling from 3-feetThe puppy was examined by my vet and owners vet early on and both times it checked out okayMy veterinarian has reviewed all the paperwork and xrays and says a lymph node had no relation to the fracture he also states that without a history report on the leg the fracture cannot be accurately datedThe puppy had been with the new owners for weeks and days already when the fall resulting in the broken leg occurredOur guarantee cleary states that it does not cover traumaI still offered her a refund on the price of the dog on March 2,which she declined

I am rejecting this response because:
The appointment with Banfield for recheck was not missed. They actually offered me a sooner appointment at another location because it was difficult getting him in to our local veterinarian due to one doctor being present. On another note the lymph node diagnosis was a probable diagnosis and not for sure that was why he was being monitored by the vet. They stated at the time there was no need for an xray because he was not whining in pain. If you do look at the xrays it has all the proof you need that this fracture was historical as noted in both reports from two other vets and was an existing fracture that dates back to before we got him. The fall was approximated at three feet but from couch height which the surgeon and expert says would not have caused that type of injury and it was due to the pre existing break of the femur bone before hand. He also states is was a matter of time before it was going to be injured due to the previous break and couls have also happened while running. If pet shop owner will not cover full costs we will also accept have of the surgery bill just to help cover the medical expenses. If not we will seek legal representation to go to court for the full amount.
