The hammer I purchased was delivered in April 2019. I made a deposit of $3187.50 on the hammer to take delivery on 4/18/2019. The Hammer I purchased was a 'refurbished/Rebuilt hammer'. Upon delivery, I attached the hammer to my machine, and began using it. The hammer almost immediately stopped working. Its was operational maybe 5 minutes before it seized up and was completely inoperable.

We contacted *** and informed him of the situation. He immediately insisted this was at fault of our machine, but agreed to come take the hammer and see what the problem was. *** picked the hammer up a few days later, and returned it back to us some time after that- still claiming our machine was at fault. Upon reinstallation, the hammer failed to operate in almost the same amount to time as the first attempt. *** was contacted and he picked up the hammer again.

*** again claimed this was at fault of my machine, and claims the machine had faulty hydraulic lines. However, *** did not perform any testing of the lines, flow testing or hydraulic tests to confirm his claims. agreed to come and 'fix? the problem with my machine. *** arrived a few days later with a helper and removed a fair amount of hydraulic components 'cleaned? them, and reinstalled on my machine. During this process, he also failed to reassemble all pieces correctly, lost critical nuts and bolts, and left myself to deal with correctly reassembling and replacing lost components.

*** shortly thereafter delivered a completely different hammer than we initially received. The hammer operated for roughly 4 hours before it again, stopped working. We removed the hammer, and purchased a brand-new hammer from GORILLA hammers at a much higher price. This company is a professional hydraulic company who before selling me a hammer, and attaching it to my machine, did all the necessary testing of the machine, all proper hydraulic testing, flow testing and pressure testing and machine calibration to ensure proper operation with the machine. This new hammer has been now operating flawlessly since May. Post testing, I was also ensured by GORILLA that my machine was completely capable of accepting a hammer, and that by all accounts if 3 consecutive 'rebuilt? hammers failed on my machines, it was a problem with the product and not the machine.

I was repeatedly assured by *** that in the event the hammer was returned I would be refunded, under the assumption the hammer was at fault. Eventually, the hammer picked up by *** and I explicitly asked him if I could be refunded. He again stated this would not be a problem.

There was no return or refund policy on the initial invoice *** sent me (attached). There is no return or refund policy on their website https://pad.rocks/. *** has never provided any documentation, pictures, or proof that our machine was at fault, additionally, provided no pictures, no evidence, no description of what the problems where, how there were resolved, and never provided a single piece of evidence whatsoever that my machine was the cause of 3 consecutive hammer failures.

After taking the 3rd hammer back, *** when completely silent.

After a few months of no contact and no refund, I began reaching out to *** directly. I began calling and texting in December 2019, with zero response after multiple attempts to contact. I even went as far as to attempt to negotiate the refund amount- with no response. Those txt messages are listed below.

At the end of the day I attempted to purchase equipment from what I thought was a reputable business, they took my money, assured a refund if their product was defective, and disappeared with my money and a product. I was left with nothing.

Desired Outcome

Refund I would like some professionalism from the company and the owner. Most importantly, i would like a refund. if a refund will not be provided, a written description why, and comprehensive evidence why the refund is being denied.
