Engaged contractor to build foundation. Prepaid $27,000 and additional $9000. Contractor made multiple, repeated mistakes. Refuses to return part of $Engaged contractor to pour footings, grade, and build foundation for two houses to be moved to site. Pre-paid $27,000 followed by an additional $9000. Poured footings incorrectly (wrong location, not deep or wide enough) incurring delay and additional cost to repour. Did not follow instructions on grading or tree removal. After repeated problems, fired from job. New contractor found additional problems with footings requiring new digging, support of house and re-pour. Seeking return of funds paid to first contractor sufficient to cover additional costs = $6300. However, we did have issues with footings with at that time. He had them re-surveyed and one of his guys supervised the correction and okayed them later down the road. I get a phone call stating that footings are still not correct which I spent $4,800.00 of my own money correcting footings. Now, he's saying footings are off to the inside when we meet onsite. I noticed that the house didn't match the plans that were in the box. He just demanded money instead of coming up with a solution or a reasonable amount which brings us to were we are...Consumer Response Mr. [redacted] did not spend $4800 of his own money correcting footings, as I prepaid him $35,000 towards a job that he did not complete. As he stated in his email to me after I fired him from the job "sorry for all the mishaps, I don't want to delay the project any further."After a series of initial errors by Mr. [redacted] pouring the footings, I did have my General Contractor supervise Mr. [redacted]'s correction of the footings to try to ensure that he did not make more gross errors in correction. The GC did this as a favor to me and was not compensated, and Mr. [redacted] did not work for the GC - Mr. [redacted]'s contract was with me. Thus responsibility for this lies with Mr. [redacted].When we subsequently went to drill the footings for rebar, we found that Mr. [redacted] had not poured the footings to the correct thickness, either intentionally to save money or unintentionally. At that point I fired Mr. [redacted].I've spent $6200 in repairing footings that were poured incorrectly. This does not come close to compensating me for the roughly $46,000 in additional costs I've incurred due to additional delays and having to hire a new contractor mid-job, directly caused by Mr. [redacted]'s errors.When we met onsite, and I thought Mr. [redacted] would be reasonable regarding my additional costs to correct the footings, but he proceeded to blame 1) the surveyor, who he said must have pinned it wrong, 2) the engineer, 3) the GC, who he said should have found the error, 4) the drawings, which he misread - and regardless, given that the surveyor had pinned the house on the site from actual survey dimensions, if there was any discrepancy between the survey pins and the drawing (there isn't) , he should have pointed that out prior to pour.He moved from one excuse to another, while never taking responsibility for any error, which he said was "impossible" for him to have done wrong, despite the fact that he had already made numerous and repeated errors on the job. I feel I am being very, very reasonable in seeking only the costs to fix the messed up footings at this point - $6200 - and not the total costs to me from all of the mistakes Mr. [redacted] made on the job, or the return of my entire $35,000. Final Business Response It seems at this point that it is back and forth. So, until there is reasonable mid-ground that we both can agree to reach and compensate there is no reason to go back and forth with this complaint. There is no reason not to assume personal responsibility as I have accepted up to a point. When the survey guy came the 2nd time we did exactly what was asked and personal money was spent to correct the said mistakes per engineer and the over seer. The project was assigned and confirmed everything was completed as reequested, however I was still terminated... When I was called to the sight for the last time Once I got on sight I discovered that one of the houses on sight did not match the plans that were in the permit box. Therefore, changing outside projection that we felled to meet which at that point becoming a issue with inside projection after spending an additional $4,600.00 tryig to meet outside projection (I still have those plans that do not match the house on sight).
