Pickersgill Construction

Pickersgill Construction was fully paid for cement work in my backyard. Not all of the work was completed and messages are no longer being returned.
On July 10, 2017 I received a quote from *** of Pickersgill Construction Ltd. There were three phases to the quote. Phase 1 included pouring a foundation and putting stone down and framing the portion of my backyard patio. The cost of phase 1 was $5,000 cash. *** asked to be paid in full after the foundation was poured which I agreed to.

*** started work on my property (***, Tecumseh) in late July and received his full payment for phase 1 on August 11. In addition, during this time, my driveway had piles of dirt and concrete deposited by *** that he said would be removed after completion
of phase 1. He did not remove the dirt and concrete and I had to pay another contractor $300 to remove it.

I began following up via text messages (copies retained) and phone calls a week later.

Text messages were sent on the following dates:

August 18- Response by *** was he would be here ASAP
August 24 - No response from ***
August 28 - No response from ***
August 31 - No response from ***, I mentioned phase 1 was not finished and wanted him to confirm laying the stone and framing was part of phase 1
September 3 - Response from *** on September 5 that he was away for the long weekend and got the flu; was trying to come by on the 6th to get things back on track
September 6 - Response from *** was that he would arrive before 12:30 on September 7
September 12 and 13 - Response from *** was that he would be there on September 15
September 18 - No response from ***
September 19 - No response from ***, I commented that phase 1 was still not complete
September 20- Response from *** was he would be there on the September 21, the 22nd at the latest
September 22 - No response from ***
September 25 - No response from ***
September 26 - No response from ***
September 28 - No response from ***, I commented phase 1 was fully paid but not complete
October 2 - Informed *** I have reached out to another contractor to finish phase 1 and would be asking him to pay portion for stone and framing - No response from ***
November 13 - provided *** an estimate for work I paid for which he didn't complete and asked him to try and negotiate a settlement and if I did not hear back from him I would file a claim in small claims court
