I have been transferred for my job and needed to move out of my apartment before the lease was up.
I paid two months rent to terminate my contract. That was all good. Approximately $2,600. I met the manager to do a final walk through on February 5, 2020. My mom and I cleaned the apartment in the days previous, and I have almost 30 pictures of everything from the fridge, the microwave, the shower, the floors, the walls, etc. The apartment was just like it was when I moved in. Obviously, I had pictures on the walls, so I spackled those holes. The place was clean and ready for painting.
I never received a copy of the checkout sheet the day of final inspection but I did take a picture of the document on my phone. The property manager, Felicia Neldner, told me she would email me a copy.
The charge of $752 for painting was not on there when I signed the checkout sheet but was on there when she emailed me a copy on 2/10. That is shady in itself!! Even though there was a $35 cleaning charge which I thought was ridiculous since the place was spotless, I wasn't going to argue about $35. A week later, I received Felicia's copy of the checkout sheet, and Felicia had added $752 for primer and paint for nicotine stains and odors. First of all, I never smoked in my apartment, and secondly, painting is normal wear and tear.
I have told her we will take her to small claims court since I have proof of the excellent condition that I left the apartment in. I am hoping that this is not necessary for me or her and that you can help resolve this issue. This charge cannot be legal. Normal wear and tear is in every contract for a reason!!!! Painting is a normal maintenance item!!!!!

In response to the complaint received by the Revdex.com on February 11, 2020:A security deposit is an amount of money paid by a renter when beginning to rent property,and it can be used to pay for any damage that the renter causes to the property.Tenant damage was present in the form of cigarette smoke damage which was also adirect violation of the lease. The cigarette smoke odors seeped into the wood beams andwood ceiling as well as the walls and carpeting. The entire apartment was painted withBin Shellac Primer for the purpose of blocking stains and odors, and paint was thenrequired on top of the primer. The smell was still present, so the carpet was shampooedto further remediate the smell. Even with these treatments, the cigarette smoke smellremains as it has been absorbed into the wood columns and heavy timber exposed ceilingsin the unit. The cigarette smoke odor was verified by various members of the managementcompany as well as other professionals outside of the management company whoconducted remediation of the unit. Multiple prospects that toured the unit also commentedon being put off by the nicotine odor. The unit was never lived in prior to this tenant as itwas new construction.Wisconsin Administrative Code states the landlord may withhold amounts reasonablynecessary to pay for tenant damage, waste, or neglect of the premises. Cigarette smokeodor is damage above and beyond normal wear and tear. If any portion of a securitydeposit is withheld by a landlord, the landlord shall within 21 days after the date on whichthe rental termination agreement terminated, deliver or mail to the tenant a writtenstatement accounting for all amounts withheld. Revdex.com:I used to live by someone who cooked a lot of Indian food. You could smell it throughout the building. Should they be punished for that? I could understand charging for this “special “primer” but why should I have to pay for what is normal maintenance before a new tenant moves in. This company has had a few questionable practices. I have, will continue to write unfavorable reviews for this management company.

I did not smoke in the apartment, although they accused me of it. They have 4 open units in this apartment and are just trying to make as much money as they can! If they had to use a special primer to get rid of smell, charge me for that, but not for the entire painting of the apartment and carpet cleaning. This is a bogus claim, and if my mom was not just diagnosed with cancer, I'd be in court fighting them for my deposit. My mom is more important than they are!!! Shady, shady, shady!!!
