Assessments are due on the first of the month and as a courtesy the homeowners are allowed a grace period of 15 days, at which time a $25.00 late fee will assess to the owners account. Section 12.14 of the Governing Documents state that “…each Assessment, including interest, late charges…in the...

event of delinquency, shall be the joint and several personal debt and obligation of the fee owner or owners and the contract purchasers of Apartments for which they are assessed as of shall be the joint and severable personal debt and obligation of the fee owner or owners and contract purchasers of Apartments for which they are assessed as of the time the Assessment is made…” Section 12.15 of the Governing documents state that “…the late fee on delinquent Assessments shall be Twenty-Five Dollars ($25.00) which shall added to any account which is not paid in full on the fifteenth (15th ) day of each month…” Mr [redacted]’s account was assessed a late charge in November 2016 because his payment posted on 11/18/16. Mr [redacted] was sent a delinquency notice 11/27/16. Mr [redacted]’s account was assessed a late charge in January 2017 because his payment posted on 1/19/17. Mr [redacted] was sent a delinquency notice 1/17/17.  Mr [redacted]’s account was assessed a late charge in February 2017 because his payment posted on 2/17/17. Mr [redacted] was sent a delinquency notice 2/17/17.  Mr [redacted] was sent a delinquency notice 3/17/17 noting the account was past due.  Mr [redacted]’s account was assessed a late charge in April 2017 because his payment posted on 4/17/17. Mr [redacted] was sent a delinquency notice 4/18/17.  Mr [redacted]’s account was assessed a late charge June 2017 for the balance carried forward and was sent a delinquency notice 6/16/17. We have applied all late charges in accordance with the Governing Documents of the Association and have provided Mr. [redacted] with ample notification of the charges to his account.  The appropriate recourse for waiver of late fees is for a homeowner to submit a written request to the HOA Board of Directors for consideration.  To date, such a request has not been received.  We have forwarded Mr. [redacted]’s request to the HOA Board for consideration.
