Peter D. Grubea Attorneys at Law Reviews (1)

When the client filed his bankruptcy petition, he did not indicate ownership of any land. Therefore, there was no need to file any type of lien avoidance motion relative to the judgment the client had against him. Judgments are discharged like any other debts in a bankruptcy case. If the client had...

already transferred the land before the judgment was entered, the judgment could not have become a lien against that land. If the land was transferred after the judgment was entered but prior to the bankruptcy filing, the bankruptcy could not have been used to avoid the judgment lien anyway. Section 522 of the Bankruptcy Code allows only judgments against land that the client owns on the date of the bankruptcy filing as his home to be removed. Obviously, that did not apply here.  The client is asking for something that is neither needed or permissible under the Law. Nothing needs to be done to address the complaint as there is no actual problem other than the one imagined by the client.  We intend no action.  Peter G[redacted]
