Phoenix performed a large fire restoration project for Mr. & Mrs. [redacted]. The [redacted]s had several change orders they wanted over and above the fire restoration project. structure loss for the additional change order items. When the project was complete and all city inspection passed, they moved back into their home. All we had left to perform was some small punchlist items. He was presented a final bill which included all his changes. The final bill was roughly 8k less than his total insurance payment made by his carrier, so we stayed in budget and he had no out of pocket for the changes. After he had been in his house for at least a month he informs us his mortgage company which they had been sent all the checks to escrow and disperse through the project that they had sent a check directly to him for 60k. He never informed our company of this until this point and says he has spent all those funds. Mr. [redacted] wanted to be in charge of the mortgage process himself which is not customary on a insurance restoration project. Every check dispersed by his mortgage company had our company name on it except the 60k he received directly without our knowledge. He wrote us a check for 15k, but still has a balance of35k with my company. Now he is claiming workmanship issues over and above the punch list items. This all came about after finding out he had a balance with our company because of the 60k he had spent without our knowledge. This file is at my attorneys office and has been for at least 2 months.

I am rejecting this response because: the information Phoenix provided is inaccurate on several accounts. I can provide pictures and emails to support my claims. For months prior to moving into our house, we informed Phoenix of problems with workmanship and that work was not completed on the house (we never signed the certificate of completion). In addition to this, they are correct in that they never completed the punch-list. A 100% complete inspect was never given (my mortgage company, [redacted] can attest to this). As previously stated, Phoenix overcharged us for several things which I disputed with them several times, charged us for work not done, which I disputed with them several times, and now we have estimates that repairs for their work are going to cost an additional $80,000+ due to their poor work.
