From: < [redacted] >Date: Fri, Jun 5, at 1:PMSubject: Re: [redacted] Complaint ( [redacted] )To: [redacted] < [redacted] >To whom it concerns: [redacted] is one of three or so difficult people we have to deal with each and every year I have always resolved any issues I have ever had with integrity and the highest of ethical standards That is why if I you review my company you will observe we have never been sued, and when we go to court for those that are not reasonable we have never lost I have bent over backwards for this person financially, in support administratively, and through the physical use of my skilled laborers to get him out of a situation he was way in over his head We finally agreed to arbitration through the Revdex.com After calling the Revdex.com in April this is the first correspondence When I was called I walked in on young man that had thrown his back out and was limping through a very ambitious reconstruction of a step stair well that spans stories with new handrails and post As they were living in the house I was mortified to see they had installed the stairs without prefinishing them The problem this creates is availability How are you going to live in your house when you have to climb three stairwells to get to your main level? I was contacted after he could no longer perform any task due to time constraints and physical issues I had a very difficult time with them before and wanted nothing to do with him again Since we have done work for his dad, twin brother, Mom, uncle, and numerous jobs on referrals I felt obligated We negotiated a set price of $per day for my carpenter to come to his house and complete the steps When he finishes the steps they asked him to continue to do the floor in the kitchen he couldn’t do Then they ask him to make alterations to the dishwasher and cabinet in the kitchen as a result of the flooring installation Next they ask for the baseboards to be installed because of the change of flooring heights The issue this created was that he wasn't finishing the steps so the painters couldn’t come in and stain or paint After days of change orders that I didn’t mind because we had a prenegotiated price for the serviceThey never once called me to explain why they were off schedule for the steps I showed up to observe why things were not going according to plan After the day I anticipated the steps to be completed I arrived to find they had altered the work order significantly adding 400sqft of laminate flooring installation and ft of baseboard installation And of course the home owner who was to supply the material was short on both the underlayment and the flooring So we scheduled a Saturday work day to accommodate his shortage and then had to wait until 10am to get started because he couldn’t get the materials before then I gave him a price at cost to produce the job if he just got out of the way of When he couldn’t help himself and said he would get the laminate landings completed before the weekend to save some money on the carpentry so I could start the painting and staining it didn't get done If you’re surprised I’m not So I gave him an offer he couldn’t refuse, I said I will pay for the carpenter for the day! Who does that; a business man that understands the biggest problem he is dealing with is a customer that can’t afford the service and it’s costing me money It’s embarrassing to say to someone that you drive a big fancy [redacted] to look good going to work but live in a half of a townhouse and need to shop at lumber liquidators whose materials have been recalled because they were using Chinese manufacturing products that are known to cause cancer Thanks for that [redacted] we really appreciate you putting our health at risk so you can save a buck We sent numerous text and phone messages with a few phone calls to sure up details on the stain I asked speficially if he tested the stain and was happy with the color on the new steps He said yes the tried it on a spare piece in the garage I arrived the next day to see this was the case When you stain you only do it once not times trying to play Michelangelo The understanding is that the wood is different in color and will show different on each step that is more or less red, brown, white, or black Well they wanted each step to mirror the laminate so after we stained the steps and rails they wanted them exactly the same So they got more stain in different colors and had the painter there for days making each step exactly uniform When he got it done and they went to apply the poly the questions of color and surface uniformity came up and I addressed them and relayed the details We were refinishing them one at a time and getting confirmation and then finishing each the next day That process didn’t satisfy a timeframe I had no idea about Apparently they needed to impress someone for a bridal shower on the 4th So when I asked him about timing he said to take our time they want it done right I said well it’s not like I can put people on your stairs because they can’t get out I had another group of painters there to prepare the risers with caulk and putty and paint and stain the railings Thank God because when I got there they were instructed by the home owner to paint the baseboards throughout the main level go into the bathroom that was never discussed and apply coats of polyurethane on the steps If that’s not some underhanded unethical unlawful enrichment attempts to subrogate the contractor I don’t know what to tell you But wait there’s more, he also hired someone to finish the staining to fall into his schedule if we couldn’t perform the touchups they wanted the night I was there to discuss the problems If you think he doesn’t deserve some name calling for that you’re wrong The nicest thing I can say about [redacted] is that he is the worst person I have worked for When I decided to come to terms with him after he sought help else where he had $for me I spent $on materials that were shorted by him, days of carpentry work, hours for painters to finish the paint and for the stain on the steps He did reluctantly pay a deposit for $but that’s all we got He had no complaints for the carpentry but wouldn’t pay for it I told him about everything then he wanted $for a clock that he says was damaged and I never saw and doubt it’s worth I wrote him a discounted bill for everything he said he was unsatisfied with that discounted the bill down to $but leaving about $1300-balance so we can move on and he can have his house in order and forget the entire problem Not good enough to be reasonable, sensible, helpful and well thought [redacted] has to have his way so he calls Daddy who we do new construction painting for entire houses to complain and starts posting online everywhere he can think and offers me $ What a Jerk! I don’t have anymore time for this kid it's time for him to learn to handle his problems honorably I was set to sue him but since he can’t afford a lawyer his dad asked me to figure it out with him It really isn’t worth my time but I’m going to teach [redacted] just how unreasonable he is Also a mindelay on a picture that was sent to him He was having double text and delayed response from his phone on multiple occasions while we were there Not to mention they problably had stain on their hands and couldn’t get to there phone after cleaning up or throwing away a glove to get access to the phone to send you what you asked them for Just an example of how we were being deceitful? Really?? I guess it’s all about [redacted] all the time I gave time, materials, administrative assistance, financial support, and technical assistance in the successful completion of poorly conceived under funded ambitious project from a person who’s top priority is an image of success that he can’t maintain or support I’m sorry that you can’t come to terms with the fact that we helped you in ways you couldn’t help yourself but then you vilified me publicly after leaving me in a financial chiasm for your benefit Games are over, the grown up is in the room and you’re punishment is coming Reap it.Steven R***Phoenix Painting, LLC [redacted] **Bristow VA

If there was a problem with the rain then why is there no peeling of stain at all? The stain is not peeling anywhere The floor boards had chipped off in tooth pick sized bits on about boards The application and product selection was sublime The surface in question was below the customers standard Boards shrink, warp, turn, crack, separate, leak sap, hold oils inconsistently, have irregular color, have knots, split around nails, crown, and splinter The latter of these conditions are what is going on with this particular deck The floor boards are splintering off after walking traffic and age The stain is not peeling off There is no bleed through There is no surface inconsistency There were no short cuts The project was done to restore the deck to her specifications and in her time frame and budget Is that not what we are here to do?If the drainage of the porch roof over the door was a such to remove the waterfall from above the door into a guttering system would that have prevented the water from wearing out the board that was negatively impacted soonest? The covered area obviously creates this is*** at the drip edge over the board where the board had broken down The rest of the areas are where there are walking traffic is***s Specifically on the corners of the steps and on the floor from the back door to the grill, chairs, and table Those boards splintered TThis is such a small deal I went over and looked at it and realized it was only going to take about minutes to solve I know we don’t warrantee floors but I figured this was easy enough to fix I’ll go ahead and take care of it Then it rained on my first opportunities to get out, then there was no touch up stain, so I supplied my own Then I upgraded the material so she wouldn’t have to worry about the duration of the board I used deck restore 4x to help fill in cracks and extend the life of the now perilous board under water damage I came up with every self deprecating concept to make this easier to placate the exhausting consumer to yield the best result the fastest I was just buying time to get to her when my schedule and resources allowed me the least resistance to incur the expense of resolving any issue. To resolve the issues *** was given:trips to her location to sweep, scrape, prime, and paint times with different products to improve her situationWas given efforts outside and above the contract written in this way to protect our company against the most inconsistent of surfaces and most difficult of task to complete successfully due to climate, ware, and exposureWas told via e-mail and phone that this is not something we will pursueDetailed summary of surface inconsistencies of a preexisting nature outside of my control that just needed to dab about toothpick sized spots that had chipped off where the boards disintegrated She just had to furnish the stain I left when the job was complete last year I’m not a psychologist just a paint professional Those are the facts My decision is final regardless of how this may make the customer in question feel about us, other companies, and any other shortages she feels I need to rectify You typically get a feel for how bad a customer is going to be when you meet them and they tell you how bad everyone that has ever done work at their house is Sometimes you gamble, sometime you give them the most outrageous price to push them away I gambled and lost. I am rejecting this response because:I couldn't accept because there was no offer that I could identify in the Business' responseWe hired Phoenix Painting to perform a job, with acceptable quality standardsMrR***'s suppositions about why I hired him, and the image I portray are irrelevant the complaintI could have hired him for any number of reasonsIt doesn't change the expectation that Phoenix would perform the job with acceptable quality. We are able to provide transcripts and narratives of the timeline, accompanied by pictures and professional references to justify the poor craftsmanshipWe are also prepared to have these references provide oral or written testaments on our behalfWe're also open to having Revdex.com representatives and/or independent contractors do a walk through of the home to inspect the quality of the jobWe have not done anything to the home since we fired Phoenix on March 27, 2015, with the intent to preserve the condition in case a walk through were to occur. I am rejecting this response because:
I am rejecting the response.  The stain is chipping and peeling across the entire deck surface.  A huge piece (approximately 4" by the width of a board) has peeled up.  I contacted [redacted] within the past week to inquire about the application of the stain immediately before heavy rain.  They confirmed that this would impact the adhesion of the stain.   This complaint has been strictly about the chipping and peeling of this product  which I believe was due to the application of it immediately before heavy rains.    I repeatedly questioned applying the stain with the forecast of heavy rain and was told repeatedly it didn't matter.  Obviously it did as the stain is peeling and chipping horribly.Regarding the owner's comments about knowing that I was going to be a difficult customer, I never spoke with him prior to signing a contract.  I dealt with a woman.  I'm shocked that he has turned this issue into a personal attack against me.  When you contract to have work like this done, it is expected to last longer than one year.  I reject his response.
