I stand by what I sent in previously in regards to [redacted] ***'s statements As we cannot reach a mutual agreement, I am moving forward and starting the small claims court process in regards to this account

** *** ** *** when he was minfrom my house, minbefore I had told him I needed to leave for workI was never confrontational. I was anxious about leaving and amazed at his lack of notice, i.e., he was coming in min. At no time did I state day the work needed to be done. Phillips started yelling at meI had prefaced my comment with "I know you don't guarantee the health of transplant ."Phillips yelled I was supposed to water the plant times the next day. Another indication of his lack of knowledge of plants . This is his mode of bullying: Arrive with very little time for the customer, start yelling, say everything is their fault and refuse to make anything right.I previously hired Phillips other times and never complained. I am years oldThis is how he treats previous customers who are seniors. I will pay $800+ I sent a check weeks ago for mowing. *** ***

On July 24, I sent my crew to *** ***'s home to weed whip and expose all existing plants located in current planting beds and expose all commercial mow edging. Then we purchased, delivered and installed bark to all planting beds. We then trimmed and pruned shrubs and transplanted
several plants. All work was based on time and material as agreed upon during the original walk through On August 9, I went to ***'s house to discuss with her work that needed to be completed that she said was not done on July 24. As soon as *** answered the door, she was extremely confrontational. I started to walk the property with her and try to take care of her and her needs and took notes of what she wanted us to do or redo (quite a bit of which was not originally discussed or planned on the first walk through). She was belittling me and my company for not doing what she asked and I told her that the things she was asking me for were not on the original list. She got into my face and raised her voice and said "yes it was, you just didn't take good notes". Her perception of what she wanted done was very different from what my perception of what she wanted done based on our original meeting. She told me multiple times that I should not be in business as a landscaper and that I did not know what I was doing, but still wanted me to come back and do the work. I told her we could but she would need to be there to make sure what she wanted done was actually done. I really wanted her to be there so my crew could ask questions if necessary to get her project done the way she wanted it done. She told me that my crew needed to be there the next Monday. She was being very belligerent and getting in my face. At this time I decided we would not be back to do any further workI felt I could not continue to subject my crew or myself to this type of work atmosphere and I knew she would treat my crew like she was treating me and I wanted to protect them from it. She told me I was a *** and told me to go to hell. At no time during this meeting did I raise my voice or "cuss" at her because I am a professional business person and I don't believe this type of behavior would keep me in business. I know there was someone in the garage but they never came out to us during the time I was there. They did witness her calling me names and telling me to go to hell because they were right inside the door and I could see them. I told her "thank you, I will send you the invoice for the material and work completed" and I left (yes, I did say thank you). I have tried to contact her several times to discuss this matter and she has refused to contact me back. This is the first communication I have had since she cancelled our company for mowing which I had cancelled on August right after this meeting. Our invoice for the landscaping is $1,373.60. She also has an unpaid invoice for mowing in the amount of $67.24.We have looked over the landscaping invoice and based on work and materials used feel she should pay all of it, as it only covers the work done on July and we didn't go back for the other work she wanted, however, we are willing to work with her. $is too much of a discount because she would have had to pay us the labor to finish it anyway to meet her perception and the job was all based on time and materials. Since we are never going to agree on perception, we are willing to reduce the landscaping invoice, instead of going to small claims court and suing for the full amount due, to $and also need to have her pay the mowing invoice of $for a total due of $1067.24. This would make both parties even
