Initial Business Response / [redacted] (1000, 5, 2015/06/18) */ Contact Name and Title: Matthew K [redacted] , Owner Contact Phone: XXX-XXX-XXXX Contact Email: ***@phoenixtax.us Before I respond, some background on me and my companyI have always tried to keep prices down and due to the business being only years old, it still isn't self-sustainingThus, I farm part-time and drive a box truck for a company and coach AAU basketball and am not in the office every day after April I do remember Mrs [redacted] leaving me a voicemailIt was during a basketball tournament and a time we were trying to get the rest of the soybeans plantedDue to the fact I had already listened to the message, it didn't show up as unheard, and, sadly I forgotWe had sent text messages between us previously as well and I did go back and see where I said I would get a phone number for herOn the front of tax return, we put a cover sheet detailing the results for the Federal and State returnsWe also put the website for Federal and State so clients can check the status of their refunds onlineI remember talking with Mrs [redacted] and mentioning I would look into why they hadn't gotten their refund and let her know the resultsI have been to the Indiana Department of Revenue office in South Bend several times and each time have checked on the return but have gotten no definite responseI should have contacted Mr& Mrs [redacted] to let them know an updateCurrently, what I have found is that the return never was received by the state of IndianaUpon learning this information, the return was immediately filed electronically with the stateIt has been rejected on two different occasions due to state withheld on the W-and Form 1099-R is not agreeing with the State of Indiana recordsI have been working to get this issue resolved so that the $refund can be released to Mr& Mrs***Am I embarrassed by this situation? Absolutely!! Let me explain why we find MrK [redacted] 's response unacceptableFirst and foremost, we still have not received any kind of update/response from MrK [redacted] other than the response to this complaintWe would still be completely clueless if we had not filed this complaintFurthermore, I finally found a phone number for the Indiana Department of Revenue and called to try to find out something for myselfI was told there is no record of our tax return and that the South Bend office has no record of MrK [redacted] ever inquiring about itThe gentleman I spoke with also told me the excuse MrK [redacted] gave for our return being "rejected" did not make sense because the Department of Revenue would accept the tax return whether or not the W2's matched what the state had on recordI was also told that we may be subject to fines or interest due to this not being filed on time which we believe should be MrK [redacted] 's responsibility to payWe also believe we are entitled to a refund for the amount we paid him for services he obviously neglected

5 years old, it still isn't self-sustaining. Thus, I farm part-time and drive a box truck for a company and coach AAU basketball and am not in the office every day after April 15. I do remember Mrs. [redacted] leaving me a voicemail. It was during a basketball tournament and a time we were trying to get the rest of the soybeans planted. Due to the fact I had already listened to the message, it didn't show up as unheard, and, sadly I forgot. We had sent text messages between us previously as well and I did go back and see where I said I would get a phone number for her. On the front of tax return, we put a cover sheet detailing the results for the Federal and State returns. We also put the website for Federal and State so clients can check the status of their refunds online. I remember talking with Mrs. [redacted] and mentioning I would look into why they hadn't gotten their refund and let her know the results. I have been to the Indiana Department of Revenue office in South Bend several times and each time have checked on the return but have gotten no definite response. I should have contacted Mr. & Mrs. [redacted] to let them know an update. Currently, what I have found is that the return never was received by the state of Indiana. Upon learning this information, the return was immediately filed electronically with the state. It has been rejected on two different occasions due to state withheld on the W-2 and Form 1099-R is not agreeing with the State of Indiana records. I have been working to get this issue resolved so that the $98 refund can be released to Mr. & Mrs. [redacted]. Am I embarrassed by this situation? Absolutely!! I strive to not have a return fall through the cracks and I am certainly not going to make excuses when, after research, I see I dropped the [redacted]. I am working to get this resolved in a timely manner and will contact Mr. & Mrs. [redacted] when I have the information on the timing of their refund.

Let me explain why we find Mr. K[redacted]'s response unacceptable. First and foremost, we still have not received any kind of update/response from Mr. K[redacted] other than the response to this complaint. We would still be completely clueless if we had not filed this complaint. Furthermore, I finally found a phone number for the Indiana Department of Revenue and called to try to find out something for myself. I was told there is no record of our tax return and that the South Bend office has no record of Mr. K[redacted] ever inquiring about it. The gentleman I spoke with also told me the excuse Mr. K[redacted] gave for our return being "rejected" did not make sense because the Department of Revenue would accept the tax return whether or not the W2's matched what the state had on record. I was also told that we may be subject to fines or interest due to this not being filed on time which we believe should be Mr. K[redacted]'s responsibility to pay. We also believe we are entitled to a refund for the amount we paid him for services he obviously neglected.
