We entered into a contract with The D***'s on 5/23/This contract was not approved by me I had brought in a gentleman who was to buy percent of my company He approved this contract against my will with complete intent to but us in a financial situation I did not want to take the contract because#We were selling it below our price#when we normally take a cash sale we take 1/at signing which would have been $11,1/at permitting $11,and 1/at InstallationThis is standard policy for us but the potential partner insisted on us taking the sale with only $5,down stating he would be funding the job and he felt it was still profitable although I did not agree he was in charge and agreed to take the contract with only $5,dow As it turns out the partner decided he would not put any money into the company until I turned over 100% of the company to him I refused to do that and He deliberately put us in a financial situation to take over my business Although this was going on behind the scenes I still had every attempt to install the D***'s solar system I processed this job as I would any job I did our site evaluation, Permitting, utilities, administrative fees etcI started receiving calls from Mr D [redacted] he was upset because it is not on the roof in days We never tell anyone days it is impossible to install in days especially in Surprise where permits are minimum days and a process would be to daysHe was upset and I told him I would do the best I could which I did Since Gary (the partner) was supposed to fund it and had now changed I was in a pickle I now had to come up with over $22,to buy the material and I was in a cash flow situation I originally did not tell Mr D***, all this it would have been unprofessional I was scrambling to handle it I offered MrD [redacted] that I would make arrangements for him to buy the material directly from Sun Edison and we would still complete the job I explained since time was of the essence for him we were ready to go we just needed the material and that would be the simplest solution to achieve his goals and we could move forward to get his system installedHe would not do and that which caused an immediate red flag to meif he is not willing to lay out the money for the material that would be on his roof in his possession I was concerned Is he going to pay us at all? I could not afford to be in thatsituation so I I agreed with his request to cancel the contract minus our costs involved or really reconsider buying the material directly from the manufacture at one point I even offered to do it at cost to move forward He would not work with me at all He made horrible threats to me and even showed up at my home I was alone he scared me, andthreatened me than and on more than one occasion I agreed to work with him anyway I could but he refusedAll and all its really an unfortunate situation for all parties involved but if you review the contract that Mr and MrsD [redacted] signed did not have a day timeline anywhere in the contract and we have a cancellation clause Sectionof the purchase contract That clearly states that he had the right to cancel but any expenses incurred would bededucted from the deposit and in fact he may owe more than the depositMr and Mrs D [redacted] signed it I would have no problem honoring the contract and give him back any money minus our expenses We did not breech the contract in anyway.Please let me know what the next step isHave a great day[redacted]

***s D*** France's B*** and Rex B*** of Phoenix solar specialist are the owners they decided to accept the contract It is a clear now they did not have the money to honor the contractThey going into financial business with someone else is of no concern to me they did not fulfill there part of the contractSo on 8/19/I ***s D*** spoke with Rex B*** and we agreed that science Phoenix Solar Specialists did not have the funds to honor the contract it would be in both our best interest for them to refund the full deposit and cancel the contractMr B*** agreed and on Phoenix Solar Specialists order change form wrote out to return customers deposit and contract is void as of 8-19-contractor will return deposit by 8-31- The reason 8-31-is because he Rex B*** said they did not have the money at the time but by the end of August they would I ***s D*** have not received any money as of today October 20th What France's B*** did is equivalent to writing someone a check and knowing she did not have the money to cover the check amount and do to the amount should be considered a felony in my personal opinion France's B*** should serve jail time This problem is easily solved by Phoenix Solar refunding the full amount I ***s D*** should not be penalized for France's and Rex B***s bad decision to go into business with someone else them not getting the money from there partner was their problem again I should not be penalized for their bad decisions I have included a photo of the signed change order by Rex B***

We have contacted Mr D[redacted] on several occasions.  I have had a cashiers check for for full payment in my possession for at least 3 weeks. Both of our schedules have been to busy to meet up. I will reach out to him again after the new year & get this resolved.  Thank you for keeping in touch

These people installed my solar system, The sales staff was great, Jesse was a good guy and worked with me all the way.
The problem that I have with this company is with the owners [redacted] and [redacted].
At the time of my install I was told by the owners that if I sent them a new customer and that customer signed a contract with them Phoenix solar would pay me $500.00.
It has been over a year with several calls to [redacted] with no return calls or a check for $500.00.
The bad thing is that they get the money from [redacted] for the new business and they inflate the install to the other customer to pay for the referral to me and then keep the money for themselves.

Review: IN SHORT WOULD LIKE MR REX B[redacted] TO REFUND MY $ 5000.00 DEPOSIT IN FULL AND CANCELL THE CONTRACT BETWEEN I [redacted]S D[redacted] AND MR B[redacted] OWNER OF PHX SOLAR SPECIALISTS . ON GROUNDS THAT THEY HAVE NOT DONE ANY WORK SCENSE OUR CONTRACT ON MAY 23,2015 AND THEY(PHX SOLAR SPECIALISTS ) DOES NOT HAVE THE MONEY TO ORDER MY EQUIPMENT AND THE WHOLE JOB WAS SUPPOSED TO HAVE BEEN FINISHED BY JULY20,2015 ALSO I SPOKE TO MR B[redacted] ON AUGUST 10TH 2015 AND HE SAID HE WOULD REFUND FULL AMOUNT AND CANCELL CONTRACT THAT HE DID NOT HAVE THE MONEY AT THE MOMENT BUT WOULD HAVE IT BY FRIDAY AUGUST14TH . TODAY IS AUGUST 19TH NO MONEY NO CANCELLED CONTRACT AND NO ANSWER FROM MR B[redacted] HE WILL NOT ANSWER HIS PHONE NOR RETURN MY CALL .
