[redacted] did not notify our company of any problems with the unit he purchased until after he filed a complaint with the Revdex.com.  We sold [redacted] a rebuilt transmission only for $750.00.  We did not install...

the unit in his vehicle.  He either did this work himself, or paid another person to do it.  There are technical steps that need to be taken in order to ensure that the transmission works once it is installed in the vehicle.   Although we are not liable for poor installation,  we did explain to [redacted] that we would gladly look at the whole vehicle to determine what was failing and fix it if it was related to the transmission.  We offered this at no cost to him.  He said that he would need to make arrangements to get the vehicle to our shop and would call back later. We spoke with him at 8:17 am on February 23, 2015.  This was prior to our knowledge of a formal complaint being filed with the Revdex.com.  We have since attempted to contact [redacted] and have gotten no answer. We are simply waiting to hear from [redacted] so that we can address the trouble he is having with the vehicle.   I have attached the original invoice with this complaint.  A "bench" unit was purchased.  This means that [redacted] brought his removed transmission to us and exchanged it for a rebuilt unit and took it home to install it into his vehicle.   We are currently waiting to hear from [redacted] regarding his vehicle.  We are more than willing to help him with his transmission problems.  [redacted] 

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait until for the business to perform this action and, if it does, will consider this complaint resolved.

Review: I contracted with [redacted] to replace my transmission with a remanufactured transmission. He in turn had Petes Transmission provide the transmission. My vehicle was towed to a shop at 430 E 10th Ave Mesa Az on 06/18/2013. This is where the original work was performed. My truck was at this location twice between 06/18/2013 and 09/15/2013. Approximately four months total. The first time I got it back from repair was in August and it was not at all correct. When trying to start vehicle there was a very loud gear grinding sound. The transmission slammed into gears when shifting. I called [redacted] immediately to complain and I was told the starter was bad and I should replace it. Although it never made this noise in the previous 12 years he insisted it was the starter. I paid $200.00 for a new starter and installed it. During this install I saw the transmission pan was leaking oil. I immediately called [redacted] to tell him it wasn't the starter and that it was leaking oil. he said he would pick it up and look at it. About two weeks later he showed up and took my truck. Two weeks later he brought it back and said it was fixed. I was working field service at this time and did not get back to the shop until after [redacted] had left. I was told [redacted] replace the flywheel a second time and repaired the leak. When I tried to start the truck it had the same terrible gear grinding sound and it still was not shifting correctly. I again called [redacted] several times over a couple weeks and got no reply. Finally, in complete frustration I called again a week later and since he didn't answer I left a message asking for the transmission shops contact info as I felt I was being given no recourse other than turning to the courts. [redacted] did finally call and told me the transmission shop wanted to see my truck for inspection. [redacted] picked my truck up a few days later. After about two weeks of not hearing anything I called [redacted] to see how it was going. He said he didn't know. I ask what did he mean. He said he dropped it off at Petes Transmission so they could look at it. A week later I called again since it had been about a week and a half to tell [redacted] I really needed my truck back soon as I was borrowing a company vehicle all this time and that was wearing thin. The truck came back on 10/22/2013 from Petes. I got back from the field expecting all to be resolved now counting on the transmission shop to fix it correctly. I was told by my boss that [redacted] left the phone number to the transmission shop and if I had questions I should call them. I went out to start my truck and the grinding noise was worse than ever. It was scary. I immediately called the number (602-257-4447) and a woman answered. I let her know who I was and that my vehicle which they just worked on was not correct at all. She told me that they had put a lot of money into the transmission and in fact while they had it they installed another flywheel and a new starter. I told her I had just put a new starter in it a few weeks earlier. She told me it and the flywheel were damaged so they had to replace them. I asked for my starter back and she said they used it for the core charge so it was gone. I told her about the gear grinding noise and the shifting problems. She said she was aware that it made some noise but they couldn't do anything about that and in fact I was given the impression they wouldn't do anything further. I went out to my truck and looked under it just to see if it was a different starter than the new one I had installed and it was. I was petrified. the starter was not the correct one and in fact the solenoid was so large that the positive cable from my battery to the starter was about an eight in from the motor oil filter. I couldn't afford to wait for a tow truck so I carefully drove it to Berge Ford knowing that if that positive lead shorted to the oil filter my truck would have gone up in flames. While with the service writer at ford another lane guy went to move my truck into the back for work. When he tried to start it EVERYONE looked out to see what was going on. The service writer look at me and said he couldn't believe anyone would give it back that way and say it was fixed. He said it sounded like they put the wrong parts in it. I warned him about the starter and to be careful. By this time there was another noise coming from my truck and I thought it was an exhaust leak. Ford would check it all but because it was a re inspection of some other shops work I would have to pay more. I had no choice, it was dangerous to drive. Ford called the next day with a quote for repair and they said Petes Transmission put in the wrong flywheel and starter. Ford also said that someone in an attempt to make it all work used a grinder on a metal spacer plate which made the transmission sit crooked at the engine. The plate had to be replaced too.. The repair cost $ 1144.55 and after they were done the truck started perfectly. The noise I had heard was not an exhaust leak it was the transmission or torque converter. The shifting problems required more inspection to wit they would have to remove the transmission and disassemble it. The following is a partial quote from the Ford receipt. "3) Remove trans and replace flexplate with Ford correct flexplate if currently not a Ford part. Install a Ford correct starter. 4) trans should be removed and verify correct assembly and inspect for cause of Harsh shifts, noise from torque conv, fluid leak in bell housing, inspect and verify correct valve body and good EPC solenoid is installed." I was told this would cost an additional $1500.00 to $4500.00. They said it would be cheaper and safer to let them install a re-manufactured transmission. I was out a lot of money and back to square one.Desired Settlement: I want a full refund from [redacted] and Petes Transmission including what I paid Ford to fix what they said they couldn't. Since my truck could have gone up in flames and by the way me and my kids or whom ever was with me at the time., I do not want them to work on my truck anymore. I will have Ford fix the rest. [redacted] told me on 10/31/2013 on the phone he would reimburse me $2,128.47 but this did not include what I paid Ford to fix it correctly nor does it cover the starter I bought which was not needed in the first place. Petes transmission was not willing to cover the Ford bill although they had the truck last and put the wrong parts in it. What I want is as follows.

I don't care how they work it out, I want the combined total of $ 3,473.02 in cash. When I have the cash I will have Ford make the repairs and give to [redacted] the following parts: transmission, torque convertor, Flexplate (flywheel), metal separator plate. The starter went for a core as mine did. It was torn up and not usable so it wont be returned.

We are truly sorry to hear about the troubles with your vehicle. As you stated in your complaint, the original shop that worked on your vehicle purchased the transmission from us.

We will honor our warranty by refunding the price of the transmission to them. We have contacted [redacted]'s shop and discussed this with them also. Understand that the unit was sold to their shop as a wholesale unit and

we do not have control over the installation of our unit or the other repairs that they performed on your vehicle. However, we understand that you have had a large amount of trouble with the situation already. We hope that this matter is resolved quickly for you.

We have already processed the refund to [redacted]'s shop for your unit.

The offer is the same offer I was given a couple weeks ago by [redacted], however I never received the $2128.47 as he said he would give me. I was suppose to receive it on Tuesday November 5th. He told me he would give the cash to me via a phone call on October 31, 2013. However, this does not include the cash I am out which was paid to [redacted] to repair damage cause by Petes Transmission by installing the wrong parts. Petes letter does not state it but they were the last technicians to remove the transmission and make repairs. When I got it back from Petes shop it was in worse shape than before and as explained in the original complaint letter I called them and was told they had spent a lot of money trying to fix it but either couldn't or wouldn't be able to do any more for me. I took it to Ford, they put in the correct parts and that area of work has been flawless since. This still left me with the defective transmission. I paid Berge Ford $1,148.55 cash for this and I need to be made whole and for that to happen I need reimbursed this amount also. I came here in an attempt to avoid getting my attorney involved any further but it doesn't appear that is going to happen. It's a shame that on top of this additional required amount I must go through the continued aggravation with this matter. It seems to me the addition of attorney fees don't make sense but that appears to be out of my hands. Thank you for your time, Henry
