Rebuttal to Contract Dispute RE: [redacted] - ID [redacted] In November I met with [redacted] because she wanted me to manage a house that she bought and wanted to flipI am a painting contractor that has been in business for over yearsI have a little knowledge in renovation and [redacted] was aware of thatThe reason she was interested in working with me was because of my contact with other contractorsIn regards to the $9,000, that money was not for meThe $9,was for the leveling of the houseShe hired me to only manage the project by paying me $every time I was at the job siteAs for completing the job within a timely manner, some factors came into playDuring that time period, it was raining and the house had a bad drainage problemThe water would drain under the house causing the ground to be very wet, which made it difficult to work on the levelingThe house was in bad shape because it was an “as-is” purchaseIt took over beams to level the home [redacted] wanted the home finished in days, and I told her that I would try to meet that deadline [redacted] asked me if she could use my guys to work on the inside of her houseI agreed as long as she paid my guys by the hourSo we demo’d the inside by taking off the panelingThen we placed sheetrock on wallsHere’s where another factor came into play with the completion of the job in a timely mannerIt was [redacted] ’s indecisivenessShe went back and forth on several thingsFirst, she told me NOT to put sheetrock on ceilingThen she told me to go ahead and put sheetrock on ceiling, then she told me NOT to put sheetrock on ceilingOnce sheetrock was on walls, she wanted for my guys to put in buishelves in wallWe also hired a crew to do work in the bathroomThey removed the panel tile in shower areaIt took [redacted] some time to purchase tile for the shower area after the removal of the panel tile in the shower area, so there was a delay thereShe hired me to make the decisions, when in the end, she was the one making all the changes and the decisionsShe could not make up her mind on the bathroom flooring whether she wanted tile flooring or to just keep the wood floor that was already thereShe continued to remind me that she wanted the job to be completed quicklyI told her it was difficult to finish when she was changing her mind all the timeAnother example of her indecisiveness was with the water heaterShe couldn’t make up her mind where she wanted the water heater that it ended up being moved three (3) different daysThe kitchen floor had vinyl, so we demo’d itShe liked the wood floor underneathThen she changed her mind and wanted tile floorFor the kitchen cabinets, she wanted to replace them at first and already had someone from Home Depot give her a quoteSo she decided to go with Home Depot cabinets, but then changed her mind and asked me to paint themThe cabinets never got painted because she told me that she had run out of funds for the projectShe continued to have meetings with me and the other crew about adding things and/or changing things aroundI should have learned my lesson from the first job I ever did for her [redacted] had her brother manage the work that she had me doing on her own house on Bailey StreetThey wanted me to paint the inside of the home and I gave them a priceThey paid me half for the work for what I had already done and then told me that they would call me back to finish the workThey never called me back and were in breach of contractIn regards to not responding to [redacted] ’s calls, texts and such, I would answer my phone when I couldHowever, she sometimes would call late at night and those calls I would not answerShe also would call one of my guys to let him know when she had paid meShe was discussing business matters with my employeesOn another note, I asked that she get a permit for the leveling of the houseShe did not get one because she did not want toShe also included an A/C unit without a permitFinally, in regards to me coming back to fix the cracks, I felt that I fulfilled my obligation because I was still working on the leveling job and I was not getting compensated for that any longerShe ran out of funds and could not pay me $per day any more so that is why I have not returned to fix the cracksIt was difficult to work for [redacted] due to her indecisiveness and not to mention the pressure to finish the job quickly which was difficult to do due to rain and bad drainage of the house that took placeI still managed to get the leveling of the house completed but was never compensated in fullShe would ask me for the hours that the guys worked and then she would give me the amount for their hoursThen I would pay each one for the total hours they worked each weekTherefore, all the guys on the job were paid in fullAll the material needed for the project was paid by herI feel that I fulfilled my obligations to the project under these difficult circumstances

Complaint *** The reason that the mess was still there was because *** told me that she did NOT have any more funds to put into the project and told us that she did NOT need us anymore Regarding the sink and water heater installation, *** would always inspect work before paying the menTherefore, when the sink and water heater installation was complete, she inspected it and then paid for the completion of the work Sent from my iPhone

I am rejecting this response because: This has left me with a messEverything his workers touched needed to be redone from the bathroom sink to adding a vent to the water heater to the crappy leveling jobHe was paid extremely well for everything he done and has now left me a house full of cracks which he refuses to fixHe is a man with little to no integrity and should not be allowed to do business in San AntonioI can now clearly see why his life has played out the way it has
