[redacted] initially employed Phoenix in June of to represent his business, [redacted] [redacted] , in negotiations with the [redacted] for tax debt stemming from non-payment of employment and unemployment taxes This was a flat fee for representation of the business in negotiations for a payment plan with the *** Despite the fact that [redacted] continually had trouble understanding that compliance with legally required payments on current taxes was imperative to maintain any sort of resolution for his past tax debt, Phoenix negotiated and finalized a payment plan for the business(Copy of formalized agreement & [redacted] transcripts attached as definitive proof)While engaged in negotiations with the [redacted] on the business case, Phoenix discovered in Early that [redacted] had personal tax debt with the *** Out of courtesy, Phoenix negotiated a payment plan for his personal case, without charging the customary fee associated with that The payment plan negotiated required an increase in the amount due monthly Client failed to increase his monthly payments, and as such defaulted the payment plan for his personal case Again, out of courtesy, Phoenix renegotiated the payment plan for his personal case in April of 2017, without charging the client any additional fees (Copy of formalized agreement & subsequent default letter attached as definitive proof)The business failed to pay its unemployment taxes for when the return came due in January of This defaulted the payment plan that had been negotiated We discussed with [redacted] the fact that we had engaged in multiple negotiations for his personal case, without a fee, and that this new payment plan for the business was not something we would renegotiate for him without payment of an additional fee [redacted] insisted that Phoenix had not actually negotiated a payment plan for the business Notices from the [redacted] evidence the fact that this assertion by [redacted] was not true For the three years of representation on this case Phoenix has been paid a total of $2,000; we logged in over hours on this case No request for refund is warranted

I would like Phoenix Fimancial to pay the penaltys incurred during the plus years of inadequate representation and reimburse me for the fees I paidA little over $ Thank you

Once again this company is contradicting itself. They stated that they "protected" my company for several months but then reply that they can't protect us from such concerns. So if you protected us, what did you protect? For the last and final time, we started a relationship with this company before there was any penalties or issues. If this company was so in contact with our tax agent, how could they not know that a tact lean had been placed against us? I'm sure that would have been something the agent should have told them of they "working" on our case. This company was unaware of this and we had to advise because they did not do what they was paid to do. Any reasonable person know they can contact the IRS and set up a payment plan or the basics of such issues. They didn't not start and work on my case like it was stated when I contracted them, They only made effort when I complained several months later. This company is a fraud and I would like my entire refund back immediately. Please BBB advise me what have they done to take my $8000.00 dollars and have me in a worse situation than I was in before I Hired them? Any "reasonable" person can see that the work that was supposedly done on our case do not match the amount that was paid for services First lie and issue with this company I have is that they did not protect us from anything! We made contact and signed a contract with them before any tax issues or penalties was a concernSecondWe did in fact suffer a a tax lien against us on their watch which they knew nothing of itAny "reasonable" person can understand and see that they had no to very little contact with the IRS on our behalfIf they were in so contact with our tax agent, how could they not be informed about a tax lien that was placed against us? Anyone who know the IRS system know that once you receive a letter on whatever the issue is has already been in place for weeks if not monthsThey when we advise them about the tax lien, they reply with that's just a standard thing the IRS do and sent us a email on the definition of tax lienReally? So what did I pay you over five thousand dollars for? Not to mention the many time we couldn't make contact with them and the unprofessional staffThis company is a joke and a fraud and I want all of my money backI will up load all the correspondence after this reply Complaint: [redacted] I am rejecting this response because: Sincerely, [redacted] ***

We never told *** *** that we could protect him from a tax lienWe can protect businesses and individuals from IRS enforcement action such as bank levies, accounts receivable levies, wage garnishments and seizure for a reasonable period of time*** ***'s business was protected from all of this type of action while we represented himAgain if he was levied, it was done after our representation ceasedWhen we sign on as a Power of Attorney, copied on all correspondence sent to the client, including when the IRS files a lienOur notice will come a short period of time after the taxpayer gets it because we are further away from the Revenue Officer's office Any business that owes over $150,to the IRS should expect that the IRS is going to file a lienThere is nothing we or any other company or attorney can do about thisIf anyone is telling him otherwise, they are lying to himOur representative explained this to *** ***If *** *** doubts this, he can ask his Revenue Officer directly We do not tell people we can prevent a tax lien from being filed and it is not in our service agreementOur contact with *** ***'s business and the IRS was maintained throughout our representationI have already listed the dates of contact with his businessIt is my understanding that most contact was made with *** ***'s bookkeeper and that it was he who was difficult to get a hold ofPhone records corroborate this assertion There were no errors made in our representationClient and IRS contact was made and maintainedCompliance was obtained and deadlines were established and met until *** *** terminated servicesI am sorry if *** ***'s business was levied, but that was not done on our watchWe are willing to reassign his case to a different Enrolled Agent or Attorney
