Customer stated gasoline and oil had leaked from his own lawn tractor and “contaminated” the coal delivered almost 3 months earlier. At this time we made arrangements to deliver 2 tons of coal ASAP so the customer had heat. The coal was delivered 2/4/13 along with a bill and monthly statements were mailed the first of every month thereafter. Twice over the summer of 2013 I spoke with the customer about the past due bill and was assured it would be paid at the end of each month. After no response, the account was forwarded to our attorney on 11/14/13. There was no response to any letters from our attorney. The account has now been forwarded to a collection agency which has prompted the complaint. We use a state certified scale to weigh all deliveries by a licensed weigh master.Please find attached a copy of the weigh slip and the letter sent from our attorney. The desired outcome at this point would to be paid for the delivery made 2/4/13, for the original amount of 424.00.Gary SVice President Phillips Fuel Inc

Review: We purchased coal from Phillips Fuel several times, each time handing the delivery person cash and paid in full. We received a shipment of coal that was short of the two tons we ordered. Not only was there not enough coal, but the coal we received was full of debris. On several occasions we had to empty out our coal stove because the house filled with smoke and a terrible toxic odor. Once we shoveled the coal outside we found nuts and bolts, parts of chain, whole chain links put together and other metal pieces. We contacted the company and were told that the coal would be replaced. We expressed that we wanted to return the already paid for defective and contaminated coal and get coal that was not a health and fire hazard to our family. We received replacement coal. Months later we started receiving a bill for the replaced coal. I called several times to let them know that this was an error and remind them of the previous incidents with the defective coal and that they were billing us for what they replaced. The defective coal was paid in full 100% with cash. We are wrongly being charged. In addition, the company has contacted a debt collector American Profit Recovery who keeps calling my home and are nasty.Desired Settlement: The bill for the exchanged coal should be nullified. We already had a verbal agreement to replace the defective coal and should not be billed twice.
