Review: Last year I signed a contract for a new awning with Phoenix Awning Co. . I gave him a $900. deposit for it. The contractor installed the new awning. The building inspector in [redacted] advised me that the awning must be removed because it did not meet code requirements and also no building permit was given. Code required a fire resistant fabric. The contractor showed me samples of fire resistant fabric and I selected one. The building inspector also advised that the wood under the awning might need repair. So, I looked for someone to fix that, and to do other improvements for the building front since the awning frame was removed. This past spring I asked [redacted] from Phoenix Awning to proceed with the installation. He then insisted that I first pay for the awning he removed. And he wanted me to pay additionally for a second awning and at a new price $580. higher. And he insisted I also pay $480. for storage of the removed awning. Note, the building inspector only wanted the new fabric removed, not the original metal frame.

So, questions: Is a contractor responsible for using materials which comply with code? Can he charge the customer again if he has to redo the job? Can he charge more than the original contract after he discovers he must used code materials? Can he charge for storage if he has not advised the customer beforehand? Also, who is responsible for obtaining a building permit?

[redacted] from Phoenix Awning seems like a nice guy who doesn't want to go to court. Am I right in my complaints? Or maybe is he justified in his billing?Desired Settlement: Please explain this to me and also to him before this case becomes more heated.

Yes we were contracted to “Re-Cover” existing awning frames at [redacted]. [redacted] PA in June of 2012. After installation we were contacted approximately one week later via mail from the borough of [redacted] stating that there was never a permit acquired and that fabric did not meet code, and that a fine would be assessed until proper steps were taken.

We immediately contacted **. [redacted] and informed him of the fines to be assessed . We then went ahead and removed said awnings [at no charge to **. [redacted]] as to not have him [**. [redacted]] charged for any violations while proper steps were being taken.

Phoenix Awning Co. never at any time mentioned or agreed to customer to acquire any permits and or licensing of said work to be done. After notifying **. [redacted] some time went by, We [Phoenix Awning Co.] took it upon ourselves and made numerous attempts via telephone to contact **. [redacted] and his daughter [[redacted]] whom he had told us would be handling the rest of this issue. Finally in Sept. 2012 we made contact with [redacted] and met up to drop off flame rdant fabric chooses that she was to look over and decide on. That was the last contact we had with either **. [redacted] or his daughter [[redacted]]. *[attached you will find an email that was sent to **. [redacted] back in Sept. 2012 trying to resolve this matter].

As you can see this email was never responded back to until almost one[1] year later. Phoenix Awning Co. has held on and stored said awnings in our shop in good faith that **. [redacted] would honor any outstanding debts and or balances.

As for The added charge of $580.00 There is an up charge for [Flame rdant fabric]. This job requires 27 yrds of flame rdant fabric,which at COST is more then said amount.

Lastly, To address this issue of taking the frames down. In order to “Re-Cover” a job of this scope it requires the frames be brought into ensure a proper fit of fabric to frame. We are a small family run business and we try to treat our customers as such. We treat our customers the way we would want to be treated.Which is why trying to resolve this matter and satisfying our customers which in this case is **. [redacted] is our ultimate goal!

No, I haven't forgotten about our awning you are storing for me. I was planning to have you install it this spring, but I then figured we should fix up and paint the front of our building before re installing it.

So. I finally found a painter. His work should be complete in a few weeks, and I'd like for you to save a spot in your installations to do my job around the beginning of August.

Either I, or my daughter, [redacted], will contact you to confirm the completion of the paint job.
